SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated June 23,2021,stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 29, 2021. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. - PROPERTY FACTS/DESCRIPTION: The subject, conforming, irregular-shaped 107,944 square feet, 2.478 acre waterfront parcel measures 118.86 feet along Harbor Lane, then runs northeast 789.09 feet along a residentially developed lot to the north,then runs 19.75 feet, 47.29 feet, 54.30 feet south at the edge of marsh grasses along a tie line at the high water mark and continues south 21.28 feet, 16.06 feet, 10.46 feet and 40.22 feet along a wood `wall' bulkhead, establishing an irregular lot line at East Creek a.k.a. Eugene's Creek, and returns 679.02 feet along a residentially developed lot to the south. The parcel is improved with a one-story, single family dwelling with waterside wood deck,concrete walkways around the structure,a catwalk and floating dock and a gravel driveway as shown on the survey prepared by Nathan Taft Corwin III,Land Surveyor and revised May 22, 2019. . BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-14 and the Building Inspector's May 19, 2021 Notice of Disapproval based on an application for a permit to demolish and construct a new single family dwelling; at; 1) located less than the code required minimum rear yard setback of 75 feet; located at: 1465 Harbor Lane, (Adj.to East Creek/Eugene's Creek)Cutchogue,NY. SCTM No. 1000-103-2-1.1. Page 2, September 16,2021 #7532,Hazard SCTM No. 1000-103-2-1.1 RELIEF REQUESTED: The applicant requests a variance for alterations and additions to a one-story,single-family residence, including the removal of the roof to allow for the development of a second story(technically classified as a demolition),with an existing rear-yard setback of 40.4 feet from the attached deck to the lot line at the wood`wall' bulkhead at East Creek a.k.a.Eugene's Creek where the code requires a minimum rear-yard setback of 75 feet. The proposed second story addition will measure approximately 42.2 feet by 31.9 feet with a ridge height of 32.8 feet. No expansion of number of bedrooms is proposed. ADDITIONAL INFORMATION: The applicant does not propose any disruption to the waterside wood deck,which will remain, however, proposes a second story addition to the residence which at its closest point illustrated on the survey included in the application is 55.5 feet from the northeast corner of the house to the wooden `wall' bulkhead at East Creek,where 75 feet is required by Code. While not subject of this application,the applicant proposes to construct a multi-car garage with additional storage space,a swimming pool and on-grade patio,all in a conforming front yard location,in conjunction with the alterations and additions to the house proposed herein.During the public hearing the applicant stated that they intended to finish the second floor of the accessory garage as a home office. The Board reminded the applicant's agent that a home office in an accessory structure is not a permitted use;furthermore,the Board requested that the garage interior stairs be replaced with a pull-down style folding stairs or that the stairs be relocated to an exterior location,to allow second floor access to the storage area over the garage. Also, at this time,the applicant stated that 2 sheds,each measuring 8 feet by 12 feet, presently located in a non-conforming front yard location along the northeastern lot line (parking area),will be removed from the property once the garage is completed. They are currently used for storage. The applicant's agent indicated that a new,UA system was installed earlier this year. The applicant received prior relief under ZBA file #6997 dated January 5, 2017, allowing for the creation of a conforming two lot subdivision of lands originally associated with the subject residence. As part of the approval, ` Covenants and Restrictions,on both lots,were filed with the County Clerk's Office on March 8,2018 In the LWRP Coordinator's Memorandum dated July 29,2021,it is noted a permit was issued for a new, Suffolk County Board of Health ,I/A wastewater,permit was issued in 2020 and that the "proposed build out meets Clause 16 of the filed Covenant and Restrictions". The subject parcel is covered by the following Certificates Of Occupancy: • Z-2790 dated August 8, 1967, covering an addition to a one-family dwelling • Z-4960 dated December 28, 1972,covering the construction of a private, one-family dwelling No evidence of a building permit or certificate of occupancy was shown to illustrate the building of the waterside deck,which at its closest point to the rear lot line is 40.4 feet. The applicant provided detailed plans for the site's redevelopment including a site-plan, elevations, and floor plans labeled page 1 through 8, stamped by Nicholas J.Mazzaferro,Licensed Professional Engineer and last revised May 15, 2021. On September 8, 2021, in response to the Board's request during the public hearing, the applicant's designer submitted enlarged (more legible) plans (date stamped September 8, 2021) illustrating various site dimensions and setbacks. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 2,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 3, September 16,2021 #7532,Hazard SCTM No. 1000-103-2-1.1 1. Town Law§267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The eastside of Harbor Lane and the northern tip of East Creek a.k.a. Eugene's Creek consists of waterfront homes on larger, private, wooded lots. Most of the area homes have been expanded upon and updated to reflect modern needs and taste,most of which are two-story residential structures. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The existing residence,where the second story addition is to be built is located 55.5 feet from the wooden`wall'bulkhead at the lot line and the existing waterside deck is located at its closest point 40.4 feet from the same lot line, affirming an established rear-yard setback. It is not feasible to relocate the existing house in a conforming location in order to accommodate the alteration of the house from one to two stories. 3. Town Law X267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 46.2%relief from the code. However, the structures exist, and the applicant does not propose any further encroachment or reduction in the rear-yard setback. Furthermore,the second floor addition proposed is located over the existing first floor,not the deck,which is located at its closest 55.5 feet from the rear lot line. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the,physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and additions including second floor living space while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Planamento,seconded by Member Dantes,and duly carried, to GRANT the variance as applied for, and shown on the survey prepared by Nathan Taft Corwin III,Land Surveyor, and dated July 23,2018 and the site plan,elevations,and floor plans labeled pages 1 through 8,stamped by Nicholas J. Mazzaferro,Licensed Professional Engineer and last revised May 15, 2021. (Date received September 16,2021) SUBJECT TO THE FOLLOWING CONDITIONS: 1. Town of Southold Trustees approval for the proposed second story addition and other improvements to the site is required prior to the issuance of a building permit and commencement of any work. 2. Prior to the issuance of the Certificate of Occupancy on the residence,the applicant is to remove the two garden sheds from the properly, or provide an updated survey, to the Zoning Board of Appeals, illustrating their placement in a conforming location. The Town of Southold Building Inspector is to verify their removal or compliant location prior to the issuance of the Certificate of Occupancy for the house. 3. The existing decking on the north and eastern sides of the residence is not to be enlarged or roofed over. The decking is to remain open to the sky. Prior to receiving a building permit,the owner(s)of the subject property cited herein must sign a statement acknowledging: a. That the applicant(s)have read this determination and understand the limits of the variance relief granted herein; b. That the applicant(s)will immediately contact the Building Department if a demolition, as defined by Section 280-4 of the Town Code,' occurs during construction, or any construction undertaken in any other way exceeds the scope of the approvals granted herein, or the issued building permit; c. That the applicants are aware that the Zoning Board of Appeals retains jurisdiction until the issuance of the Certificate of Occupancy and has the right, after a public hearing,to modify, suspend or revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions,pursuant to Article XXV, Section 280-141 of the Town Code. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board ofAppeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy,when issued The.Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree ofnonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial-by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board_ofAppeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Pursuant to Chapter 280-146(B)of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may,upon written request prior to the date of expiration,grant an extension not to exceed three(3)consecutive one(1)year terms. ADDITIONAL INFORMATION: The Planning Board submitted a Memorandum dated October 6, 2016 indicting their support for the requested variance along with suggesting three measures to mitigate potential adverse environmental impacts to East Creek: 1) Create a 100' wide non-disturbance buffer landward from the edge of wetlands on proposed Lot#1 and Lot#2, 2) Have only a single common access path to East Creek for proposed Lot#1 and Lot#2, 3)Any new residential structures must have an onsite decentralized wastewater treatment system that, at a minimum, is designed to reduce total nitrogen'in treated effluent to 19 mg/L, and as furthef regulated by article 19 of the Suffolk County Sanitary Code. The Southold Trustees required a "reflagging" of the tidal wetlands on the subject parcel, which was done and 1 indicated.on the revised November 11, 2016 Survey of Property. I On December 8, 2016, the Board of Appeals received a Ietter from Michael A. Kimack, attorney for the f applicant, requesting that Condition 1 in this decision be amended to remove the required 100 foot "non- disturbance"buffer from proposed lot 1 which is already developed with a single family dwelling,wood deck and floating dock, and that Condition 2 requiring the maintenance of a single common access path to East Creek for both lots 1 and 2 be removed since it would require the relocation of the applicant's existing dock in cooperation with any future owner of lot 2,which is currently undeveloped. Street Trees Nine existing trees meet the requirement to provide street trees for this subdivision. These trees must be maintained by the lot owner as such. The street trees are identified on the Subdivision Map Final Plat, and include seven oak trees and two maple trees. They are located along Harbor Lane within the vegetated buffer on Lots 1 and 2. The lot owner is responsible for maintaining these trees in good condition and replacing them in case they are removed for any reason. No street trees may be removed, except in the case of trees that are dead or diseased and are a safety hazard, and only after submitting an arborists report to the Planning Board and the Planning Board issuing their approval in writing to remove the tree. 8. Significant Trees Significant trees as identified on the Subdivision Map Final Plat on Lot 2 must be maintained in good condition.
