Connolly and Lorraine Acarelli Connolly Property Location: 3505 Wickham Avenue, (Adj. to Long Creek)Mattituck,NY SCTM#1000-107-9-9 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions,without further requirements under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated July 12,2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: this application was referred for review under Chapter 286, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)Policy Standards. The LWRP Coordinator issued a recommendation dated July 29,2021. Based upon information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available,the proposed action is considered a Minor Action and is EXEMPT from the LWRP review. REQUEST MADE BY APPLICANT: Applicants request a Special Exception under Article III, Section 280-13B(13). The Applicant is owner of subject property requesting authorization to establish an Accessory Apartment in an existing accessory structure; at: 3505 Wickham Avenue,(Adj.to Long Creek) Mattituck,NY. SCTM#1000-107-9-9. PROPERTY FACTS/DESCRIPTION: The subject property is a 32,478 square foot parcel located in an R 80 Zoning District. The northerly property line measures 128.57 feet and is adjacent to Long Creek,the easterly property line measures 270.98 feet,the southerly property line measures 126.43 feet and is adjacent to Wickham Avenue and the westerly property line measures 249.00 feet. The property is improved with a two-story frame dwelling with a single-story accessory(formerly a two-car garage) apartment located to the rear of the property in the northwest corner. There is also a 12.1 by 8.1-foot frame shed located in the northeast corner of the property as shown on the survey map prepared by Arthur J. Connolly,PE,and dated June 12,2021. Page 2, September 16,2021 7535SE,Connolly SCTM No. 1000-107-9-9 ADDITIONAL INFORMATION: The applicant states the accessory apartment has been in use for the past 50 years,however,there is no Certificate of Occupancy for that use CO#Z-26556 dated 07/12/99 was issued for the"conversion of an existing two car garage to non-habitable studio space as applied for." A violation for the occupancy of the non-habitable studio as a residence without a building permit was issued by a Town Ordinance Inspector on April 39,2021. The properly owners(applicants)were advised that a Certificate of Occupancy was needed and that application for such should be made to the Building Department upon an approval from the Board of Appeals for the as built accessory apartment in the accessory structure The previous owner had a relative living in the space without a Certificate of Occupancy. The new owners and applicants state that this accessory use has been ongoing for fifty years. The applicant owner who is a professional engineer, submitted a hand drawn floor plan with hand drawn dimensions, stamped with his State of New Jersey Seal, indicating 603 square feet of interior space and 81 square feet of storage accessed only from the exterior of the structure. In a different label the applicant shows a total of 590 square feet including the outside storage at 81 square feet.The numbers are confusing and inconsistent and will require recalculation and resubmission to conform to the livable floor area verbally confirmed by the Building Department FINDINGS OF FACT: The Zoning Board of Appeals held a public hearing on this application on September 2,2021 at which time written and oral evidence were presented.Based upon all testimony, documentation,personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application,the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-13(B)(13)to establish an Accessory Apartment in an Accessory Structure and finds that the applicant complies with the requirements for the reasons noted below: 1. The Accessory Apartment unit will be located on the first floor of the accessory structure with a conforming area of 503 square feet of livable floor area on one floor, where the code permits a maximum of 750 square feet as verbally confirmed by the Chief Building Inspector. 2. The dwelling unit complies with the definition of same in §280-4 of the code and complies with all code requirements as defined in Section 280-13(B)(13)of the Zoning Code except for the size of the apartment. The owners confirm that the accessory apartment shall not contain less than 450 sq. feet,but the accessory apartment will not exceed 750 square feet of livable floor area,with an overall square footage of 503 square feet inside all on one floor with only one full bathroom, and outside storage space of 81 square feet(total 584 square feet). There is a small loft area above the first-floor apartment which is non-habitable and used for storage only. 3. The applicants herein, own and reside at the property and will continue to occupy the single family residence as a principal residence in conformance with the code requirements-as set forth in Article III, Section 280-13(B)(13)0, 1-4),and as documented by copies of Driver License from the State of New York, Suffolk County Voter Registration form, and Suffolk County Water Authority Bill 4. The occupants of the accessory apartment will be either a family member or a resident who is currently on the Southold Town Affordable Housing Registry, and the occupancy shall not exceed the number of persons permitted, in conformance with the code requirements as set forth in Article III, Section 280- 13(B)(13)0, 1-4). The tenant of the accessory apartment will be Mrs. Connally's elderly mother,Joan Page 3,September 16,2021 7535SE,Connolly SCTM No. 1000-107-9-9 Vicarelli as evidenced by copies of an executed lease agreement and her daughter's Birth Certificate to show the family relationship. 5. The owners' plans comply with the on-site parking requirements and provide for a total of three parking spaces, as shown on the site plan(survey)by Arthur J. Connolly,PE and last revised June 12, 2021. 6. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists. 7. This conversion is/shall be subject to a building permit, inspection by the Building Inspector, and annual renewal of the Certificate of Occupancy. REASONS FOR BOARD ACTION DESCRIBED BELOW: Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant: 1) The Accessory Apartment, as applied for, is reasonable in relation to the District in which is located, adjacent use districts, and nearby adjacent residential uses. 2) This Accessory Apartment shall be in conjunction with the owner's residence in the Accessory structure, and as proposed will not prevent the orderly and reasonable use of districts and adjacent properties. 3) No evidence has been submitted to show that the safety,health,welfare, comfort,convenience,order of the Town would be adversely affected. 4)The special exception is authorized under the Zoning Code through the Zoning Board of Appeals as noted herein,and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory Apartment may be occupied. 5)No adverse conditions were found after considering items listed under Sections 280-142 and 280-143 of the Zoning Code. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson) seconded by Member Dantes, and duly carried,to GRANT a Special Exception Permit as applied for SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant must submit a new floor plan for the as built accessory apartment stamped by a licensed design professional recalculating the square footage of the livable floor area of the as built accessory apartment on the first floor of the subject accessory structure as 503 square feet, or alternatively, conforming to the code permitted maximum of 750 square feet which must be confirmed in writing by the Building Department. 2. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 3. This Special Exception permit cannot be transferred to new owners That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. These are copies of the originals which were reviewed by the Building Dept. on October 4, 2021; they confirmed the total interior living space as 498sf. They then said they would deliver them to the ZBA office. It is my understanding that you never received the originals which were left with the Building Dept. on October 4. 1 trust this is all you need to issue the Special Exception Permit.
