TYPE OF ACTION: UNLISTED DESCRIPTION OF ACTION: Appellant proposes to replace and approximately 600 lin. ft. of bulkhead and apDroximately of retaining wall. - install 180 lin. ft. SUPPORTING THIS DETERMINATION: An envIronmental assessment form in the short form has been submitted which indicated that there would be no adverse effect to the environment should the prcject be implemented as planned. Because there has been no response in the allotted time from the Southold Town Building Dept. and the N.Y.S.D.E.C.it is assumed that there are no objections nor comments from those aqencies. Wiggin, President PeconicAssociates, Inc. One Bootleg Alley P.O. Box 672 Greenport, NY 11944 Re: F-86-111 U.S. Ar~tv Corps of Engineers/NY District Permit Application - Budd's Pond Marine (Albertson Marine) - Town of Southold Request for Additional Information Dear Mr. Wiggin: We have reviewed the project documentation which we received on February 18, 1986 and have determined that the following information is needed to enable the Department to complete its federal consistency review for this proposed project: (1) Per our letter to you of February 20, 1986, please complete the enclosed Federal Consistency Assessment Form (FCAF) certifying that the above- referenced project is consistent with State Coastal Policies. Please be advised that our six-month review period commences upon receipt of your FCAF. Please take note of Section D of the FCAF. A list of State Coastal Policies is attached for your information. (2) Tidal wetlands maps (1974) indicate the presence of intertidal marsh areas at the boat basin mouth. Discuss the adverse impacts the proposed bulkheads, retaining wall and riprap (cross section B) may have on tidal wetlands and their values at the site. What is the type and areal extent of wetlands vegetation to be disturbed alon9 the shore? (Coastal Man- agement Program Policy 44). In addition, Budd's Pond Marina is adjacent to Port of Egypt Island, a proposed State significant habitat area documented as one of the largest common tern nesting areas in New York. Investigate the possible effects that the proposed dredging and shoreline construction activities may have on this wildlife habitat and how such impacts could/will be avoided (CMP Policy 7). Mr. Merlon E. Wiggin March 24, 1986 Page 2 (3) What are the existing and proposed water depths in the boat basin? Why is the proposed Channel depth of 5.0 feet below MLW necessary considering that boats 25 feet in length typically draw a draft of -3.0 feet? Docu- ment the distance between shoreline marsh areas and proposed dredge loca- tions (cross-sections on drawing #3) and explain how wetlands will be protected from slumping and erosion during the proposed dredging activity (CMP Policies 35 & 44). (4) Explore nonstructural alternatives to the propOeed bulkheads in the basin including vegetation, riprap, etc. Co~leteiand return the attached Vege- tative Treatment Potential form (CMP Policy i7), (5) Verify that storm~ater runoff will be controlled on site. For example at the concrete ramp, French drains ora berm may be used at the shore- ward edge of the ramp to divert runoff from directly entering State coastal waters. Other best management pract~!ces exist to control runoff andshould beexp~ored. These include, but are not limited to, natural drainage swales, retention or leaching basins and l0 foot wi de vegetated buffer striPsbetween the proposed bulkheadsiandparking areas (CMP Pol~icies 8, 33, 37, & 38). (6) Please discuss ,the adequacy of onsite parking facilities and provisions for public access to the marina (CMP Policies 19 & 20). (7) Please provide the Department'with on-site color photographs including views showing ~he basin inlet wetlands, and shoreline areas where altera- tion activities are proposed. We would appreciate receiving any other information which might facilitate our consistency review for this project. Please provide the information requested above to the Department of State within thirty days from the date of this letter. If this information is not pro- vided, the Department of State may object to your consistency certification on the grounds of insufficient information needed to determine the consistency of the proposed activity with the New York State Coastal Management Program. A copy of this letter has been sent to the U.S. Army Corps of Engineers. Please call me at (518) 474-3642 if you have any questions. Enclosures AVT:KAC:dlb CC: M. Greges, COE/NY District C. Attached are application forms and site plan for the replacement and reinstallation of wooden bulkhead and wooden retaining wall for shore protection, including excavation of approximately seven hundred (?~0) cupic yards of redeposited material. Work is required primarily as a result of storms of March 1984 and Hurricane Gloria. Existing floating docks to be repaired and reinstalled. Without the above remedial work, marina will not be useable for the 1986 boating season. If not accomplished, approximately sixty (6~) boat owners will not have a boat slip for the coming season. In addition, because of the washed out bulkhead, the high Southerly winds on January 25th and 26th erroded several more feet in the Northeast corner of the basin and is within five (5) feet of existing Port of Egypt structure.
