POLICY: At the beginning of scheduled Town Board meetings, the attending public is
encouraged to briefly address the Town Board relating to agenda resolutions prior to their
enactment; the public will also be given time at the conclusion of the regularly scheduled
business agenda to address the Board on any given topic.
ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting.
The video of the meeting is usually available to watch live during the meeting. Minutes with
adopted resolutions are available 1-2 days after the meeting. A full copy of the minutes, agenda
and meeting video can be viewed by going to the official Town of Southold website:
www.southoldtownny.gov and following either of the following:
(1) Move pointer over “Government” on the Town website home page. You will find the title
“Town Supervisor/Town Board”. Under this title you will see “Southold Town Board Meetings
and Agendas”. or
(2) Go to “How Do I”, in the right upper corner of the Town website home page, Choose
“Access”, then “Southold Town Board Meetings and Agendas.
Go to the date of the meeting and click on "Minutes Packet" this is the full copy of the
resolutions. (Scroll to bottom of page for KEY to symbols). You can view the live video of the
meeting by clicking on the camera symbol. All of this information is available 24/7.

Due to the expiration of the New York State Governor’s Executive Orders regarding the
COVID-19 pandemic in-person access to the Public will now be permitted. The meeting will
still be accessible via Zoom and streamed live on the Town’s website. The meeting can be
viewed live by going to the Town’s website at www.southoldtownny.gov home page. Click on
the “Government” tab, once the drop down menu appears, under “Town Supervisor/Town
Board”, click on “Southold Town Board Minutes and Agendas” which takes the user to the
Town of Southold Meeting Portal page. Once on the Meeting Portal page, click on “June 29,
2021 4:30PM” and then click on “Video”. A recording of the meeting will also air on Channel 22
and will be posted on the Town’s website

Instructions and link to attend the meeting will be available on the Town’s website or by calling
the Town Clerk’s office at (631)765-1800. A telephone number will also be provided to allow
members of the public to attend via telephone.

and/or questions will be considered at the public hearing provided that they are submitted no
later than 12:00 P.M. (Prevailing Time) on the day of the public hearing.
Pursuant to the requirements of the Executive Order of the Governor of the State of New York, a
transcript will be prepared of the public hearing, and a copy shall be filed with the Town Clerk
and placed upon the Town's website.

WHEREAS on May 31, 2021, a complaint was received regarding a violation of Section 100-
4(A) Section 100-4(A) of the Southold Town Code, “Property Maintenance”, at the property
located at 145 Williamsburg Road, Southold, NY. SCTM #1000-78-5-13, and on June 1, 2021,
this alleged violation was confirmed by Town of Southold Code Enforcement; and
WHEREAS on June 1, 2021, a Notice of Violation and Order to Remedy the condition by June
30, 2021, was served upon the owner of record and posted at the subject property; and
WHEREAS as of July 1, 2021, the property had not been brought into compliance with Section
100-4(A) of the Southold Town Code and on July 29, 2021, employees of the Town of Southold
Department of Public Works were dispatched to the property and performed the maintenance
required to bring the property into compliance with Town Code, now, therefore, be it
RESOLVED that the Town Board of the Town of Southold, pursuant to Section 100-10 of the
Southold Town Code, hereby directs that the costs and expenses incurred by the Department of
Southold Town Meeting Agenda - September 21, 2021

Public Works in effectuating the cleanup of the property located at 225 Williamsburg Rd,
Southold , in the amount of $559.70 shall be levied against the real property of Thomas Peters,
SCTM #1000-78-5-13, and that said costs and expenses are to be collected at the same time and
in the same manner as the Town taxes.

E-Filing System for Filing a SCAR Petition(S)
WHEREAS, the County of Suffolk and each of the ten Suffolk County Towns are in a State of
Emergency with the entire State of New York as declared by the Governor as of March 7, 2020,
due to COVID-19; and
WHEREAS, in light of the foregoing, the Town of Southold, the Supervisor, the Board of
Assessors and the legal representatives of the Town recognize the need to reduce expenses, to
conserve resources and to maintain some type of “social distancing” now and into the future.
Therefore, there is a need to make certain changes to the current procedure for the application of
a real property tax exemption(s) authorized under Article 4 of the Real property Tax Law.
Changes to the current application process would not only limit the personal contact between the
public and assessment staff, but also greatly reduce the already limited resources of the Town
reviewing and processing the large number of exemption applications that are generally filed
each year; and
WHEREAS, the filing period for such exemptions is imminent and the adoption of an E-Filing
system is in the best interest of both the Applicant and the Town; and

WHEREAS, the use of a uniform E-Filing system for filing a SCAR petition(s) upon the Town is
currently provided for by the Real Property Tax Law §104(1)(a) and the proposed uniform E-
Filing system provides Complainants with the same protections they currently enjoy; and
WHEREAS, the adoption of a uniform E-Filing system is not intended to replace a Petitioner’s
ability to file grievance complaints in accordance with the current statutory and regulatory
framework but rather it is to be an alternative thereto; and
WHEREAS, the Procedures and Protocols will be located at:
<<http://southoldtownny.gov/FormCenter/Assessors-11/Exemption-Applications-
Electronic-Filing-65>> and incorporated herein adequately address the concerns of the
Applicant and the Town; and
WHEREAS, in accordance with the provisions of Real Property Tax Law §104, the adoption and
implementation of a uniform E-Filing system for the application of an exemption(s) authorized
under Article 4 of the Real Property Tax Law shall be deemed to be in compliance with all the
provisions of the Real property Tax Law and all other applicable laws, rules & regulations
effecting the process of filing such applications relative to the assessment of real property.
NOW, THEREFORE, BE IT RESOLVED, the Town Board hereby authorizes the Chair of the
Board of Assessors to accept an application(s) for an exemption(s) authorized under Article 4 of
the Real property Tax Law in accordance with the provisions of Real Property Tax Law §104
and shall adopt and implement a uniform E-Filing system that complies with the aforesaid
section 104 and all other applicable laws, rules & regulations that are applicable to the service of
exemption applications upon the Town.

porch along the easterly side of the dwelling, install a new propane tank along the westerly
portion of the property, construct a new 50 square foot basement entry along the westerly side of
the dwelling, install new IA/OWTS septic system landward of the dwelling, construct a 2. 5 foot
high (maximum height) by 97. 5 foot long retaining wall along the northeast corner of the
property, and as depicted on the survey prepared by Gary Benz, L. S. Received on February 12,
2021, within a near shore area in a Coastal Erosion Hazard Area located on property on parcel
SCTM# 1000- 31- 18- 18, 860 Rabbit Lane, East Marion, New York, under the Town of
Southold Coastal Erosion Hazard Areas Law (the “Law”) of the Town of Southold pursuant to
Section 111-11(c); and

WHEREAS, on July 20, 2021, the Applicant submitted an application to the Town Board of the
Town of Southold seeking to appeal the determination of the Board of Trustees, or in the
alternative, seeking a variance from the requirements of the Law; and
WHEREAS, on September 21 2021, the Town Board conducted a duly noticed public hearing
on the instant appeal with an opportunity for all interested parties to be heard and testimony was
taken of the Applicant’s consultant and other interested parties; and
WHEREAS, the application has been reviewed pursuant to Chapter 268, Waterfront
Consistency Review of the Town Code and the Local Waterfront Revitalization Program; now,

erosion hazard area permit pursuant to §111-20 of the Town of Southold Coastal Erosion
Hazard Area Law and be it further
RESOLVED that the Town Board had determined that this action is consistent with Chapter
268, Local Waterfront Revitalization Program; and be it further
RESOLVED that this Determination shall not affect or deprive any other agency of its properly
asserted jurisdiction, separate and apart from the proceedings under the Coastal Erosion Hazard

BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The purpose of this local law is to improve safety for pedestrians and vehicles, as well as
dealing with impacts to the public’s health, safety and welfare.
II. Chapter 260 of the Code of the Town of Southold is hereby amended as follows:
§260-4. Stop intersections with stop signs.

III. SEVERABILITY

I. Purpose
The Purpose of the amendment is to improve safety for emergency vehicles, pedestrian and
passenger vehicles, as well as dealing with impacts to the public’s health, safety and welfare
resulting from vehicles parking and standing on Sunset Lane in the hamlet of Greenport.
II. Amendment.
The Southold Town Code is hereby amended by adding the underlined words as follows:
§189-2 Designation of areas requiring parking permits.
B. The following road end areas are hereby designated as Town of Southold "Parking by
Southold Town Permit Only" area:
(60) Sunset Lane, Greenport, on both sides, beginning at the intersection with Sound Drive
extending southerly for a distance of 350 feet.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
