Unfortunately due to their error,four applications were not published in the paper with the Hirsch application being one of the four. Given the fact that the Suffolk Times did not publish this application,these four applications must be postponed to our October 20, 2021 public hearing date. Because the full noticing process failed to be completed, as per Ch. 55 of the Southold Town Code you will have to re- notice adjacent property owners and re-post the property with updated information. The dock is owned by Douglas and Leslie Hirsch at 5028 New Suffolk Ave., Mattituck, NY The owner intends to put a yacht, approximately 40' in length on a 20' float. I would like to see wording in his wetlands permit that would prevent the boat from sticking out in a southerly direction more than the southern end of his new floating dock. Otherwise his boat could hinder the safe navigation of my boat when I am leaving and returning to my dock. Also, this would be consistent with the requirements of his present permit. I believe that one of the main goals of the BOT is to preserve marine life and that is why Frank and Paula Doka, ( y neighbors to the south), were required to chock their floating dock so it would remain 2 1/2' above the creek bottom. Wetland permit #9039. This is to prevent the float from sitting on the bottom and killing the marine life under it. If an independent third party, with no financial incentive, were to measure the depth of the water on the Doka dock and the Hirsch dock, I think they would find there was more water by the Doka dock. Especially compared to the northern end of the new Hirsch float. To be fair and consistent, should the Hirsch dock be chocked in a similar manner to the Doka dock? In anticipation of tonight's work session,I'm writing to summarize my findings and response to the Trustees' inquiry. Based on my discussion with the applicant and research of the permitting history of the original dock,the dock cannot be relocated to the north because there is insufficient water to the north. Specifically,the water depth declines quickly and significantly as you move from south to north across the applicant's waterfront. So the deepest water is on the south end of the property,which is occupied by the neighboring dock structure that encroaches onto the applicant's waterfront by approximately 75 feet(thus in violation of the required 15-foot property line clearance required by Section 275- 11(C)(2)(a)(5)by approximately 90 feet);and the next deepest and only remaining sufficient water depth occurs in the vicinity of the existing dock. Evidence of this condition can be found in the Trustee records,which show that at the time the dock was proposed where it was ultimately approved and constructed in 2004,the Trustees expressed concerns about potential navigational conflict with the encroaching dock to the south and discussed the possibility of locating the subject dock farther to the north. But at the hearing during which the dock was approved, the Trustees advised that the Board had inspected the site at low water and found that the dock could not be moved farther north because"there's no water to the north." Thus,it is our opinion that aside from seeking relocation of the encroaching neighboring dock,the only viable solution that would enable the applicant to avail his right to moor two boats at his dock is the proposed"L" configuration. Relocation and rotation of the float places deeper water under the float;maintains the seaward limit of the dock within the"pier line," compliant with Section 275-11(C)(2)(c)(1)(c);keeps the dock and any vessel moored at the dock well within 1/3rd of the width of the waterway,compliant with Section 275-11(C)(2)(b)(2);and,compliant with Section 275-11(C)(2)(b)(1),will not create any additional navigational conflict,as no boat will be moored south of the southern limit of the current dock position.
