The public will ALSO have access to view and listen to the meeting as it is happening via Zoom. However, this meeting is not a public hearing and no testimony will be solicited or received. Present were: Leslie Kanes Weisman, Chairperson William Duffy, Town Attorney Nicholas Planamento,Vice Chair Elizabeth Sakarellos, Office Assistant Eric Dantes, Member Kim E. Fuentes, Board Assistant Patricia Acampora, Member Carrie O'Farrell,NP&V, Virtually attended Robert Lehnert, Member 3:33 P.M. Chairperson Weisman opened the meeting in order to call for Executive Session. Vote of the Board: Ayes: Members Weisman (Chairperson) Planamento, Lehnert and Acampora Dantes. This Resolution was duly dopted (5-0). EXECUTIVE SESSION: 3:33 P.M. Motion was offered by Chairperson Weisman, seconded by Member Planameno to enter into Executive Session in order to receive Attorney Advice. Vote of the Board: Ayes: Members Weisman (Chairperson) Planamento Lehnert and Acampora Dantes. This Resolution was duly adopted (5-0). Vote of the Board: Ayes: Members Weisman (Chairperson), Planamento, Dantes, Acampora and Lehnert. This Resolution was duly adopted (5-0). WORK SESSION: Began at 5:15 PM A. Requests from the Board Members for future agenda items. DELIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS: Agenda items and commenced deliberations on the following applications. This Resolution was duly adopted RESOLUTIONS: RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Acampora to authorize advertising of hearings for Regular Meeting to be held on Thursday, September 2, 2021 which will commence at 9:00 A.M. for Executive Session and 10:00 A.M. for Regular Meeting. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Acampora to approve Minutes from Regular Meeting held August 5, 2021. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). RESOLUTION ADOPTED: To Accept the Final Environmental Impact Statement last revised July 2021 for the Special Exception Application of The Enclaves Hotel and Restaurant, as follows: WHEREAS, the Town of Southold Zoning Board of Appeals (ZBA) has received an application ("Case#7046") from Andrew Giambertone and Associates, Architects, on behalf of client and property owner 56655 Main Street LLC c/o Jonathan Tibett for a Special Exception Use Permit for "The Enclaves" 44-unit hotel and 74-seat "sit-down" restaurant, the hotel being a Special Exception Use in the Town's Hamlet Business Zoning District; and WHEREAS, the subject 6.75-acre property is located at 56655 Main Street ("NYS Route 25") in the Town of Southold and is identified as Suffolk County Tax Map No: District 1000; Section 63; Block 3; Lot 15; and WHEREAS, the proposed project was classified as an"Type I" action pursuant to the State Environmental Quality Review Act("SEQRA") and the ZBA conducted a coordinated review with involved agencies and issued a Final Scope dated April 19, 2018 for the DEIS; and WHEREAS, the applicant submitted and revised a Draft Environmental Impact Statement ("DEIS") pursuant to ZBA comments and on October 7, 2019, the last revised DEIS dated August 2019 was found to be adequate with respect to its scope and content for the purpose of filing, distribution, and commencing public review; and Minutes of the Zoning Board of Appeals August 19, 2021, Page 4 WHEREAS, a DEIS Notice of Completion was published in the New York State Department of Environmental Conservation(NYSDEC) Environmental Notice Bulletin on October 16, 2019 providing a public comment period to November 18, 2019; and WHEREAS, a public hearing was held on November 7, 2019 and the ZBA elected to extend the written comment period to December 9, 2019; and WHEREAS, the Applicant prepared a Final Environmental Impact Statement ("FEIS") in response to comments and questions received during the document review period and, after several revisions of same, has revised the FEIS to address ZBA comments. NOW THEREFORE BE IT RESOLVED, that the ZBA accepts the FEIS for the Proposal as adequate for purposes of public and agency consideration; and BE IT FURTHER RESOLVED, that the requisite Notice of Completion be filed with the NYSDEC Environmental Notice Bulletin and that the FEIS be circulated to involved agencies, posted online, and made available as a paper copy at Town Hall for public consideration. A motion to adopt the above Resolution was made by Member Weisman (Chairperson) seconded by Member Lehnert and adopted upon the following vote: Vote of the Board: Ayes: Members Weisman(Chairperson), Planamento, Dantes, and Lehnert. Nays: Member Acampora. This Resolution was duly adopted (4-1). There being no other business properly coming before the Board at this time, the Chairperson declared the meeting adjourned.
