SCTM# 30-2-78 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policies and therefore, INCONSISTENT with the LWRP. There is evidence of moderate to severe erosion on the bluff(sloughing) indicating that the soil characteristics of the bluff are unstable. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The Applicant currently enjoys access to the Long Island Sound Beach. The Planning Board designed Open Space Area E (SCTM lot#21-5-10) in the Pebble Beach Farms subdivision, located east of the property to provide access to Long Island Sound, a bathing beach, a parking area, and a path to the beach. The area is maintained by a Homeowners Association, as per the Covenants and Restrictions dated May 14, 1975. Therefore, the proposed action is not permissible pursuant too Chapter 275-11, B. 0) which states: "Individual residential stairs are prohibited on bluffs if the property is part of an association that maintains a common stairway within a reasonable distance."
