Kaminski Living Trust PROPERTY LOCATION: 805 Bay Haven Lane, Southold NY 11971 SCTM: 1000-88-4-33 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE., This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 15,25 square feet, .36-acre, rectangular lot located in the R40 Residential Zone„measures 125 feet along Bay Haven Lane, then runs east 125 feet along a residentially developed lot to the north, then runs south 125 feet along two residentially developed lots to the east and returns 125 feet along a residentially developed lot to the south. The parcel is developed with a one-story,wood- frame dwelling with attached 2-car garage, a covered front porch, walkway, asphalt driveway, outdoor shower, central air conditioning mechanicals,a generator, and 8.2 feet by 10.2 feet shed as shown on the survey prepared by Kenneth M.Woychuk Land Surveying,PLLC and dated April 16, 2021. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124; and the Building Inspector's May 18,2021 Notice of Disapproval based on an application for a permit to demolish and reconstruct a single-family dwelling; at; 1) more than the code permitted maximum lot coverage of 20%; located at: 805 Bay Haven Lane, Southold,NY. SCTM No. 1000-88-4-33. RELIEF REQUESTED: The applicant requests a variance for the demolition of a single-family residence, 2 car garage and other improvements and for the reconstruction of a 2-bedroom, single-family residence with an attached four-car garage with a walk-up attic storage area on the second floor,a new covered front porch, a rear deck,a three- season sunroom,and an outdoor shower with a total lot coverage of 25.6%where the code limits such improvements to 20% lot coverage. AMENDED APPLICATION: During the hearing,the applicant was asked to bring the plan into more conformity with the code. The applicant on September 13,2021 submitted a new plan reducing the proposed lot coverage from 25.6% to 22.6% and on September 14, 2021 submitted a new site plan further illustrating this reduction from the originally proposed, and bringing the plan into more conformity with the code. Additionally, the applicant reduced Page 2, September 16,2021 #7536 Kaminski SCTM No. 1000-88-4-33 the depth of the proposed attached garage from 47.9 feet to 37.9 feet which is the same depth as the opposite side wall of the existing dwelling,thereby reducing the impact on the adjacent neighbor to the north. The subject property is covered by the following Certificate of Occupancy: Z-6701 dated September 24, 1975 covering a private one-family dwelling Z-12656 dated July 31, 1984 covering a deck addition to an existing dwelling Z-19391 dated September 27, 1990 covering a deck addition to an existing dwelling There is no record of a Certificate of Occupancy for the central air conditioning,the generator,or the outdoor shower illustrated on the survey and observed during the Board's site inspection. No prior variance has been issued by the Zoning Board of Appeals in relation to the subject property. The applicant and their agent indicated that the property owner has a collection of several vintage/antique cars that they wish to store on site for ease of repairs and personal enjoyment. Additionally, that the house basement periodically floods,promoting the need for dry storage in the proposed attic, over the garage. The applicant added that while the renovation is substantial, it is in keeping with the nature of the residential community and that since the owner proposes no increase in the number of bedrooms the existing sanitary system is sufficient and that a new, Suffolk County Board of Health approved I/A system is unwarranted,despite the demolition of the existing residence. The applicant provided the Board with two prior decisions granting relief, as evidence of excessive lot coverage, supporting their application: #5627 dated January 5,2003 Granting relief of 22.3% lot coverage, for alterations and additions to a waterfront residence,where the code permits a maximum of 20%lot coverage. #7451 dated January 22,2021 Granting relief of 22.2% lot coverage, for the addition of an accessory inground swimming pool,where the code permits a maximum of 20% lot coverage. While the Board considers prior decisions to assist in establishing relief for an applicant, it is encouraged that examples of similar hardship should be for the immediate neighborhood of the applicant's property. In the case of ZBA decision #5627, the applicant is a waterfront property owner outside of the Bay Haven private community where the subject parcel is located. As a result of the unique hardship of developing a waterfront parcel,this applicant had greater relief granted in order,to meet setbacks and to comply with other authorities. Similarly, decision#7451 is also located in another private community—Terry Waters;located adjacent to the Bay Haven private neighborhood. However, in this case the relief granted was to allow for the non-dimensional installation of an inground swimming pool which has little visual impact on the character of a community versus the massing of a more dimensional improvement such as a framed structure would. Neighbors spoke in opposition to the application, including a resident to the immediate north of the subject parcel who retained legal counsel on her behalf. The neighbor's attorney, in advance of the public hearing, sent a detailed letter outlining their opposition to the proposed excessive lot coverage. The public hearing was adjourned to September 16, 2021 allowing the applicant to amend their design to reduce lot coverage and bring the application into better compliance with the Town Code. On September 13,2021 the applicant submitted a new floor plan, labeled A-1 to A-7 and dated September 12,2021, illustrating a reduced lot coverage from 25.6% to 22.6%, where the code allows a maximum lot coverage of 20%. The reduced lot coverage is reflected by a reduction of number of garage spaces (from four to three which reduced the depth of the proposed attached garage by 10 feet). On September 14,2021 the applicant submitted a revised site plan, labeled S-1 and dated September 14, 2021, further illustrating the reduced lot coverage and how it interacts with the overall lot. Page 3, September 16,2021 #7536 Kaminski SCTM No.,1000-88-4-33 A second letter of objection,reaffirming the neighbor to the north's opposition,was submitted by their legal counsel on September 15,2021 after review of the applicant's amended plans. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 2,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Bay Haven community consists of smaller, non- conforming lots created prior to current zoning with houses ranging in age and size,most built in the 1960's through the 1990's, many of which have been updated and renovated to meet modern needs and taste. The lots are laid out in a grid pattern leading to an association bay beach and waterfront residences. The majority of properties in this community are non-waterfront and modest one-story ranches or expanded two-story residences. Several homes basically stretch the lot width,maintaining narrow but predominately conforming side yard setbacks. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant can demolish their home and reconstruct their residence with compliant lot coverage not exceeding 20%. Moreover,the applicant can store their car collection off site. However,the applicant could also construct the proposed garage/storage addition as it is currently amended as of right with no required mitigation,by reducing the lot coverage to a conforming 20%by the elimination or reduction in size of one or more of the proposed additions on the rear of the existing house, both of which have little to no impact on the street or adjacent properties , 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 13%relief from the code.However,the build out represents 2.6%increase over the allowable lot coverage and meets all setbacks relative to front, rear, and side yards as well as conforming to the height permitted by code. While the proposed increase in.lot coverage will add additional bulk/mass to the current dwelling and will clearly be visible from the road and from the adjoining property to the north,with the conditions imposed in granting relief,the Board finds that the negative impact on the adjacent property will be mitigated to the greatest extent possible. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law 4267-b. Grant of amended relief as requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a single- family residence with attached garage,three season sunroom and rear deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 4, September 16,2021 #7536 Kaminski SCTM No. 1000-88-4-33 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Planamento,seconded by Member Dantes,and duly carried, to DENY as applied for and GRANT THE RELIEF AS AMENDED, and shown on the Architectural Plans, labeled A-1 to A-7 prepared by MCH Design Services and stamped by James J. Deerkoski, Licensed Professional Engineer and dated September 12, 2021 and revised site plan, labeled S-1 prepared by MCH Design Services and stamped by James J.Deerkoski,Licensed Professional Engineer and dated September 14,2021, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The shed located in the rear yard is to be removed prior to the issuance of a Certificate of Occupancy on the new construction residence. 2. The applicant is to apply for a building permit and receive a Certificate of Occupancy for the demolition of the existing and proposed outdoor shower along with the existing central air conditioning and house generator in conjunction with the issuance of the Certificate of Occupancy on the new dwelling. 3. The applicant/owner is to install and permanently maintain six-feet tall solid fencing with a non- reflective surface (wood or matte finish) along the entire perimeter of heir rear yard on all sides beginning 40 feet from the front property line and extending along both side property lines up to and across the entire rear property line. 4. The applicant/owner is to plant, per grower's instructions, and permanently maintain evergreen screening such as Leyland cypress trees or similar a minimum of 2-feet in from the above referenced fence along the perimeter of the entire rear-yard. The initially planted trees shall be a minimum of 5' in height when planted. 5. The proposed rear deck is not to be roofed over or enclosed in any way. 6. The proposed `Three Season' sun room is to remain unheated and unconditioned. 7. Because the proposed construction has been determined by the Building Department to constitute a demolition and reconstruction, per code, therefore consisting of major construction, the applicant shall install a Suffolk County Board of Health approved I/A(innovative and alternative)waste water system for a two-bedroom house, replacing the current sanitary system. 8. Prior to the issuance of the Certificate of Occupancy on the new residence, the Building Inspector is to inspect the subject premises to ensure all conditions are met and is to report back to the Zoning Board of Appeal for permission to grant.the final Certificate of Occupancy. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three 4 Page 5, September 16,2021 #7536 Kaminski SCTM No. 1000-88-4-33 (3)years from the date such variance was granted. PROPERTY FACTS/DESCRIPTION: The applicant's 14,996 sq. ft. parcel is shown as Lot 122 on the filed map of Cedar Beach Park (or 12,667 sq. ft. per surveyor tie line measurements at bulkhead)with 100 feet along West Lake Drive and 126.24 feet in depth along the easterly side line. The property is improved with a one-story frame house with garage, as shown on the July 6, 2004 site map prepared by Robert Charles Tast, R.A. BASIS OF APPLICATION: Building Department's July 22, 2004 Notice of Disapproval, citing Section 100-244, in its denial of a building permit to construct additions with alterations which will be less than the code-required 35 feet from the front yard line and exceeding the 20% code limitation of lot coverage. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 16, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: in the applicant's original application and survey map dated July 6, 2004, prepared by Robert Charles Tast, Architect, the front porch was requested with variable dimensions, 24.74 feet from the front lot line facing West Lake Drive, 12.9 ft. and 12.8 ft. side yards, and lot coverage at 22.3% of the 14,997 sq. ft. parcel size. AMENDED AREA VARIANCE RELIEF REQUESTED: During the 'December 16, 2004 public' hearing, the applicant was requested, and agreed,-to increase the front yard setback that would be more conforming to the code's front setback requirement of 35 feet, reducing the size of the porch from 8-11' depth variables x 58.30'+- lin ft., to 8' in depth x 58.30' lin ft., after removing a 3 ft. x 15.50 ft. section of the porch, resulting a 27' +-front setback, 12.9 feet from the west side line and 28.8+- feet to the east side line. (The applicant agreed to submit the Board's requested revisions for this reduction, to allow for an 8 ft. deep front porch, before obtaining a building permit.) This also reduced the lot coverage from 22.6% to 22.3%. Grant of the alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant requests a proposed one-story covered porch along the entire front length of her home on West Lake Drive in Southold. The setback proposed is greater than at least one parcel, adjacent to the east, which contains a nonconforming front yard-setback as close as 22.5 feet. The lot coverage request was reduced to 22.3% of the entire lot size (or 26.8%when measuring the lot size to a tie line at the bulkhead). 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's lot is a small lot (12,667 sq. ft. in area when measured to the existing bulkhead), and the applicant wishes to construct a single-story 8 ft. porch in front of the existing concrete entry/platform/brick walkway, which is presently 32+- feet from the front property line, requiring code relief. 3. The variance granted for the porch is not substantial. The existing front walkway with platform at the entrance is 32+- feet from the front property line, and the proposed 8 ft. porch will replace this area, resulting in a 27+- ft. front yard setback. The lot coverage increase would allow 2.3%, or 345 square feet, over the 20% code limitation of the 14,997 sq. ft. lot size, for 3,344.11 sq. ft. total (22.3%). 4. The difficulty has been self-created and is related to the need for a front porch, which cannot be planned to meet the setback requirement of the zoning code. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a front porch, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. On January 19, 2021, the applicant's representative submitted a revised survey dated January 17, 2021, in order to show the proposed swimming pool mechanicals and a drywell. The applicant's pool installer testified at the hearing that a smaller pool to further reduce the lot coverage can be installed.However,it would then be difficult to create a deep`end' as the pool's shallow end includes standard stairs that take up much of the interior slope. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 7,2021 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in-the character of the neighborhood or a detriment to nearby properties. The subject property is located in the Terry Waters subdivision,a bayfront private beach association neighborhood located on Hogs Neck,consisting of approximately 72 pre-existing, non-conforming lots, laid out in a grid, several of which have swimming pools. While most of the houses in the neighborhood were built in the 1960's and 1970's, the majority have been updated in recent years to reflect current needs and taste. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance.Variance relief is necessary to enable the applicant to construct a modest sized pool in the rear yard. The applicant has reduced the size of the pool that was originally planned (18 feet by 44 feet to 18 feet by 36 feet) and they intend to remove the existing `attached' shed and rear deck, thereby reducing lot coverage,so that the relief requested is the minimum necessary to allow enjoyment of an accessory pool. 3. Town Law X267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 11%relief from the code.However,because the pool is a ground level improvement,the visual massing will not be-discernable to neighbors or those passing by,versus a structure with more dimension such as an addition to the residence. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law $267-b. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. Browne, a next-door neighbor of Applicant, residing at 685 Bay Haven Lane,Southold,New York 11971, Ms. Browne has resided there for the past 35 years. Ms. Browne shares her full side yard,or southerly lot line of Applicant's property,with Applicant. She objects to the size, height, Substantiality, and proximity to her property of the reconstruction and additions proposed to be constructed following demolition of Applicant's existing single- family dwelling at 805 Bay Haven Lane. For the Board's reference, we attach Applicant's proposal, hereto. Applicant's property is a nonconforming lot that is undersized for an R-40 zoned district at 0.36 of an acre or 15,625 sq. ft. Applicant is before this Board seeking a substantial variance for lot coverage of 25.6%, where the maximum permitted is 20%, or 281A over the Inaxinfum. allowed under Section 280-124 of Article XXIII of Southold's Zoning Code for lots measuring less than 20,000 sq. ft. Here,the lot is 21.9%,smaller than 20000 sq. ft. Applicant's Proposal In place of the existing dwelling of 2,501 sq. ft.,Applicant proposes to build a new structure that will add 1,499 sq. ft. for a total or 4,000 sq. ft., including a 23.5' house(i.e.,over two stories), merely 10.3' from Ms. Browne's property. Applicant's stated primary purposes are to build a 4- car garage, athree-season room, and some storage space on top, which will raise the height to 23,5',well beyond the standard height of a one-story building. In doing so, Applicant proposes to ism September 1,2021 Page 2 of 4 move the dwelling's structure from 38.1' from Ms. Browne's property line to within 10.3' of her property line, without any justification. in any other jurisdiction on the East End, a structure so close to the property line at a height of 23.5' would be a Pyramid Law violation. Not only would the new proposed structure be almost 28' closer to Ms. Browne's property, but it is proposed to be expanded from front to back, from 22.1' to 47.9' in depth. Furthermore, there is no explanation for why the new structure cannot be reduced and more centered on the subject property. The present proposal leaves a full 28' side yard setback with respect to the northerly side yard lot line, that is,the side yard opposite Ms. Browne's. In other words, the proposed new garage will be closer to our client's property by 27.3 feet and 25.8 wider and literally tower over her side yard at 23.5' as it will be higher than a standard one-story structure, which is otherwise typical of the neighborhood. Moreover,this addition would take up over one-third of the view from her side yard, not to mention her privacy,as her living room's bay window overlooks Applicant's side yard. Standards As set forth in the Southold Town Code: "The granting or denial of an area variance is based on a `balancing test' consisting of six factors dictated by NYS Town Law used to determine if the benefit to the applicant outweighs the possible detriment to the health, safety, and welfare of the community,or vice versa." See Littps: l�layky,southr�ldt7vnny. cvE'296 1" es-o't�� Five of the six factors of this balancing test are found in New York State's Town Law, Sec. 267- b. The sixth factor of this balancing test is set forth in New York State's Town Law, Sec. 267-c. Applying these factors as set forth below, it is respectfully submitted that Applicant's proposal should be denied. Application of Factors (1) Whether an undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties will be created by the granting of the area variance. Yes. The proposed change presents an immediate detriment to Ms. Browne's neighboring property due to its size,substantiality, and proximity to her property and the impact it will have on her yard's privacy and view, which is atypical for their neighborhood. (2) Whether the benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. Yes. Applicant is seeking to build a 4-car garage in a neighborhood of modestly sized, largely one-story houses, purely for its own convenience. It sets a terrible precedent to allow 4-car garages in a neighborhood of such undersized parcels with houses already close to one another. Simply put, we could not find another 4-car garage in this neighborhood. September 1, 2021 Page 3 of 4 (3) Whether the requested area variance is substantial. Yes. It is respectfully submitted that Applicant's requested variance fails these tests, particularly as to the substantiality of the variance required for lot coverage. Scife, 215 A.1).2d 665, 628 N.Y.S.2d 311 (2d Dep't 1995) (Denying variance: "The proposed addition, however, required an area variance that would result in 42.9%more building coverage and 19% more lot coverage than permitted by the Village Code."). The two Board decisions which Applicant attaches in support of its lot coverage variance are not in fact supportive of Applicant's request. ZBA File 5627 (Dec. 29, 2004) involved a variance of 22.3% where 20% is permitted, or 26.8% when measuring lot size from the bulkhead. Applicant's property does not involve waterfront property, and thus, the more appropriate measure is 22.3%. The latter figure represents a variance of 11.15%over the 20% permitted;not the 28%sought here. Moreover,what was involved there was the building of a proposed covered porch, not a solid stricture. Further, in granting the variance, the Board prohibited"any future use, setback or other feature of the subject property." Similarly,ZBA File 7541 (Jan.21,202 1)involved the grant of a variance of 22.2%where 20% is permitted. That grant is only a variance 11.1%, again not the 28% sought here; and it involved the installation of a pool, which is far different than building a house almost double in size from the existing dwelling at a height of 23.5'. Further, as a condition of granting the variance, the Board required that: "The applicant shall install and maintain evergreen vegetation to screen the rear yard," which condition was to be written into the Certificate of Occupancy. (4) Whether the proposed variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. Yes. Without question,it will make an already densely developed area of Southold even more overdeveloped and set a terrible precedent. See attached Suffolk County GIS photo of the neighborhood. September 1,2021 Page 4 of 4 (5) Whether the alleged difficulty was self-created,which consideration shall be relevant to the decision of the board of appeals, but shall not necessarily preclude the granting of the area variance. Yes. Applicant's desire for the variance in order to have a 4-car garage is entirely self-created. (6) The board of appeals, in the granting of area variances, shall grant the minimum variance that it shall deem necessary and adequate and at the same time preserve and protect the character of the neighborhood and the health, safety and welfare of the community. It is respectfully submitted that Applicant's proposal is not the minimum variance which would ordinarily be considered adequate and necessary that would preserve and protect the character of the neighborhood. Why wouldn't a 2-car garage be adequate, especially when considering the subject property's size? A New Sanitary System Applicant proposes to rely on its existing septic system. Kaminski Living Trust PROPERTY LOCATION: 805 Bay Haven Lane, Southold NY 11971 SCTM: 1000-88-4-33 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 15,25 square feet, .36-acre, rectangular lot located in the R40 Residential Zone measures 125 feet along Bay Haven Lane, then runs east 125 feet along a residentially developed lot to the north, then runs south 125 feet along two residentially developed lots to the east and returns 125 feet along a residentially developed lot to the south. The parcel is developed with a one-story,wood- frame dwelling with attached 2-car garage, a covered front porch, walkway, asphalt driveway, outdoor shower, central air conditioning mechanicals, a generator, and 8.2 feet by 10.2 feet shed as shown on the survey prepared by Kenneth M. Woychuk Land Surveying,PLLC and dated April 16, 2021. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124; and the Building Inspector's May 18, 2021 Notice of Disapproval based on an application for a permit to demolish and reconstruct a single-family dwelling; at; 1) more than the code permitted maximum lot coverage of 20%; located at: 805 Bay Haven Lane, Southold,NY. SCTM No. 1000-88-4-33. RELIEF REQUESTED: The applicant requests a variance for the demolition of a single-family residence, 2 car garage and other improvements and for the reconstruction of a 2-bedroom, single-family residence with an attached four-car garage with a walk-up attic storage area on the second floor,a new covered front porch,a rear deck,a three- season sunroom,and an outdoor shower with a total lot coverage of 25.6%where the code limits such improvements to 20% lot coverage. AMENDED APPLICATION: During the hearing,the applicant was asked to bring the plan into more conformity with the code. The applicant on September 13,2021 submitted a new plan reducing the proposed lot coverage from 25.6% to 22.6% and on September 14, 2021 submitted a new site plan further illustrating this reduction from the originally proposed, and bringing the plan into more conformity with the code. Additionally,the applicant reduced Page 2, September 16,2021 #7536 Kaminski SCTM No. 1000-88-4-33 the depth of the proposed attached garage from 47.9 feet to 37.9 feet which is the same depth as the opposite side wall of the existing dwelling,thereby reducing the impact on the adjacent neighbor to the north. The subject property is covered by the following Certificate of Occupancy: Z-6701 dated September 24, 1975 covering a private one-family dwelling Z-12656 dated July 31, 1984 covering a deck addition to an existing dwelling Z-19391 dated September 27, 1990 covering a deck addition to an existing dwelling There is no record of a Certificate of Occupancy for the central air conditioning,the generator,or the outdoor shower illustrated on the survey and observed during the Board's site inspection. No prior variance has been issued by the Zoning Board of Appeals in relation to the subject property. The applicant and their agent indicated that the property owner has a collection of several vintage/antique cars that they wish to store on site for ease of repairs and personal enjoyment. Additionally, that the house basement periodically floods, promoting the need for dry storage in the proposed attic, over the garage. The applicant added that while the renovation is substantial, it is in keeping with the nature of the residential community and that since the owner proposes no increase in the number of bedrooms the existing sanitary system is sufficient and that a new, Suffolk County Board of Health approved I/A system is unwarranted,despite the demolition of the existing residence. The applicant provided the Board with two prior decisions granting relief, as evidence of excessive lot coverage, supporting their application: #5627 dated January 5, 2003 Granting relief of 22.3% lot coverage, for alterations and additions to a waterfront residence, where the code permits a maximum of 20% lot coverage. 47451 dated January 22, 2021 Granting relief of 22.2% lot coverage, for the addition of an accessory inground swimming pool,where the code permits a maximum of 20% lot coverage. While the Board considers prior decisions to assist in establishing relief for an applicant, it is encouraged that examples of similar hardship should be for the immediate neighborhood of the applicant's property. In the case of ZBA decision #5627, the applicant is a waterfront property owner outside of the Bay Haven private community where the subject parcel is located. As a result of the unique hardship of developing a waterfront parcel,this applicant had greater relief granted in order to meet setbacks and to comply with other authorities. Similarly, decision#7451 is also located in another private community—Terry Waters;located adjacent to the Bay Haven private neighborhood. However, in this case the relief granted was to allow for the non-dimensional installation of an inground swimming pool which has little visual impact on the character of a community versus the massing of a more dimensional improvement such as a framed structure would. Neighbors spoke in opposition to the application, including a resident to the immediate north of the subject parcel who retained legal counsel on her behalf. The neighbor's attorney, in advance of the public hearing, sent a detailed letter outlining their opposition to the proposed excessive lot coverage. The public hearing was adjourned to September 16, 2021 allowing the applicant to amend their design to reduce lot coverage and bring the application into better compliance with the Town Code. On September 13,2021 the applicant submitted a new floor plan, labeled A-1 to A-7 and dated September 12,2021, illustrating a reduced lot coverage from 25.6% to 22.6%, where the code allows a maximum lot coverage of 20%. The reduced lot coverage is reflected by a reduction of number of garage spaces (from four to three which reduced the depth of the proposed attached garage by 10 feet). On September 14,2021 the applicant submitted a revised site plan, labeled S-1 and dated September 14, 2021, further illustrating the reduced lot coverage and how it interacts with the overall lot. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 2,2021 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and.surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Bay Haven community consists of smaller, non- conforming lots created prior to current zoning with houses ranging in age and size,most built in the 1960's through the 1990's, many of which have been updated and renovated to meet modern needs and taste. The lots are laid out in a grid pattern leading to an association bay beach and waterfront residences. The majority of properties in this community are non-waterfront and modest one-story ranches or expanded two-story residences. Several homes basically stretch the lot width,maintaining narrow but predominately conforming side yard setbacks. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant can demolish their home and reconstruct their residence with compliant lot coverage not exceeding 20%. Moreover,the applicant can store their car collection off site. However,the applicant could also construct the proposed garage/storage addition as it is currently amended as of right with no required mitigation,by reducing the lot coverage to a conforming 20%by the elimination or reduction in size of one or more of the proposed additions on the rear of the existing house, both of which have little to no impact on the street or adjacent properties 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 13%relief from the code.However,the build out represents 2.6%increase over the allowable lot coverage and meets all setbacks relative to front, rear, and side yards as well as conforming to the height permitted by code. While the proposed increase in lot coverage will add additional bulk/mass to the current dwelling and will clearly be visible from the road and from the adjoining property to the north,with the conditions imposed in granting relief,the Board finds that the negative impact on the adjacent properly will be mitigated to the greatest extent possible. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law§267-b. Grant of amended relief as requested is the minimum action necessary and adequate to enable the applicant.to enjoy the benefit of a single- family residence with attached garage, three season sunroom and rear deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
