In accordance with the Memorandum of Heather Lanza, Southold Town Planning Director, dated September 14, 2009, the Town Board requests that your client withdraw the change of zone application presently before the Town Board prior to your client's expenditure of additional monies. As a matter of policy, the Town Board does not consider change of zone applications when there is alternative relief available. Here, as noted in the Lanza Memorandum, offices and meeting space owned by a non-profit and/or charitable organization may be permitted in the R-40 zone by special exception approval from the Zoning Board of Appeals (§280-13B(5)). While your client will be required to comply with the special exception conditions set forth in the Zoning Code or seek additional area variance relief from the Zoning Board of Appeals, the alternative is available and it is suggested that your client pursue this avenue prior to proceeding with an application for a change of zone. Estimated building dimensions, including height, s.f., #floors, basement; 2. Estimated# seats in meeting hall; 3. Estimated# s.f. of office space; and 4. Environmental Assessment Form is incomplete. This information should be submitted prior to finding the application complete. Although the missing information is necessary for a complete application,there is enough information for this department to review the requested zone change. The application describes the use as offices and meeting space to be owned by a non-profit, and will provide space for a local charity, Community Action Southold Town(CAST), and other charitable organizations. After a review of the zoning code, the use appears to be permitted in the R-40 zone by Special Exception approval from the ZBA (280-13B (5): W =a (5) Philanthropic, eleemosynary (definition of eleemosynary: of, relating to, or supported by charity) or religious institutions, (definition and emphasis added) health care, continuing care and life facilities, but excluding facilities for the treatment of all types of drug addiction, subject to the following requirements: [Amended 12-27-1994 by L.L. No. 30-1994; 11-12-1996 by L.L.No. 20-1996] (a) No building or part thereof or any parking or loading area shall be located within 100 feet of any street line nor within 50 feet of any lot line. (b) The total area covered by principal and accessory buildings shall not exceed 20% of the area of the lot. (c) The maximum height shall be 35 feet or 2 1/2 stories. (d) The entire lot, except areas occupied by buildings or parking or loading areas, shall be suitably landscaped and properly maintained. The site plan sketch submitted does not meet the first Special Exception requirement regarding the setbacks. Rather than seek a variance from that requirement, the applicant has applied to change the zone from R-40 to B to benefit from the smaller setback requirements in that district. This is not reason enough to change the zoning district on a single parcel. There are no other compelling reasons to change the zoning of this parcel from residential to commercial, and several reasons to reject the application,including the following: 1. It would cause the B zoning district to protrude into the residential district adjacent and across the street. 2. It would isolate the residential property to the east between the school and the business district. 3. The uses allowed in the B zone include many commercial activities that may not be compatible with the adjacent residential zoning. While the proposed use would likely make a good transition from commercial uses to residential, the Town Board must consider the full range of permitted uses in the proposed zoning district. Most important, the applicant has not exhausted other, less drastic measures of relief from the zoning code. For example, the applicant has the option to apply to the Zoning Board of Appeals for relief from the conditions of the Special Exception that the application does not meet (setbacks of the building and parking areas). This department recommends that the Town Board not consider the change of zone petition before these other remedies sought. Greenport Village Board 3rd Street Greenport, NY To The Greenport Village Board, My Name is Darryl Volinski and 1 reside at 35 Washington Avenue Greenport with my wife and two children and lived in the neighborhood all my life. I would like to express my concern and other neighbors about the traffic that has doubled since the connection of Cedar Fields and Moors Lane. I'm not concerned as much as the volume, but the rate of speed vehicles travels down Washington Avenue. We have a neighborhood of small children; this concerns me because I've seen cars moving down the road at an estimate of 55 miles per hour many times a day and aggressive maneuvering as well. l would suggest this problem be evaluated before a tragedy happens. Estimated building dimensions, including height, s.f., # floors,basement; 2. Estimated# seats in meeting hall; 3. Estimated#s.f. of office space; and 4. Environmental Assessment Form is incomplete. This information should be submitted prior to finding the application complete. Although the missing information is necessary for a complete application, there is enough information for this department to review the requested zone change. The application describes the use as offices and meeting space to be owned by a non-profit, and will provide space for a local charity, Community Action Southold Town(CAST), and other charitable organizations. After a review of the zoning code, the use appears to be permitted in the R-40 zone by Special Exception approval from the ZBA (280-13B (5): (5) Philanthropic, eleemosynary (definition of eleemosynary:of, relating to, or supported by charity) or religious institutions, (definition and emphasis added)health care, continuing care and life facilities,but excluding facilities for the treatment of all types of drug addiction, subject to the following requirements: [Amended 12-27-1994 by L.L.No. 30-1994; 11-12-1996 by L.L.No. 20-1996] (a) No building or part thereof or any parking or loading area shall be located within 100 feet of any street line nor within 50 feet of any lot line. (b) The total area covered by principal and accessory buildings shall not exceed 20% of the area of the lot. (c) The maximum height shall be 35 feet or 2 1/2 stories. (d) The entire lot, except areas occupied by buildings or parking or loading areas, shall be suitably landscaped and properly maintained. The site plan sketch submitted does not meet the first Special Exception requirement regarding the setbacks. Rather than seek a variance from that requirement,the applicant has applied to change the zone from R-40 to B to benefit from the smaller setback requirements in that district. This is not reason enough to change the zoning district on a single parcel. There are no other compelling reasons to change the zoning of this parcel from residential to commercial, and several reasons to reject the application, including the following: 1. It would cause the B zoning district to protrude into the residential district adjacent and across the street. 2. It would isolate the residential property to the east between the school and the business district. 3. The uses allowed in the B zone include many commercial activities that may not be compatible with the adjacent residential zoning. While the proposed use would likely make a good transition from commercial uses to residential, the Town Board must consider the full range of permitted uses in the proposed zoning district. Most important,the applicant has not exhausted other, less drastic measures of relief from the ** - zoning code. For example, the applicant has the option to apply to the Zoning Board of Appeals for relief from the conditions of the Special Exception that the application does not meet (setbacks of the building and parking areas). This department recommends that the Town Board not consider the change of zone petition before these other remedies sought. DESIGN CONCEPT The proposed change of zone is to allow the construction of a building that would provide a permanent home for C.A.S.T. (Community Action Southold Town) and also provide meeting rooms for use by other community organizations and activities. As now planned, the building will consist of large and small meeting rooms, a kitchen, two bathrooms, several offices, a computer training room and several storage rooms. Off- street parking would be provided for the offices and for all but the largest meetings. The entrance to the parking lot for the Greenport School is only 130 feet east of the subject parcel. If permission were granted by the School to use their parking lot to accommodate the overflow parking, that would eliminate the need for guests to walk across the highway at night after parking along Ninth Street. B. OBJECTIVE OF DEVELOPER The objective of the project is to provide a permanent home for C.A.S.T. and, in addition, to provide facilities for use by other community organizations and activities benefiting the Town of Southold. The building would be owned by a non-profit foundation and supported by an endowment. This project needs to be located in or near the Village of Greenport where many of C.A.S.T's clients live and work. The project will be designated as a memorial to my wife, Barbara Dwight Schriever, who was one of the founders of C.A.S.T. some forty-four years ago and who dedicated her life to serving this community. Mrs. Schriever passed away on December 21, 2006. C. COMPLIANCE WITH TOWN CODE AND MASTER PLAN The instant project would be compliant with Town Code and Master Plan of the town of Southold in that it would be consonant with controlled development of a non environmentally sensitive area that reflects a logical progression towards a commercial use of a property that now lies along a major thoroughfare and is already adjacent to several commercial properties. If the use can be described as a philanthropic, eleemosynary or religious institution and, if granted a Special Exception from the Board of Appeals, this project could be built within the existing Low-Density Residential R-40 District under Section 280-17B(1) which then refers to Section 280-13B(5). However, quoting from Section 280-13B(5)(a) "No building or part thereof or any parking or �F loading area shall be located within 100 feet of any street line nor within 50 feet of any lot line." That restriction alone means that the minimum practical size of the lot in the R- 40 District would have be about 80,000 square feet or more than twice as large of the subject parcel. The cost to purchase and to maintain such a large parcel within the hamlet of Greenport would be prohibitive. Fortunately, if the use can be described as an auditorium or meeting hall, this project can be built within the proposed General Business B District under Section 280- 48A(2)) which then refers to Section 280-45A(13). The Bulk Schedule for Business, Office and Industrial Districts, Chapter 280, Attachment 4, states that for the B District, the minimum lot size is 30,000 square feet, the minimum side yard setbacks are 25 feet and the maximum lot coverage is 30 percent. The size of the subject parcel is 35,403 square feet which is more than sufficient to comply with the area requirement for the B District. Quoting from Section 280-47, "The purpose,of the General Business (B) District is to provide for retail and wholesale commercial development and limited office and industrial development outside of the hamlet central business areas, generally along major highways." That statement accurately describes the location of the subject parcel which fronts on Route 25 within the hamlet of Greenport but outside the central business area. The parcels adjoining the subject parcel immediately to the west and continuing westerly along the north side of Front Street are all in the B District. In conclusion, the area of the subject parcel appears to be adequate for the project, the location of the subject parcel is suitable for the zoning requested and the zoning requested is consistent with the zoning in the immediate neighborhood. The property is less suitable now for residential purposes than in the past due to the increased traffic and, given the aims of the developer as stated above, the proposed change would greatly allow the general welfare of the community to be served. DESIGN CONCEPT The proposed change of zone is to allow the construction of a building that would provide a permanent home for C.A.S.T. (Community Action Southold Town) and also provide meeting rooms for use by other community organizations and activities. As now planned, the building will consist of large and small meeting rooms, a kitchen, two bathrooms, several offices, a computer training room and several storage rooms. Off- street parking would be provided for the offices and for all but the largest meetings. The entrance to the parking lot for the Greenport School is only 130 feet east of the subject parcel. If permission were granted by the School to use their parking lot to accommodate the overflow parking, that would eliminate the need for guests to walk across the highway at night after parking along Ninth Street. B. OBJECTIVE OF DEVELOPER The objective of the project is to provide a permanent home for C.A.S.T. and, in addition, to provide facilities for use by other community organizations and activities benefiting the Town of Southold. The building would be owned by a non-profit foundation and supported by an endowment. This project needs to be located in or near the Village of Greenport where many of C.A.S.T's clients live and work. The project will be designated as a memorial to my wife, Barbara Dwight Schriever, who was one of the founders of C.A.S.T. some forty-four years ago and who dedicated her life to serving this community. Mrs. Schriever passed away on December 21, 2006. C. COMPLIANCE WITH TOWN CODE AND MASTER PLAN The instant project would be compliant with Town Code and Master Plan of the town of Southold in that it would be consonant with controlled development of a non environmentally sensitive area that reflects a logical progression towards a commercial use of a property that now lies along a major thoroughfare and is already adjacent to several commercial properties. If the use can be described as a philanthropic, eleemosynary or religious institution and, if granted a Special Exception from the Board of Appeals, this project could be built within the existing Low-Density Residential R-40 District under Section 280-17B(1) which then refers to Section 280-13B(5). However, quoting from Section 280-13B(5)(a) "No building or part thereof or any parking or loading area shall be located within 100 feet of any street line nor within 50 feet of any lot line." That restriction alone means that the minimum practical size of the lot in the R- 40 District would have be about 80,000 square feet or more than twice as large of the subject parcel. The cost to purchase and to maintain such a large parcel within the hamlet of Greenport would be prohibitive. Fortunately, if the use can be described as an auditorium or meeting hall, this project can be built within the proposed General Business B District under Section 280- 48A(2)) which then refers to Section 280-45A(13). The Bulk Schedule for Business, Office and Industrial Districts, Chapter 280, Attachment 4, states that for the B District, the minimum lot size is 30,000 square feet,,the minimum side yard setbacks are 25 feet and the maximum lot coverage is 30 percent. The size of the subject parcel is 35,403 square feet which is more than sufficient to comply with the area requirement for the B District. Quoting from Section 280-47, "The purpose,of the General Business (B) District is to provide for retail and wholesale commercial development and limited office and industrial development outside of the hamlet central business areas, generally along major highways." That statement accurately describes the location of the subject parcel which fronts on Route 25 within the hamlet of Greenport but outside the central business area. The parcels adjoining the subject parcel immediately to the west and continuing westerly along the north side of Front Street are all in the B District. In conclusion, the area of the subject parcel appears to be adequate for the project, the location of the subject parcel is suitable for the zoning requested and the zoning requested is consistent with the zoning in the immediate neighborhood. The property is less suitable now for residential purposes than in the past due to the increased traffic and, given the aims of the developer as stated above, the proposed change would greatly allow the general welfare of the community to be served.
