BARGAIN AND SALE DEED with Covenant against Grantor's Acts
THIS INDENTURE, made the 5th day of March 2021 BETWEEN
JOAN FALLON and RICHARD YETT, with an address at 2229 Indian Neck
Lane, Peconic, NY 11958, party of the first part and
MOIRA KATE TOTARO, residing at 229 Chrystie Street, Apt # 920, New
York, NY 10002, party of the second part.
WITNESSETH, that the party of the first part in consideration of ten dollars and
other valuable consideration paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party
of the second part, forever,
ALL that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being in the
(see attached schedule "A")
Being the same premises described in the deed to the parties of the first part herein
dated December 1, 2003 and recorded December 16, 2003 in Liber 12290 page 266
in the office of the County Clerk, County of Suffolk,State of New York.

TOGETHER with all right, title and interest, if any, of the party of the first part
of, in and to any streets and roads abutting the above described premises to the center
lines thereof; TOGETHER with the appurtenances and all the estate and rights of the
party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the
party of the second part forever.
AND the party of the first part covenants that the party of the first part has not
done or suffered anything whereby the said premises have been encumbered in any way
whatsoever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust fund to be applied first for
the purpose of paying the cost of the improvement and will apply same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of
this indenture so requires.

BEGINNING at a point on the Northerly line of a 15 foot right of way, where said Northerly line of said right of way
intersects the Easterly line of Indian Neck Lane, and from said point running in an Easterly direction, 643.95 feet,to lands
now or formerly of Duchow;
RUNNING THENCE along said land, 396.80 feet, to lands now or formerly of Pontino;
THENCE along lands now or formerly of Pontino South 21 degrees 29 minutes 20 seconds East, 240.0 feet to the true
point or place of BEGINNING;
THENCE from said point of beginning, South 72 degrees 29 minutes 20 seconds East, along land (now or formerly) Fanelli
246.38 feet(276.06 feet deed)to a tie line along the high water mark of Richmond Creek;
THENCE along said tie line along the high water mark of Richmond Creek,the following two(2)tie line courses and
distances:
1. South 13 degrees 44 minutes 34 seconds West, 127.45 feet(136.70 feet deed);
2. South 57 degrees 01 minutes 23 seconds West, 120.36 feet (104.38 feet deed)to land now or formerly of Pontino:

TOGETHER with an Easement 25 feet in width, as shown on a certain map made by Roderick Van Tuyl, dated June 26,
1973, and last amended December 30, 1980, which map was fled by the Planning Board of the Town of Southold, under
date of April 7, 1981, which Easement extends across other land now or formerly of Gertrude Duchow, as shown as Lot
No. 1, on a subdivision map annexed hereto, and further, together with an easement 15 feet in width from the Northwest
corner of premises owned by Gertrude Duchow to Indian Neck Lane.
THE POLICY TO BE ISSUED under this commitment will insure the title to such buildings and improvements on the
premises which by law constitute real property.
FOR CONVEYANCING ONLY: Together with all the right, title and interest of the party of the first part, of in and to the
land lying in the street in front of and adjoining said premises.
