RESOLVED that the Southold Town Board of Trustees APPROVE the Administrative Amendment to Wetland Permit#10019 for an increase in size of the permitted on-grade stone patio to 595.7sq.ft. (including stone steps) in lieu of the previously approved 437.19 sq.ft; and as depicted on the revised site plan prepared by David Russell Black, RA, dated May 3, 2023, and stamped approved on May 8, 2023. Any other activity within 100' of the wetland boundary requires a permit from this office. This is not an approval from any other agency. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. This engineer report below includes our observations, findings, and recommendations for remediation. Observations & Findings: As part of our inspection, we examined the visible portions of the foundation from the interior and exterior of the residence. This report is limited to the readily visible condition at the time of inspection. No record drawings where provided to verify if the construction wa completed in accordance to the design documents. DiLandro Andrews Engineering PLLC absolves itself from conditions not visible or any future work that is currently uncovered. This report is only representative of the current conditions observed. The existing structure is a one-story residence with partially below grade cement masonry unit (CMU)foundation. The basement level was split into a portion for a two-car garage and an unfinished storage area. The garage area was finished at the ceiling level with no stick framing within the floor space. The storage area was stick framed with no finishes on the walls or ceilings. There is no information available regarding the construction of the foundation walls. Reinforcement could not be determined and cell grouting (filled cells with flowable grout) was not able to be determined. A vertical crack was noted at the north-western window within the garage space. T is is likely due to settlement of the structure. The first floor framing parallel to the foundation wall was not blocked appropriately to adequately brace the wall. rage 11. Signs of continued settlement wem not apparent however a single helical pile with an underpinning bracket may be insta led to ensure future settlement of the north-western portion of the foundation does not occur. Blocking should be added at 16" on center from the closes joist to the foundation wall in areas where framing runs parallel to the wall. These are the northern and southern fou dation walls, Framing sizes should match the existing framing types, Given the condition of this structure, it is likely it was installed in conformance with the applicable codes. If after further demolition commences and the top of wall condi ion is exposed, the CMU cells should be filled solid with grout and #4 vertical rE!inforcinE bars should be placed at 48" on center, Given the condition! observed it is our opinion that, this foundation is acceptable to receive the proposed addition. ADDITIONAL INFORMATION:_ The applicant will be installing a new Innovative Advanced (IA) septic system designed and approved by the Suffolk County Department of Health. The applicant will not be expanding the footprint of the dwelling further to the seaward side of the property and will be ,replacing the existing bluff steps. The first-floor expansion of the covered porch does not decrease the existing dwelling setback of 34 feet at its closest point to the foundation. The relief sought does not decrease the existing bluff setback. The applicant's representative submitted several prior comparable determinations located in the community for Top of Bluff setback relief, as listed: #7117—Hermer/Campo dated February 1, 2018—Addition to dwelling at 67 feet setback. #7434—Weiland dated November 19, 2020—Addition to dwelling at 36 feet setback. #6929—Stromski/Perez dated May 19, 2016—Addition to wood deck at 20 feet. 47138—Teicher dated June 7, 2018 - - Grant for addition to dwelling, deny platform seaward of bluff. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing July 1, 2021 on this application on at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&267-b(3) It Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Many of the residences in the neighborhood are similarly situated close to the bluff. ZBA decision#7434 was approved with a 33 feet distance from the bluff. Some hornet;are located closer to the bluff. The neighborhood keeps the bluff' in good condition. Also, many of the homes in this neighborhood have been bought by new owners who are or have done renovations to update their residences. 2. Town Law $267-b(3)(b)Q. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Although deemed to be a demolition by the town code definition, the home exists in its current non-conforming bluff setback and that footprint is to be maintained so variance relief is required for the proposed additions and alterations, most of which are on the landward side of the dwelling. 3. Town Law X267-b(3)(b1Q.. The variance granted herein is mathematically substantial, representing 72% relief from the code. However,the footprint of the dwelling wil l not be expanded seaward. The addition of a partial second story will allow the footprint to stay the same only with some updating. 4. Town Law $267-b(3) !( 4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Additionally, the;applicant proposes to install an IA wastewater treatment system that will reduce adverse environmental impacts. 5. Town Law §267-b(3)(b)I.L. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
