The property is a corner lot with approximately 267 feet of road frontage on West Shore Road,226.4 feet along the southerly property line and 223.3 fiect along a private road on the easterly property line. The property is improved with and existing 2 story dwelling with an enclosed porch,and an accessory garage. The driveway to the garage is accessed from West Shore Road. All as shown on the,survey by Kenneth M.Woychuk Land Surveying,dated August 20,2018. BASIS 01IJQA .-.F-AEL— -1LO—N: (Adjourned from December 19, 2019)Request for Variances from Article XXIII, Section 280-124 and the Building Inspector's June 12,2019,Amended October 4,2019 and Notice of Disapproval based on an application for a permit to construct additions and alterations to a single family dwelling;at, 1)less than the code required minimum front yard setback of'40 feet;2)less than the code required minimum rear yard setback of 50 flet;located at 155 West Shore Road,Southold,NY.SCTM No. 1000-80-2-25. RELIEF REQUESTED: The applicant requests variances to demolish the existing residence and to construct a new residence with a front yard setback of+/-35.7 feet where a minimum of 40 feet is required,and a rear yard setback of 34.1 feet where a 50 feet minimum is required. ADQITIONAL.I­NfC)�RMATIQ During both written and oral testimony from the applicant's agent at the public bearing on December 5,2019,it was determined by the Board of Appeals,that the proposed project met the definition of a demolition. The applicant was asked to hire a licensed professional to prove otherwise.The Board received an Page 2,June 25,2020,Amended October 15,2020 #7338,Cimino SCTM No.1000-80-2-25 c mail on December 18,2019 from the applicant's agent stating that the architect indicated that the extent of the work proposed did indeed exceed the 504'r'o threshold and met the definition of a demolition. On December 24,2019 the applicant was instructed in writing to obtain a revised Notice of Disapproval for the demolition and to return for another public hearing on March 5, 2020, Prior to that hearing,the applicant's agent did not submit an amended Notice of Disapproval but rather chose to testify during the second public hearing, as to the reasons why,despite the demolition, the applicant did not propose to move the new dwelling to a location on the subject property with conforming front and rear yard setbacks, AMENDED DECISION OCTOBER 15 2020 On August 4, 2020, the applicant's agent submitted a letter to the Board of Appeals explaining that the setbacks of the existing dwelling shown in the Site plan submitted with the original application were in error, and submitted a corrected site plan and architectural plans prepared by Harold E. Gebliard,R.A.,revised August 31,2020.This corrected site plan shows a front yard setback of 32.9 feet and a rear yard setback of 37.7 feet for the"as built"dwelling,as originally granted as alternative relief in this decision.The agent also requested that the Board remove condition No. I in the June 25,2020 decision which requested that the applicant obtain an amended Notice of Disapproval from the Building Department for a demolition,rather than additions and alterations to an existing dwelling as cited in the Notice of Disapproval. The Building Department confirmed that since the Z.BA decision had already been rendered determining that the application involved the demolition of the existing dwelling and construction of a new dwelling,no new Notice of Disapproval is needed.Therefore, on October 15, 2020,the Board accepted the corrected architectural plans and site plan,and rescinds condition No.I of the June 25,2020 1 decision(see CONDITIONS). FINDINGS OFFACT/ -SIO&S—EF®RB ARP A2MIQN- �----UA The Zoning Board of Appeals held public hearings on this application on December 19,2019 and March 5,2020 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds(be following facts to be true and relevant and makes the,following findings: 1. Town Law '267-bI3,b)(l,)., Grant of the variances as applied for will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties, The proposed reduction of the existing non- conforming setbacks for a new dwelling will produce a house that is much larger than and out of scale with surrounding houses on similar properties and will create additional non-conformity on a property that is already, characterized by non-conforming setbacks, 2. Town Law 4267-b(3)(!2J(2). The benefit sought by the applicant to build a now dwelling that is substantially larger than the existing dwelling cannot be achieved without some form of variance relief due to the triangular shape oftbe subject property with two front yards.Flowever,alternative relief will allow the applicant to achieve his goals without creating more non-conformity than what currently exists. 3. Town Law§267-b(3)(b)(3'). The variances granted herein as alternative relief are mathematically substantial, representing 24.0o relief from the code required setback for the rear yard and 17,75%relief for the front yard setback. Ilowever,maintaining the existing non-conforming setbacks,while still less than the setbacks required by code,will have less adverse impact on the character of the neighborhood than the relief requested. 4. Town Law§267-b(3)(bJ(4). No evidence has been submitted to suggest that a variance with amended relief in this-residential-curriniunity will have, an adverse impact orr the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and conditions imposed by this board. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time ofpurcliase, 6.
