Thanks for making the review of Racketts Court as a ROW for our Conservation Subdivision a priority! Can you clarify what you mean in the below email by “submit the rest
of the documents( maps etc) so we can review further”?
Below is the original email that I sent to you on 12/17/20 summarizing all of the Deed Research/Chain of Title supporting our
ownership and ROW over Rackett Court. That email had 3 supporting documents sent in separate emails on the same day due to the large file size. I am happy to resend these documents
if you do not have them already.
Supporting Documents:
1. Chain of Title/Deeds for South Dyer and Racketts Court
2. History of Racketts Court Summary with Tax Map
3. Draft Map of Proposed
South Dyer Conservation Subdivision.
The only other information we have are the surveys of our South Dyer Property (including Racketts Court) and surveys of the 2 adjacent properties
on Racketts Court that use it as a ROW. I am attaching these surveys to this email.

Also I have been very involved in this research and am happy to answer questions
and resend any of this information.

Warm Holiday greetings to you and your families. We want to thank you for your continued input and and support of our Conservation Subdivision project this year!
We are working diligently
to prepare for the review of the Tuthill Conservation Subdivision Resolution items with the Planning Board ideally in January 2021.
One of our key focus areas is finalizing the ROW
for South Dyer. In our last meeting we proposed the use of Racketts Court as the ROW to the 4 proposed lots on South Dyer Parcel. This allows for the use of an existing road to minimize
view shed/environmental impact and allows for less roadway turns for fire safety. The next step was to provide the Deeds/ Chain of title confirming ownership / ROW on Racketts Court.
Sandra Goleski from Fidelity National Title completed a thorough Chain of Title and Deed search (THANK YOU SANDRA!) for the South Dyer property, Racketts Court and all adjacent properties
on Racketts Court. The Chain of Title Document from Fidelity National Title and a document summarizing the history of Racketts Court based on the historical deeds is attached. The
research confirmed that the South Dyer LLC has deeded ownership and rights of way based on L539 p367 and L566p88 as follows :
1. Ownership of the Westerly 1/2 of private road, Racketts
Court (1 1/2 rods in width (24.75ft) and 436 ft in length) from the Main Road in Orient.
2. Right of Way over ALL of Racketts Court (3 rods (49.5ft) in width and 436 ft in length) from
the Main Road in Orient.
This information was reviewed and confirmed by our attorney, Martin Finnegan, from Twomey & Latham firm who also spoke with Sandra Goleski to confirm the findings
of her work. They are both copied on this email. Martin also mentioned that a Right of Way over Racketts Court is part of the current deed of record L 12574 cp90 with the clause “together
with all the right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center line thereof”. As
a next step Martin is going to prepare Confirmation Deeds for the South Dyer LLC tax parcels (1000-017.00-06-014.003 and 1000-017.00-06.00-014.002 ) incorporating the ownership and
ROW specifics with regards to Rackett’s Court.
Martin recommended that we forward this information confirming our ownership and ROW on Racketts Court to you ASAP as he knows our
sense of urgency to get our Conservation Subdivision plans reviewed by the Planning Board with your support. With your agreement to this supporting information we will proceed with
using Racketts Court at the proposed ROW for the 4 parcels on the South Dyer as outlined in the attached map.
Please confirm if this is sufficient proof of Racketts Court ownership
and ROW for us to proceed with using Racketts Court as the ROW to our 4 proposed lots in the South Dyer Conservation Subdivision.

Rackett’s Court as the ROW for the 4 lots on the South Dyer Conservation Subdivision.
We also need clarification if the next step is showing our Rackett’s Court ROW plan (attached
below) to the Planning Board (with Support from you and Heather which we believe we already have) OR do we need to get a letter of agreement from the other owners of Rackett’s Court
about our ROW plan and then go to the Planning Board?
Finally, can you please clarify with the Town Attorney what documentation is legally required from the Rackett’s Court Neighbors
for us to proceed with the Rackett’s Court ROW plan?
Martin Finnegan (copied on this email) will be handling the process for us in engaging the Rackett’s Court Neighbors about the
use of Racketts Court as the ROW to our 4 lots. Martin will proceed based on your input about whether we get Planning Board agreement 1st and then the neighbors or if we need to get
neighbor agreement 1st.
