The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, September 15, 2021 regarding the above matter:
WHEREAS, Jennifer Wicks on behalf of D. CANNIZZARO QRPT & B. MILTAKIS
QRPT, c/o JOHN MILTAKIS, TRUSTEE applied to the Southold Town Trustees for a
permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated July 9, 2021, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the proposed
application be found Inconsistent with the Local Waterfront Revitalization Program
policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 15, 2021, at which time all interested persons were given an
opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the Board has determined that the structure, as applied for does not
comply with the standards set forth in Southold Town Code Chapter 275 — including but
not limited to lack of drainage; decking on non-turf buffer; and
WHEREAS, the Board has determined that the request, as applied for, will have a
detrimental effect upon the health, safety and general welfare of the people of the town,
and,
BE IT FURTHER
RESOLVED that the Board_ of Trustees,DEN IES WITHOUT PREJUDICE-based,on, no
action the application of D.,CANNIZZARO QRPTA B. MILTAKIS-QRPT, c/o JOHN
MILTAKIS, TRUSTEE for the as-built-approval of;the existing un=treated,Trex decking

The Southold Town Board of Appeals issued a variance (#7455) for the action in 2021 with
conditions.
Jennifer Wicks on behalf of D. CANNIZZARO QRPT & B. MILTAKIS QRPT, c/o JOHN MILTAKIS,
TRUSTEE requests a Wetland Permit for the as-built approval of the existing un-treated Trex
decking along bulkhead and walkways to the house of various dimensions (5'2"x36'3", 12'x5',
15'2"x3'7", 5'5"x12', 45'4"x16'); as-built 16'x44' patio; as-built 3'x16' planter/bench; as-built 5'x10'
stone steps; as-built 395.27sq.ft. deck; construct a proposed first-floor 5.75sq.ft. seaward side
addition; a proposed 779.81 sq.ft. second-floor garage addition; a proposed 113.5sq.ft. garage
expansion; a proposed 120sq.ft. front covered stoop; and a proposed first-floor 120sq.ft. front entry

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with LWRP Policy 6.3 and therefore, INCONSISTENT with
the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
The as-built structures were constructed without Board of Trustee review or permit.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

This email is in regards to your application for the above referenced property. There are several additions/corrections
needed to be made in order for this application to be heard on our Sept. 15, 2021 public hearing date. Currently,the
following is required.
• As this application contains a request to permit as-built structures,the application fee is$500.00. This office
received a $250.00 application fee which would be correct if there were not as-build's connected with the
application. Please submit a second check in the amount of$250.00.
• The survey is incomplete and has errors on it. The existing dwelling is not currently a two-story dwelling, it is a
one-story dwelling according to the Southold Town's Zoning Board of Appeals determination letter dated
January 21, 2021. Please have that corrected. There are no plans nor are the dimension shown of the survey of
some of the existing as-built's, please add dimensions onto the survey or on a site plan for the as-built
planter/bench, stone steps, new patio, and decking from patio to bulkhead. In the information box in the
bottom right corner of the survey,the town is Town of Southold, not Town of Southeast.
• Regarding the written out project description,the following is requested to be added in order for the description
to be complete: If not part of the current dimensions given, add the dimensions of the as-built trex decking
along bulkhead. Please add the as-built patio, planter/bench and stone steps each with dimensions to said
project description. Any and all structures proposed or existing need to be permitted. The existing shed needs
to be re-located per ZBA Determination, as this is currently within Trustee jurisdiction please add/show where
shed is to be located or removed off site, and if staying on the property the size of said shed.
• As soon as possible, but no later than Thursday,September 2"d please submit the as-built fee, revised project
description and four(4) new surveys in order to be considered to be added to our September 15, 2021 public

SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply
dated December 16,2020 stating that this application is considered a matter for local determination as there appears
to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency
review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards.The LWRP Coordinator issued a recommendation dated December 21,2020. Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available,
it is recommended that the proposed action is INCONSISTENT with LWRP policy standards since the structure was
constructed without obtaining required permits,although,being that the proposed action is less than the code required
minimum side yard setback of 10 feet, the Action is EXEMPT from LWRP review. The Action can be deemed
CONSISTENT by imposing conditions that require that the "as built" decks remain open to the sky, and that the
applicant obtain a building permit;and therefore,be CONSISTENT with LWRP policy standards.
PROPERTY FACTS/DESCRIPTION: The subject, non-conforming 13,894 square feet, .32 acre rectangular,
waterfront parcel located in the R40 Zoning District measures 80 feet along Strohson Road then runs cast 179.43 feet
along a residentially developed lot to the north,then runs 80.83 feet along wooden bulkheading at Baldwin's Creek,
then returns 167.91 feet along a second residentially developed lot the south. The subject parcel is developed with a
single-story wood frame residence with attached garage and waterside deck, concrete patio, an asphalt circular
driveway,concrete retaining wall before the bulkhead,a wooden pier with floating dock and a garden shed straddliirg
the southern lot line,as shown on the survey prepared by John Gerd Heidecker,L.S. and dated May 8,2017.
BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building
Inspector's November 5,2020 Notice of Disapproval based on an application for a permit to legalize an"as built"
deck addition and construct additions and alterations to an existing single-family dwelling;at 1)located less than the
code required minimum side yard setback of 10 feet; located at: 1460 Strohson Road (Adj. to Baldwin's Creek),

RELIEF REQUESTED: The applicant requests a variance to legalize an`as-built'waterside attached deck of 395.27
square feet,a first floor addition of 5.75 square feet,a second floor garage addition(storage area accessed via a pull
down stair) of 779.81 square feet, a garage expansion of 113.5 square feet, a covered front stoop addition of 120
square feet and a first floor front entry addition of 120 square feet,where the existing side yard setback of 6.7 feet
will be maintained while the code requires a minimum side yard setback of 10 feet.
ADDITIONAL INFORMATION: No immediate neighbor or member of the public spoke in favor of or against this
application. During the public hearing it was discovered that the storage shed located in the front yard straddled the
lot line to the south.
The subject parcel has the following Certificates of Occupancy on file:

FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals-held a public hearing on this application on January 7,2021 at which time written:
and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property
and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. Strohson Road consists of residential waterfront and non-
waterfront residences developed prior to zoning,along Baldwin's Creek. The roadway is unimproved and meanders
along the creek. The subject property is sited towards the end of the road where few people,other than the occupant
of the subject parcel or the residence to the north would commonly travel. Wlule the applicant proposes alterations
and additions to their property,the `as-built' and proposed improvement will maintain the pre-existing 6.7 feet side
yard setback with no further increase in its non-conformity. As a result of the house being setback from the roadway,
it will be hard for any individual to discern the difference between the code required 10 feet and maintaining the
existing setback.
2. Town Law§267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible
for the applicant to pursue, other than an area variance. The residence and garages were built at an earlier time and
a Certificate of Occupancy,#Z14386,was issued May 8, 1986 recognizing the non-compliant side yard setback of
6.7 feet where the code requires a minimum of 10 feet. As a result of the pre-existing setback, the `as-built' deck
follows the side fagade,creating the need for a variance. It is unclear whether the certificate of occupancy#218812,
issued February 21, 1990 for a deck with hot tub addition covers the `as-built' application for a deck, subject of this
application. Furthermore,the second-floor addition over the garage will also follow this pre-existing setback.
3. Town Law 5267-b(3)(b)(3). The variance granted herein are not mathematically substantial, representing 33%
relief from the code. However, the setback exists, and the applicant does not propose to further reduce the setback
as part of their alteration and additions plan.

4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter,236 of the Town's Storm Water Management Code.
5. Town Law§267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of additions and alterations,including a second-floor attic storage area over the garage,
to an existing single-family residence and the legalization of an `as-built' accessory deck while preserving and
protecting the character of the neighborhood and the health,safety and welfare of the community.
RESOLUTION OF THE BOARD:In considering all of the above factors and applying the balancing test under New
York Town Law 267-13,motion was offered by Member Planamento,seconded by Member Weisman(Chairperson),
and duly carried,to GRANT the variance as applied for,as shown on Site Plan and Architectural Drawings prepared
by Harold E.Gebhard,Architect,'dated October 1,2020 and labeled DWG NO 1 of 2 and DWG NO 2 of 2.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. The shed straddling the southern lot line is to be removed from the property or relocated to a conforming
... location.
2. The applicant must apply to the Building Department for a building permit for the "as built"
improvement(s)within ninety(90)days of the date of this decision and submit same to the Office of the
Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting
forth the reason(s)why the applicant was unable to obtain a building'permit in the time allotted.
3. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built"
improvement(s) and submit same to the Office of the Zoning Board of Appeals within twelve (12)
months of this decision or submit a written request for an extension to the Board of Appeals setting forth
the reason(s)why the applicant was unable to obtain a Certificate of occupancy in the time allotted.
4. The "as built"unprovement(s)may not be used until a Certificate of Occupancy has been obtained.
5. Prior to receiving a building permit for the additions and alterations proposed,the owner(s)of the
subject property cited herein must sign a statement acknowledging that he/she/they have read this
determination;understand the limits of the variance relief granted herein;and are aware that if a
demolition occurs during construction,or any construction undertaken exceeds the scope of the
approvals granted herein,the Zoning Board of Appeals retains jurisdiction and has the right,after a
public hearing,to modify,suspend or revoke such approvals or any term or condition thereof or to
impose thereon one or more new conditions,pursuant to Article XXV, Section 280-141 of the Town
Code
6. The subject second floor`attic storage', accessed via a pull-down stair,over the existing garage shall
remain non-habitable space and shall be unfinished with open stud walls and rafters.
7. At the discretion of the Board of Appeals, failure to comply with the above conditions may render this
decision null and void.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.
Any deviation front the survey, site plan and/or architectural drawings cited in this decision will result in delays
and/or a possible denial by the Building Department of a building permit, and may require a new application and
public hearing before the Zoning Board of Appeals.

Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey
cited above,such as alterations, extensions, or demolitions, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future use,setback
or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the
approval shall not be deemed effective until the required conditions have been met, and failure to comply therewith will
render this approval null and void.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not
increase the degree of nonconformity.
Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the
Board of Appeals shall become null and void where a Certificate of Occupancy has not been
procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three
(3)years from the date such variance was granted. The Board of Appeals may, upon written
request prior to the date of expiration, grant an extension not to exceed three(3) consecutive one
(1)year terms.
