LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 15,756 square foot parcel located in an R-40 Zoning District. The parcel has a triangle shape which gives it two front yards. The parcel runs 174.39 feet along Old Cove Road then curves 41.52 feet at the intersection of Old Cove Road and Vanston Road,runs 154.75 feet along Vanston Road,and then runs 167.28 feet on the South side. The parcel is improved with a two-story frame house with attached first and second floor decks,an accessory one-story frame garage,and an in-ground pool. All is shown on a survey prepared by John T.Metzger L.L.S. dated January 21, 2021. BASIS OF APPLICATION: Request for Variances from Sections 280-124 and the Building Inspector's May 6, 2021 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single-family dwelling at; 1) located less than the code required minimum front yard setback of 35 feet; 2) located less than the code required minimum side yard setback of 10 feet; located at 2700 Vanston Road, Cutchogue,NY SCTM# 1000-111-5-4. RELIEF REQUESTED: The applicant requests variances to make additions and alterations that will connect the accessory garage to the existing house which will result in a non-conforming front yard setback of 32 feet where town code requires front yard setbacks to be-a minimum of 35 feet and a non-conforming side yard setback of 5.5 feet where town code requires a minimum side yard setback of 10 feet. Page 2, September 16,2021 #7533,Braverman SCTM No.No. 1000-111-5-4 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 2,2021 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family homes. The parcel is irregularly shaped and has two front yards which are screened from view by mature hedgerow. The proposed additions and alterations are all within the code conforming building envelope. The variance is needed because the applicant is attaching an existing accessory structure to the principle dwelling with the proposed addition thereby creating the non-conforming setback. 2. Town Law 4267-00)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing accessory garage is already placed outside of the permitted building envelope. Any additions to the accessory structure will require the benefit of variance relief. 3.'Town Law4,267-b(3)(b)(3). The variances granted herein is mathematically substantial,representing 45%relief from the code for the non-conforming'side yard setback. The variance granted herein,for the non-conforming.front yard setback is not mathematically substantial representing 8% relief from the code.'However`, the parcel has two front yards,the footprint of the as built accessory`garage will not change, and there-are many non-conforming front yard setbacks in the neighborhood. 4. Town,Law 4267-b(3)(b)(4). No evidence has'been submitted to suggest that a variance in this 'residential , community will have,.an'adverse impact on the physical or environmental conditions in the neighborhood. The. applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in' effect and it is presumed that the applicant had actual or constructive knowledge_of the limitations on the use of the parcel under,the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a home office and storage space while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD:In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Dantes,seconded by Member Planamento,and duly carried, to GRANT the variances as applied for, and shown on the site plan and architectural plans prepared by Frank W. Ullendahl,Architect dated June 15,2021. SUBJECT TO THE FOLLOWING CONDITION: 1. The applicant shall plant and continuously maintain a row of evergreen trees (Leyland Cypress or similar)alone the side property line to create privacy screening from the adjacent neighbor. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a second-floor addition above the existing sunroom, raising the roof to obtain legal ceiling heights, to add an extension to the existing accessory garage for work and storage areas, and the addition of an in-ground swimming pool with trellis and wood deck. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant has an existing 1-1/2 story home and wishes to construct a full second story with partial flat roof. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property is only 13,500 sq. ft. with an irregular triangular shape, and provides a limited yard area for new construction as requested. There is no other alternative. 3. The variance granted herein is substantial and the maximum that the Board would approve. 4. The difficulty was self-created, and is related to the placement of the home as exists, and the small size and irregular shape of the property with two street frontages. 5. No evidence has been submitted to suggest that a variance in this community of single-family residences will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and a swimmingpool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
