SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated July 12,2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 6, 2021. Based upon the information provided on the LWRP Consistency Assessment Form, as well as the records available, it is recommended that 1) the second-floor addition in relation to setbacks is EXEMPT from LWRP Review; 2)the deck, and additions to the accessory building are recommended as CONSISTENT with the LWRP; but the location of the hot tub 10 feet from the top of the bank is recommended as INCONSISTENT with the LWRP. However, any potential damage or loss due to storms or erosion can be easily mitigated to make it CONSISTENT with the LWRP since the hot tub is a self-contained movable unit, and not a permanent structure. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 21,188 sq. ft. parcel located in an R-40 Zoning District. The property has 130.00 feet of frontage on Great Peconic Bay, then runs north for 163.00 feet along South Oakwood Ave, then turns east for 130.00 feet before returning 163.00 feet back to Great Peconic Bay. The property is improved with a two-story frame house with attached wood deck. There is a two-story frame garage existing at the north end of the property and wooden decking with stairs leading to the Peconic Bay to the south, all shown on a survey prepared by Nathan Taft Corwin, III, L.S., dated November 10,2014. BASIS OF APPLICATION: Request for Variances from Article III, Section 15; Article III, Section 122A; Article XXIII, Section 280-124; and the Building Inspector's June 1, 2021, Amended July 20, 2021 Notice of Disapproval based on an application for a permit to construct second floor additions to the single family dwelling,additions to an existing accessory garage and installation of a hot tub;at; 1)Single family dwelling located less than the code required minimum rear yard setback of 50 feet; 2) Not permitted alteration or enlargement of a nonconforming Accessory .f Page 2, September 16,2021 #7534, Sanchez SCTM No. 1000-145-3-9.1 Garage containing a conforming use resulting in increasing a new nonconformance or increasing the degree of nonconformance; 3) Accessory hot tub located in other than the code permitted rear yard; located at: 515 South Oakwood Road,Laurel,NY. SCTM No. 1000-145-3-9.1 RELIEF REQUESTED: The applicant requests variances for a second-floor addition to a single-family dwelling having a proposed rear yard setback of 17 feet, 1 inch, where a minimum rear yard setback of 50 ft is required, alterations to the accessory garage where the proposed additions create a new non-conformance where no new non- conformance is allowed, and to install an accessory hot tub in the side yard where a only rear yard placement is permitted. AMENDED APPLICATION: As per testimony of the applicant's agent, the applicant will remove the request for relief relating to the accessory structure and make it part of a future application for an accessory apartment in conformance with the Town Code. ADDITIONAL INFORMATION: The agent stated that the proposed hot tub is not a permanent,but a self-contained unit that is removable. He also indicated that the property is fully bulkheaded. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 2,2021 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town-Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood'or a detriment to nearby properties. The nature of the proposed additions to the residence are maintaining the existing setbacks. The proposed construction is just an extension of the height of the second floor, thereby not impacting the character of the neighborhood. The proposed hot tub is a self-contained unit,and therefore not a permanent structure which will mitigate any potential damage or loss due to storms or erosion. Due to the location of the house, and the designated side yard being he actual rear yard, the hot tub would also not cause any undesirable change to the character of the neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The existing residence currently has certificates of occupancy, and the proposed addition is only an extension of the height of the second floor which by being less than the required 50 feet from the designated side yard would require variance relief. The hot tub is proposed in the designated side yard,which in actuality is the rear yard and therefore again would require variance relief. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial. The proposed second floor additions to the single-family dwelling represent a 66%relief from the code.However,the proposed additions are merely an extension of the existing second floor and will not change the setbacks of the current house with existing certificates of occupancy. The proposed hot tub represents a 100%relief from the code. However,the hot tub is not a permanent structure, which will mitigate any impacts from storms or flooding. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. f 1 Page 3, September 16,2021 #7534, Sanchez SCTM No. 1000-145-3-9.1 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of.a second-floor addition, and an accessory hot tub while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Weisman(Chairperson), seconded by Member Dantes, and duly carried,to GRANT the variance for the second-floor addition as applied for, and shown on the site plan&architectural plans prepared by Anthony Portillo,Architect, and dated July 26, 2021. GRANT the variance for the accessory hot tub as applied for, and shown on the site plan & architectural plans prepared by Anthony Portillo,Architect and dated July 26,2021. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall submit amended plans for the approved hot tub location, and approved additions and alterations to the subject dwelling,and remove the drawings for the proposed additions and alterations to the "as built"accessory garage on the subject property which has been withdrawn from the application. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current orfuture use,setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may,upon written request prior to the date of expiration, grant an extension not to exceed three(3)consecutive one(1)year terms. FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF SEPTEMBER 16,2021 ZBA FILE: 7534 NAME OF APPLICANT: Ronald & Mary Sanchez PROPERTY LOCATION: 515 South Oakwood Road,Laurel SCTM No. 1000-145-3-9.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated July 12,2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 6, 2021. Based upon the information provided on the LWRP Consistency Assessment Form, as well as the records available, it is recommended that 1) the second-floor addition in relation to setbacks is EXEMPT from LWRP Review; 2)the deck, and additions to the accessory building are recommended as CONSISTENT with the LWRP; but the location of the hot tub 10 feet from the top of the bank is recommended as INCONSISTENT with the LWRP. However, any potential damage or loss due to storms or erosion can be easily mitigated to make it CONSISTENT with the LWRP since the hot tub is a self-contained movable unit, and not a permanent structure. ' PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 21,188 sq. ft. parcel located in an R-40 Zoning District. The property has 130.00 feet of frontage on Great Peconic Bay, then runs north for 163.00 feet along South Oakwood Ave, then turns east for 130.00 feet before returning 163.00 feet back to Great Peconic Bay. The property is improved with a two-story frame house with attached wood deck. There is a two-story frame garage existing at the north end of the property and wooden decking with stairs leading to the Peconic Bay to the south,all shown on a survey prepared by Nathan Taft Corwin,III,L.S., dated November 10, 2014. BASIS OF APPLICATION: Request for Variances from Article III, Section 15; Article 111, Section 122A; Article XXIII, Section 280-124; and the Building Inspector's June 1, 2021, Amended July 20, 2021 Notice of Disapproval based on an application for a permit to construct second floor additions to the single family dwelling,additions to an existing accessory garage and installation of a hot tub;at; 1)Single family dwelling located less than the code required minimum rear yard setback of 50 feet; 2) Not permitted alteration or enlargement of a nonconforming Accessory Page 2, September 16,2021 #7534, Sanchez SCTM No. 1000-145-3-9.1 Garage containing a conforming use resulting in increasing a new nonconformance or increasing the degree of nonconformance; 3) Accessory hot tub located in other than the code permitted rear yard; located at: 515 South Oakwood Road,Laurel,NY. SCTM No. 1000-145-3-9.1 RELIEF REQUESTED: The applicant requests variances for a second-floor addition to a single-family dwelling having a proposed rear yard "setback of 17 feet, 1 inch, where a minimum rear yard setback,of 50 ft is required, alterations to the accessory garage where the proposed additions create a new non-conformance where no new non- conformance is allowed, and to install an accessory hot tub in the side yard where a only rear yard placement is permitted. AMENDED APPLICATION: As per testimony of the applicant's agent, the applicant will remove the request for relief relating to the accessory structure and make it part of a future application for an accessory apartment in conformance with the Town Code. ADDITIONAL INFORMATION: The agent stated that the proposed hot tub is not a permanent,but a self-contained unit that is removable. He also indicated that the property is fully bulkheaded. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 2,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The nature of the proposed additions to the residence are maintaining the existing setbacks. The proposed construction is just an extension of the height of the second floor, thereby not impacting the character of the neighborhood. The proposed hot tub is a self-contained unit,and therefore not a permanent structure which will mitigate any potential damage or loss due to storms or erosion. Due to the location of the house, and the designated side yard being he actual rear yard, the hot tub would also not cause any undesirable change to the character of the neighborhood. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The existing residence currently has certificates of occupancy, and the proposed addition is only an extension of the height of the second floor which by being less than the required 50 feet from the designated side yard would require variance relief. The hot tub is proposed in the designated side yard, which in actuality is the rear yard and therefore again would require variance relief. 3. Town Law X267-b(3)(b)(3). The variances granted herein are mathematically substantial. The proposed second floor additions to the single-family dwelling represent a 66%relief from the code.However,the proposed additions are merely an extension of the existing second floor and will not change the setbacks of the current house with existing certificates of occupancy. The proposed hot tub represents a 100%relief from the code. However,the hot tub is not a permanent structure,which will mitigate any impacts from storms or flooding. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second-floor addition, and an accessory hot tub while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Weisman(Chairperson), seconded by Member Dantes,and duly carried,to GRANT the variance for the second-floor addition as applied for, and shown on the site plan& architectural plans prepared by Anthony Portillo,Architect, and dated July 26, 2021. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall submit amended plans for the approved hot tub location, and approved additions and alterations to the subject dwelling,and remove the drawings for the proposed additions and alterations to the "as built"accessory garage on the subject property which has been withdrawn from the application. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may,upon written request prior to the date of expiration, grant an extension not to exceed three(3)consecutive one(1)year terms.
