Box 582 Bohemia, NY 11716 RE: ANTHONY & BEATRICE FALCONE 405 WILLIAMSBERG ROAD, SOUTHOLD SCTM#: 1000-78-5-17 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, July 13, 2022 regarding the above matter: WHEREAS, Jeffrey Patanjo on behalf of ANTHONY & BEATRICE FALCONE applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July 26, 2021, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council who was unable to make a recommendation as property was not staked at the time of their inspection; and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the proposed application be found Consistent with the LWRP; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 17, 2021 and July 13, 2022, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the structure(s), as applied for does not comply with the standards set forth in Southold Town Code Chapter 275-11(C)(2)(b) Docks locations and lengths[1]No dock shall be erected or extended if, in the opinion of the Trustees, such structure would adversely affect navigation, fisheries, scenic quality, habitats or wetland areas; 275-11(C)(2)(d)[5] Degradation of surface water quality and natural resources, and Southold Town Code Chapter 275-12D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vegetation or the natural habitat thereof, and Chapter 275-12F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the Town; and WHEREAS, the Board has determined that the request, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and, BE IT FURTHER RESOLVED that the Board of Trustees DENIES WITHOUT PREJUDICE the application of ANTHONY & BEATRICE FALCONE for the installation of two (2) 4'10" wide x 12'3" long personal watercraft floats (total of 118.3 s.f.) fastened to existing bulkhead in an end-to-end pattern so as to not obstruct navigation in existing channel; and as depicted on the site plan prepared by Jeffrey Patanjo, received on June 14, 2022. Applications For Permit Renewals,Modifications or Transfers The permittee must submit a separate written application to the Department for permit renewal, modification or transfer of this permit. Permit Modifications, Suspensions and Revocations by the Department The Department reserves the right to exercise all available authority to modify, suspend or revoke this permit. The grounds for modification, suspension or revocation include: a. materially false or inaccurate statements in the permit application or supporting papers; b. failure by the pennittee to comply with any terms or conditions of the permit; c. exceeding the scope of the project as described in the permit application; d. newly discovered material information or a material change in environmental conditions,relevant technology or applicable law or regulations since the issuance of the existing permit; e. noncompliance with previously issued permit conditions, orders of the commissioner, any provisions of the Environmental Conservation Law or regulations of the Department related to the permitted activity. 6. Permit Transfer Permits are transferrable unless specifically prohibited by statute,regulation or another permit condition.
