PH 1015 9:01 Am Harbor View Cottages, LLC Coastal Erosion
RESOLVED the Town Board of the Town of Southold hereby sets Tuesday, October 5,
2021 at 9:01 AM. at the Southold Town Meeting Hall, 53095 Main Road, Southold, New
York as the time and place for a public hearing upon the Coastal Erosion Hazard Board of
Review Appeal of Harbor View Cottages, LLC (c/o Thomas Shillo) which seeks relief from
Chapter 111, applicant seeks to remove an existing 3' x 11.5' ramp, 8' x 15.5' float and piles as
necessary, all of which were approved under a previous wetlands permit; construct a 6' x 20'
extension onto the seaward end of a 6' x 59' fixed dock, which was approved under a previous
wetlands permit and install a 4' x 16' aluminum ramp, 12 new piles and an 8' x 18.5' float.
Under Section 6 Definitions - Unregulated Activities, the proposed reconstructed dock exceeds
the 200 sf limitation, and therefore by code, must be removable. A dock of less than 200 sf

could not be used for docking as it would not be long enough to reach the depths needed to
safely dock a boat due to water depths. The proposed work is within a near shore area in a
Coastal Erosion Hazard Area located on property on parcel SCTM# 1000-10-9-6.1, 520 Sterling
Street, Fishers Island,New York, and directs the Town Clerk to publish notice of such appeal in
the Suffolk Times and The Day newspaper not less than ten (10) days nor more than thirty (3 0)
days prior to such hearing and to notify the applicant by first class mail.

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
Parking associated with Love Lane businesses, specifically in Deans Parking Lot in the
Hamlet of Mattituck, has resulted in conditions that impact the surrounding community.
At the request of local business owners and with the approval of the Transportation
Committee, it has been determined that creation of a loading zone adjacent to the
commercial establishments will both alleviate congestion and facilitate the delivery of
goods to the Love Lane businesses. Accordingly, an amendment to Chapter 260 is
warranted.
II. Chapter 260 of the Code of the Town of Southold is hereby amended as follows:
§ 260-22. Loading Zone.

ROBERT DUNN: Robert Dunn, Peconic. Thank you. Sorry I couldn't be there. I really wanted
to give you a little update on the inlet. The armament has just worked out so well, this year 30
trees have popped up. Next year it's going to be a forest. That was a real good thing. On the
dredging this year and I was really impressed by it. It was doen by Tim Abrams because Jamie
is gone and Michael was on vacation at the time and Tim followed Jamie's plan to a T. And that
dredging I think is one of the best that was ever done and I think it can be proved by the fact that
it's withstood two hurricanes in a month and it's just fine. The beach, the shoreline is actually 20
feet further out than it was before and it's holding. The spits regrowing as it always does but I
felt that I needed to comment on that and comment on the success of it. The second comment,
this morning you discussed special events and how they are not so special anymore, tonight you
approved three more packages of them. This week I was made aware of a proposal by the
enclaves that hasn't even got a shovel put in the ground that has put in their DEIS, noted that they
are going to do 12 special events a year. If you are a business and your business model is 12
special events, then they are not special events, point made. Can you hear me?
SUPERVISOR RUSSELL: Yes. Are you looking for a response?
MR. DUNN: Did I make my point?
SUPERVISOR RUSSELL: You did but let me just clarify with reference to the actions that
were taken tonight, one of them was for five events over the course of several weekends, it's the
only events that have been applied for all year, either prior or subsequent. Five events over the

course of the year would seem to be more consistent with what the intent of the special events
legislation is, in other words, it's not.....
MR. DUNN: Absolutely. I totally agree with you.
SUPERVISOR RUSSELL: And then the other one that we approved, it was for a successive
weekend but it's for a Christmas tree farm that has a definitive date that it works around, in other
words, there's only one Christmas a year and they do open up for several weekends prior to
Christmas, which is the nature of being able to maintain a Christmas tree farm. But there are no
special events after Christmas, throughout the spring, summer etc. so, that's why those are
approved and the other one was approved at a commercially zoned property, so that's all that
was.
MR. DUNN: Scott, I am not talking about any individual one, my point is we, this happens
every meeting whether it's six or twelve or eighteen, it just, it seems to be an important part of
town business now is approving special events. Well, my point is that if there's so many special
events, they are really not special and that needs to be addressed. And now we have a business
that isn't even in operation that is proposing 12 special events a year, I just, my question is just
with the conversation you had this morning and I really think this year ought to be finished out
and everyone ought to be treated fairly but in the end, the town needs to reexamine their policy
of special event and what is a special event, if it is a special event and you want to pass it, I
concede to your judgment on that, fully. That is what you guys are elected to do but if the
practice is that we have special events just so we can circumvent something, then that's not a
special event. And when a business is not even in operation yet and they are already talking that
they are going to do 12 special events a year, then special events become a fallacy. That is the
point I am making. I am not directing it at any one person, or group or business what I am
saying is, as a town there is a need to identify what a special event is and stay consistent with it
and I don't think a business that isn't even in operation yet that is proposing 12 special events is
staying consistent with the concept of special events and that is just the discussion point. That is
not a criticism of anybody. For me, I would like to see this done in a good manner and one that
supports both the people and the residents and the businesses of our town. That's it.
