The proposed action is for the purchase of 1.6 sanitary flow credits from the Sanitary Flow
Credit Bank(Mattituck)to construct a one-bedroom affordable housing apartment unit, a
restaurant and dry retail store in the former North Fork/Capital One building located in the
Hamlet Center of Mattituck.
The action has been reviewed to Chapter 130 Environmental Quality Review of the Southold
Town Code and the New York State Department of Environmental Conservation regulation
6NYCCRR Part 617 State Environmental Quality Review and it is my recommendation that the
Town Board, as lead agency, issue a Negative Declaration for this Unlisted Action pursuant to 6
NYCRR Part 617, Section 617.7 of the State Environmental Quality Review Act(SEQRA).
This determination was based upon the information provided in the file, the Short Environmental
Assessment Form dated April 25, 2019 and the results from the NYSDEC Environmental
Mapper Program, the Town of Southold Local Waterfront Revitalization Program Coastal
Consistency Review consistent recommendation and lastly, the Southold Town Planning Board
report dated June 27, 2019.

Mattituck, NY 11952"
The proposed "Application for Transfer of Sanitary Flow Credits Hard Corner Properties,
LLC, 50 Pike Street Mattituck, NY 11952" has been reviewed to Chapter 268, Waterfront
Consistency Review of the Town of Southold Town Code and the Local Waterfront
Revitalization Program (LWRP) Policy Standards. Based upon the information provided to this
department as well as the records available to me, it is my recommendation that the proposed
action is CONSISTENT with the LWRP Policy Standards 1, 5 and 6 and therefore is
CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Town Board shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

Re: Transfer of Sanitary Flow Credits Application for Hard Corner Properties,

The Planning Board has reviewed the Application for Transfer of Sanitary Flow Credits
hard Corner Properties, LLC, 50 Pike Street Mattituck, NY 11952.
The applicant is proposing to construct a one-bedroom affordable housing apartment
unit (unit), a restaurant and dry retail store in the former North Fork/Capital One building
located in the Hamlet Center of Mattituck. The construction of the unit requires 1.6
sanitary flow credits to be purchased from the Sanitary Flow Credit Bank (Mattituck).
Chapter 917 Sanitary Flow Credits, Transfer of the Southold Town Code requires that
the Planning Board evaluate the application to the following criteria:
1. The effects of potential increased development which is possible under the
transfer of development rights;
The property is zoned HB and is located within an eligible receiving district. The
purpose of the zoning district states:
The purpose of the Hamlet Business (HB) District is to provide for
business development in the hamlet central business areas, including
retail, office and service uses, public and semi-public uses, as well as
hotel and motel and multifamily residential development that will support
and enhance the retail development and provide a focus for the hamlet
area.

The proposed transfer of 1.6 sanitary flow credits to construct the unit does not
conflict with the purpose of the HB Zoning District. The parcel is improved and an
expansion of the building footprint is not proposed. The increase of one dwelling
unit through renovation and re-use of the existing building will increase
residential density in the Hamlet Center by one unit.
2.' That the district contains adequate resources, environmental quality and public
facilities, including adequate transportation, water supply, waste disposal and fire
protection;
Adequate Resources
The parcel is located within the Hamlet Center of Mattituck, west of Love Lane
and South of Pike Street near many commercial uses that would support the unit.
The U.S. Post Office, LIRR Train Station, religious institutions, grocery stores,
restaurants and other commercial businesses are located nearby and are easily
within walking distance.
Environmental Quality
The applicant has submitted a SEQR Short EAF and results from NYSDEC
Environmental Mapper Summary Report. Environmental constraints have not
been identified on or in the proximity of the parcel. The potential adverse impacts
to community character, traffic and water quality and quantity will be negligible.
The building is not listed on The Society for the Preservation of Long Island
Antiquities (SPLIA) map.
Public Facilities
The Hamlet Center contains adequate public facilities. A municipal parking lot is
located to the south of the parcel. The Mattituck Train Station is located across
Pike Street from the parcel providing public transportation.
Adequate Transportation and Pedestrian
Impacts to transportation from the transfer of 1.6 sanitary flow credits and
creation of one,unit are low. Two vehicle parking spaces are required for the use.
Parking is adequate in an improved parking area located in the rear of the parcel
or along Pike Street and Love Lane; both,public streets.
Pedestrian sidewalks and crosswalks are located throughout the Hamlet Center.
Sidewalks and crosswalks are located adjacent to the building on Pike Street and
Love Lane. Pedestrian infrastructure connecting commercial uses and public
transportation is available and adequate.

Water Supply
The property is connected and served by public water.
Waste Disposal
The estimated sanitary flow proposed for the unit is 150 gallons per day. The
calculated sanitary flow for the parcel is 470 gallons per day and the total number
of uses proposed is 939 gallons per day. Double density on the parcel is equal to
940 gallons per day.
The total number of sanitary flow credits in the Mattituck Sanitary Flow Credit
Bank is 17.14. The applicant is proposing to purchase 1.6 credits. Following the
purchase, 15.54 credits will be available.
The purchase of the sanitary flow credits mitigates the potential adverse impacts
to water quality (on a town wide basis) that could result from the uses proposed.
3. That there will be no significant environmentally damaging consequences; and
that such increased development is compatible with comprehensive planning and _
the development otherwise permitted by the Town and by the federal, state and
county agencies having jurisdiction to approve permissible development within
the district.
The addition of the unit is compatible with, and supports the 2007-2008 Hamlet
Study and Mattituck Stakeholder recommendations, Policies 1, 5 and 6 of the
Town of Southold Local Waterfront Revitalization Program and is consistent with
the Draft Comprehensive Plan Housing Chapter goals and objectives by
proposing the adaptive re-use of an existing commercial structure through
renovation to increase affordable housing inventory.
4. Sanitary flow credits shall not be transferred out of the school, special
assessment or tax districts unless the Town Board determines that there is no
other available lot within said districts to which a sanitary flow credit may
reasonably be transferred and that the transfer does not unreasonably transfer
the tax burden between the taxpayers of such districts.
The proposal includes the transfer of sanitary flow credits within the same school
district.
