Motion Sequence No.3,dated November 21,2016 of the Supreme Court of the State of New York,
County of Queens, Commercial Division, Part D by the Honorable Martin E. Ritholtz, Index No.
14652/2014 and sale authorized pursuant to Memorandum Decision—Motion Sequence No. 16,
dated August 15, 2018 of the Supreme Court of the State of New York, County of Queens,
Commercial Division,Part D by the Honorable Marguerite A. Grays,and having an address at c/o
Fox Rothschild LLP, 101 Park Avenue, 171h Floor,New York,New York 10178,party of the first
part, and George Grammatikopoulos, having an address at 1230 Bay Avenue, East Marion,New
York 11939,party of the second part.

WHEREAS, receiver Ernest B. Badway ("Receiver) submitted an Affirmation of the
Receiver dated March 12,2018,moving for an orddr confirming his sale of real property located
at and 1695 Shipyard Lane,
East Marion, New York {"East Marion Property') (collectively, the "Properties"}, the exhibits
attached thereto,the Affidavit of Lisa Lauricella,sworn to on the 27h day of September 2017;
WHEREAS, plaintiff Marina Fakiris cross-moved by Notice of Cross-Motion dated
March 28,2018 and submitted an Affirmation of her counsel, Lara P.Ernouna dated March 28,
2018 along with exhibits attached thereto;
WHEREAS,defendant Kostas Fakiris opposed the Cross-Motion by Affirmation of his
counsel dated April 2,2018 and the Affidavit of Kostas Fakiris sworn to on April 2,2018,along

• NOW,on the proposed counter-order with notice of settlement submitted by defendants
Gusmar Enterprises LLC, Kostas Paldris and Summit Development Corp., d/b/a Summit
Waterproofing&Restoration Co.by their counsel,Mastropietro Law Group,PLLC with proof of
due service thereof,the Order of Honorable Marguerite A.Grays,dated August 15,2018,and upon
all pleadings and prior proceedings herein,it is hereby '
ORDERED, ADJUDGED AND DECREED; that (1) the Receiver has entered into
Icontracts for the sale of and the East Marion Property; (2) the contracts were
made pursuant to and in conformity with an Order of the Honorable Martin Ritholtz, dated
November 21,2016;(3)the Receiver gave due notice of his motion for confirmation of the sale to
all parties in this case;(4)
(5) the Receiver will sell the East Marion Property to George
