This proposal is for a Standard Subdivision of a 4.29 acre parcel into two lots where Lot 1 is 2.07
acres and Lot 2 is 2.22 acres, with a 25'flag over Lot 1 to provide access to Lot 2, located in the
R-80 Zoning District.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department,the proposed action is CONSISTENT with the LWRP below listed
policies provided that the following is required to further and/or meet the policies:
Policy ]. Foster a pattern of development in the Town of Southold that enhances community
character,preserves open space, makes efficient use of infrastructure, makes beneficial use of a
coastal location, and minimizes adverse effects of development,
The proposed action is for two residential lots on a 4.29 acre parcel. The parcel is located in
Orient. The use does not conflict with the Residential 80 zoning district or community plans,
however, adverse impacts to groundwater and eventually surface waters may occur as a result of
the action. Best management practices are proposed below to mitigate the potential impacts.
Access to the lots is proposed from Platt Road. A 25' wide flag is proposed to serve Lot 2.
Policy 2.2. Protect and preserve archaeological resources.
A. Conduct a cultural resource investigation when an action is proposed on an
archaeological site,fossil bed, or in an area identified for potential
archaeological sensitivity on the archaeological resources inventory maps
prepared by the New York State Department of Education.
1. Conduct a site survey to determine the presence or absence of
cultural resources in the project's potential impact area.
2. If cultural resources are discovered as a result of the initial survey,
conduct a detailed evaluation of the cultural resource to provide
adequate data to allow a determination of the resource's
archaeological significance.
The New York Department of State Cultural Resource Information System
(CRIS)was consulted to determine if the applicant had inquired about cultural
resources on the property. No records were available. The property directly to
the south known as the Standard Subdivision of Old Orchard has an open inquiry
(Reference 15PR02545).
Due to the parcel location and historic relevance of cultural resources on the
Orient peninsula,the applicant should contact the NYS CRIS database
littps://cris.parks.ny. 70, v/Lo in.aspx?ReturnUrl=%2f and provide the response to
the Planning Board to further this policy.
Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold.
The parcel is located south of Platt Road, and is not visible form New York State Route 25, a
Scenic Byway.
E. Preserve existing vegetation and establish new indigenous vegetation to enhance
scenic quality:
Clearing limits will be applied reducing the area turf, fertilization and pesticide
application and irrigation on the lots. Street trees are also required along Platt
Road.
J. Protect visual quality associated with public lands, including public
transportation routes,public parks and public trust lands and waters.
Platt Road is a public transportation route. Any future residential is not expected
to be discordant with the existing scenic character of the area and the structures
will be required to be set back from Platt Road.
K. Protect visual quality associated with agricultural land, open space and natural
resources.
3. Avoid structures or activities which introduce visual interruptions to
natural landscapes including:
a. introduction of intrusive artificial light sources
It is recommended that the Board waive street lighting requirements to
preserve the night sky in the area pursuant to § 240-46. Lighting.
Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion.
The property is not located within a mapped FEMA flood zone.
Policy 5. Protect and improve water quality and supply in the Town of Southold.
The parcel is located above a sole source aquifer that supplies Orient with potable water. The
water supply to surrounding properties is sourced from private wells. Recent studies have
identified nitrogen loads and saltwater intrusion as threats to the water supply in Orient. The
condition and depth of the freshwater lens in this area is unknown.
Recommendations to mitigate potential impacts to groundwater and surface waters include:
a. The installation of a Suffolk County Department of Health Services approved I/A
OWTS's on each residential lot;
b. Installing water supply wells with a maximum 10 gpm flow to meet the new water
demand to minimize upconing and saltwater intrusion.
To meet and further LWRP policies 5.2, 5.3, 5.4 and 5.5 below and protect the ground water
and surface waters of Orient, it is recommended that the Board require the following best
management practices in a Covenant and Restriction applied to each residential lot:
Policies
5.2. Minimize non point pollution of coastal waters and manage activities causing
non point pollution.
5.3. Protect and enhance quality of coastal waters.
5.4. Limit thepotential for adverse impacts of watershed development on water
quality and quantity.
5.5. Protect and conserve the quality and quantity of potable water.
a. Require the use of native, drought-tolerant plants in landscaping.
b. Area of irrigation should be limited to 15 percent of the lot area.
c. Require rain sensors to promote responsible irrigation methods.
d. Require only the use of organic fertilizers where the water-soluble nitrogen is
no more than 20% of the total nitrogen in the mixture.
e. Require a maximum of 1 lb. of nitrogen per 1000 square feet in any one
application, with a cumulative application of no more than 2 lbs. per 1,000
square feet per year.
f. Prohibit the application of fertilizer products containing nitrogen, phosphorus,
or potassium between November 1St and April 1St
g. The use of phosphorous containing lawn fertilizer is prohibited unless
establishing a new lawn or soil test shows that the lawn does not have enough
phosphorus. Fertilizer labels have three bold numbers. The number in the
middle is the percentage of phosphorus in the product, e.g. 22-0-15. Use of
products with 0.67 in the middle or lower is not restricted. Products with a
number higher than 0.67 may only be used if a new lawn is being established
or a soil test indicates it is necessary.
As indicated above,to further protect groundwater clearing limits will be required for
each residential lot (clearing limits reduce turf areas that require fertilization,
irrigation and herbicides and insecticides).
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem.
The NYSDEC Environmental mapper was consulted and the parcel is not located within an
environmental designated area.
Policy 12.3. Minimize adverse impacts on agriculture from unavoidable conversion of
agricultural land.
Soils on site are comprised of HaA (Haven Loam 0-2 percent slopes), a prime agricultural soil.
Correspondingly, the parcel is listed on the Town of Southold Community Preservation Project
Plan (2017). Agricultural soils would be converted to residential use as a result of this
subdivision. Due to the size, location and residential use of the property, the likelihood and
suitability of farming of the parcel is expected to be low. The permanent loss of agricultural
lands/soils will be limited where structures will be constructed and to is unavoidable in this
instance.
