SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated June 21, 2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 24, 2021. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 11,758 square foot parcel located in an R-40 Zoning District. The parcel is a corner lot which runs 105.26 feet along the northerly property line fronting Sound View Avenue and 102.98 feet along the easterly property line fronting Mill Lane. The parcel runs 100.00 feet on the West side and 129.82 feet on the South side. The parcel is improved with a one-story frame residence with an attached wood deck,a patio and a masonry walk patio. All is shown on a survey by John C. Ehlers L.L.S. dated August 24,2020. BASIS OF APPLICATION: Request for Variance(s) from Sections 280-124 and the building inspector's May 7, 2021 Notice of Disapproval based on an application for a permit to construct deck additions to an existing single- family dwelling; at 1) located less than the code required minimum front yard setback of 35 feet; located at 3745 Mill Lane,Peconic,NY. SCTM# 1000-67-2-10. RELIEF REQUESTED: The applicant requests a variance to construct deck additions,to attach to the existing deck, of the single family dwelling at 11.8 feet from Sound Avenue where code requires a 35 foot front yard setback . ADDITIONAL INFORMATION: The applicant's agent testified that there are other lots in the neighborhood which have non-conforming front yard setbacks including 3645 Mill Lane and 3575 Mill Lane. The applicant's neighbor Page 2, September 16, 2021 —AMENDED AUGUST 15,2024 #7529, Chandler-Meskouris SCTM No. 1000-67-2-10 further testified that there is approximately 25 feet from Sound Avenue's edge of pavement to the subject parcel property line. One neighbor spoke against the application. In a letter dated August 12, 2024, the applicant's representative, Mathew Smith, Registered Architect, requested that the Board remove the original condition requiring that the applicant have"deck remain open to the sky". He clarified that the existing shed roof over the existing deck will be replaced with the gabled roof. He submitted photographs of the existing roof, and requested that the condition be removed. Accordingly, the letter dated July 25, 2024 which denied a de minimus change shall be rescinded, and Condition No. 1 shall be removed from the decision,accordingly. At the August 15,2024 Special Meeting,the Board members voted unanimously to strike Condition#1 from the original decision. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 2,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law V67-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is an older neighborhood that was developed prior to zoning. The existing dwelling is 11.8 feet from Sound Avenue and the proposed deck will maintain the dwelling's existing setback. The proposed deck shall remain open to the sky thereby having less of an impact on the character of the neighborhood than the dwelling which is already in place. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling is built with a non-conforming front yard setback; therefore, any additions*and alterations on the North side of the house will require the benefit of variance relief. 3. Town Law V67-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 66.28% relief from the code. However,the existing non-conforming front yard setback is not being increased And there are other non-conforming front yard setbacks on Sound Avenue 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.,The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a deck addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. . The original condition stated in the approved zoning variance dated 09/20/21 stated that"The proposed deck shall remain open to the sky."We would like to clarify that the"proposed gabled roof"over a portion of the deck in our plans is replacing an existing shed roof over the existing deck.There will be no increase in covered portion of deck as this is only a change from a shed roof to a gabled roof within the same footprint. Please see photo report submitted with this document showing the existing deck and covering for your reference. As we do not seek to increase the area of roof coverage in our plans or add any additional deck covering(s)to what is existing,we believe that the change to the existing rear deck covering should fall under a de minimis approval and further help to'mitigate any potential adverse impacts to the character of the neighborhood' by bringing the existing covering design more in line with the character of the building. The comments he was allowed to make, which were all lies, have nothing to do with his application and he should have been stopped from speaking in outrageous falsehoods. Mr. Dunn is a wonderful neighbor and has been hugely instrumental in protecting this entire beach community by spearheading the boulders being installed along the inlet stream and the plantings along Mill Lane in addition to assisting many of our neighbors with home repairs and advice and storm mitigation and emergencies when neighbors were not at their homes. Mr. Meskouris has taken town property to install a fence very close to the roads around his property and has disrespectfully treated the Town laws and Mr. Dunn. He has been issued numerous violations and been ordered to move his fence, yet he boldly ignores the Town communications. The fence and the huge gate he has added to the property have changed the look of this corner property at the end of Mill Lane negatively and caused an issue with visibility for cars traveling Sound Ave and Mill Lane. Residents on this block are allowed a say as to variance applications' merits. And, I know that I and my other next door neighbor and the next door house owner on Mr Meskouris' west side all strongly disapprove of his blatant disregard for Town rules and disapprove of his being approved on his variance application.
