held on Wednesday, September 15, 2021:
RESOLVED, that the Southold Town Board of Trustees APPROVE the request for a
Transfer of Wetland Permit#128-6-21, as issued on December 21, 1992 and Amended
on February 25, 1993 from Ruby Keller to Paul Yau & Melissa D. Hobley.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

Based on the information you have submitted, the New York State Department
of Environmental Conservation has determined that the J parcel

Greater than 300 ' from inventoried tidal wetlands.
Landward of a substantial man-made structure `
great"er than 100 ' in length which was constructed prior to 9/20/77 .
Landward of the 10 ' above mean sea level elevation contour on a
gradual, natural slope.
Landward of the topographic crest of a bluff, cliff or dune which is
greater than 10 ' in elevation above mean sea level.
Therefore, no permit is required under* the Tidal Wetlands Act (Article 25
of the Environmental Conservation Law) . . Please be advised, however, that
no construction,. sedimentation or disturbance of any kind may take place
seaward of the 10 ' contour or topographic crest without a permit. It is _
your responsibility to ensure that all- necessary precautions "are taken' to
" prevent any sedimentation or other alteration -or- disturbance to the
ground surface or vegetation in this area as a result of your project. .
Such precautions may 'include providing adequate work area between the
10 ' contour or topographic crest and the project (i.e. a 15 ' to 20 ' wide
construction area) or- erection of a temporary fence, barrier , or hay
bale berm.
Please note that any additional work, or modification to the project as
described, may require authorization by this Department . Please contact
this office if such are contemplated.
Please be further advised that this letter does not relieve you of the
responsibility of obtaining any necessary permits or approvals from other

RE: Request for Reconstruction of Bulkhead
Dear Mr. Mastropolo:
I have received a copy of correspondence you sent to the
Town of Southold Board of Trustees in which you requested
amendments to Town permits for retaining wall reconstruction to
allow for bulkhead reconstruction as well for your property and
property owned by Ruby Keller.
Your correspondence included no request for action by this,
Department. I have reviewed our records and discovered that this
Department issued Letters of,- No Jurisdiction (#KAM-39 KAM-46) for
replacement of upper walls on both, properties, because they are
landward of a bulkhead that existed in September 1917. - --' '
If you wish to replace those lower bulkheads, permits will
be required for both properties for tidal wetlands, protection of
waters and water quality certification.
I am enclosing application forms, an Applicant's Guide, a
fee schedule (the fee will be $210 for each property) , office
hours information sheet, your- original letters and site plans,
and 'an application checklist.
Please submit the applications together, if possible,
attention to "Division of Regulatory Affairs. "
