Act, NOTICE is hereby given of the following action:

Subject: Fire safety in areas of pubhc assembly.
Purpose. To provide standards for hre detection systems, interior
finishes, and accumulation of materials in areas of public assembly.

,Secuon 430. I. Purpose. Artaclc 18-AA of the Executtvc Law, as added by
Chapter 707 of the Laws of 1981, provides a means to reduce the ask posed
by fire to users and patrons of areas of pubhc assembly. Section 399-e of
the Executive Law directs the Secretary of State to promulgate standards to
implement the requirements of the Article and to provide a procedure
whereby those reqmremeats may be ,,aricd m appropriate circumstances.
Those standards and procedures are the subject of thzs Part.
Section 4.;0 2 Definmons (a) "Area of public assembly" An area of
pubhc assembly includes a budding or a portion of a building used for
garhermg together fifty or more persons for amusement, athleUc, civic, din-
tag, educational, entertainment, patriotic, pohtical, recreational, religious,
social, or similar purposes, the entire fire area of which it is a part, and the
means of egress therefrom.
For the purpose of determining the threshold number of persons, d~vide
the net floor area by the appropriate value for floor area per person m the
table below. If multiple uses occur within the net floor area, thc threshold

The preceding table and note apply only to the determination of the
threshold number of persons to classdy an asea of public assembly for these
standards, It should not be used to post the mnmmum number of persons
or for other $~milar purposes.
Area~ of public assembly shall be classified as follows:
Group C~.t - capacity at least ~0 per~ans, but not exceeding 300 persora;
Group C$.2 - capacity ex_e_,'_?d__in~ ~00 persona, but not exceeding
persons;
Group C5.3 - capac/ty exceeding 1000 persons.
(b) "Budding." A building h a structure wholly or partially enclosed
within exterior walls, or witiun exterior and party wails, and · roof, af-
fording shelter to persons, al!imam% or property.
(c) "ConsU'uction or ranovauon." Construction or renovation means the
actual, physical construcuon of new fac~ti~ and alteration or repairs to an
existing bmldmg within any six-month period e~ceeding fifty percent of the
cost of replacement of the buddlr~ at the b~,~n_ nmog of that sm-month

(d) "Educational occupancy." Educational occupancy includes all
bwldings used for the gathering of persons for purposes of instruction such
as schools, universities, colleges, and academies. Educational occupancy
includes part-<lay nursery, kindergarten, amd other e.¢hc~o[$ whose purpose
Ls primarily educational, even though the ci'u!dren are of preschool age.
(e) "Equipment." EqutDment L,eans pinmbing, heating, electrical,
tilating, ai~ conditioni=g, re£n.jerafing, c. te',ators, dumb w~ters, ew. alator
and other mechanical additions or ~staUat~ons.
(f) "Fire detection system." A l.re detection system is an installation of
equipment which automatically activates a fire alarm when the detecung
element is exposed to fire, ~moke, or abnormal rise in temperature.
(g) "Fire area." A fire area is tbe floor area of · story of a builcho$
within exterior walls, party walls, fire walls, or any eotnbmation thereof.
(h) "Fire protection equipm :at and systems." Fire protection equipment
and systems includes apparatus, assemblies, or systems, tither portable or
fixed, used to prevent, control, or extinguish fire.
(i) "Generally accepted standard." A generally accepted standard is a
specification, code, rule, guide, or procedure in the field of construcuon or
related thereto, recognized and acc-pted as authoritative.
(j) 'Inter, or finish." Interior fin th means the exposed interior surface of
buddings including, but not lmaiteo to, fixed or movable walls and parti.
Uons, columns, ceilings, draperies, hangings, n.nd decorative material, but
does not include trim such as picture molds, chair rails, hand rails,
baseboards, and door and window frames, or svbsequantly applied paint or
wall covering less than 1/28 inch in thickness.
(k) "Interior floor finish." Interior floor finish means the exposed floor
surfaces of bud,hags, but does not include wood floonng and resilient floor
coverings such rs vinyl and linoleum.
{I) "Means cf egress." A means of egress is · continuous, unobstructed
way of exit from any point m a building or structure to a public way. A
means of egress composes the vertical and horizontal ways of travel and in-
eludes intervening room spaces, doOrways, hallways, corridors, passage-
ways, balconies, ramps, sitars, ~cinsures, lobbies, escalators, horizontal
exits, cour~ , and yards.

,~o:Oon 430.4. Fire derecuon system. (a) General Requirement. All arcs-,
of public assembly shall have a fire detection system installed which meels

(b) Speofic Requirement. (l) The hre detection system shall have detect-

(2) The component parts of a fire detection system shall be installed in
· manner such that they are protected from damage, operate without delay,
and are maintained in proper working order in accordance with generally
accepted standards.
($) Such system shall be designed, installed, and malmained in
cords·ce with generally accepted standards in a manner which dctec',~ fire
and smoke in i~s lnmal stage provided, however, that tire or abnormal rise
in temperature detectors ~re permitted in lien of smoke detectors where
Hus~, smoke, or produciS of combustion may cause false alarms, or where
sprinkler systems are installed.
(4) The fire alarm components of such system shall be installed in ·
wanner which when acuvated shall signal an alarm which can be clearly
reco~.ized as · warning of possible fire da·let from anywhere within the
area of public assembly.
(c) Additional Reqmreman~s. In C5.2 and C5.3 areas o! public assembly
excluding those in educatmnal occupancies and excluding the sanctuary and
nave ar~ of churches, synagogues, mosques, ·nd similar reh~lous struc-
tures, the fire detecuon system shall also activate an alarm m · location
which is manned by persons capable of effectively evacuarin~ the facility.
Such system shall be reasonably free from false alarm possibilities. Provi-
sions shall be made for transmitting voice messages throughout the area of
pubhc assembly, and for determinln8 that such m~sages are being receiv-
ed. Rehabthty of any pubhc address system used for lransmitm".$ voice
m~ges shall be assured by testing said system prior to allowing occupanTM
into the assembly room. Any such system shah be provided with an
emergency power supply.

equipment, materials, or other obstruction.
Sec[ioo 450.7. Co~strucUo~ with local ~lations. The requirements of
this Part are m addmon to, and no! in derogation of, local rules and regUla-
tions pertaining to areas of public assembly.

with the requ/rcmants of this Part wiflun · local government would entail

rules and re~ulauon~ in force within such local iovernment are substant/al-
ly equivalent to the reqmremanta of this Part, the Secretary of State shall
have the power to vary these requirements by approving in their stead said
local regulations as prescribing -qually safe and proper alternatives, Ap-.
plicafion to the Secretary for the exercise of this power shall be made in
wntlng by the chief executive officer or, if th~'e is none, the chic!
mlnistratlve body or board of such local lover·meat particularly describing
the provisions and circumstances which give rise to the request.
Sect~oa 450.9. Attthority of state a~e~cte$. (a) 'Fhe requirements of
Part as applied to areas of public assembly under the custody or supervision
of a state department, bureau, commission, board, pubhc authority, or
other agency of the stats, including · public benefit corporaaoa any
member of whose board is appointed by the governor, shall be ad-
ministered and enforced by such agency. The Secretary of State may review
the administration and enforcement efforts of such agencies.
(b) Where strict compliance with the requirements of this Part by such
state agency would cntad practical difficulty or unnec~sary hardship, such
agency havmB the custody or supervision over an area of public assumbly
shall have the power to vary or modify these requirement. Any such
variance or modification shall not substantially affect adversely provisions
for health, safety, and accuray, and shall assure that equally safe and pro-
per alternatives are provided. In addilaon, such ~anance shah be the
minimum necessary to overcome the practical difficulty or unnecessary
hardship. The Secretary of State shall be noufied that such variance or
modthcatinn has been granted.
(c) In making determm~_.:ons on varianc~ or modifications of the re-
