Comments regarding resolution 9562
SUPERVISOR RUSSELL: I just want to quickly say something, because we have two
resolutions in a row here, 562 and 563 and they look like they are for events each day every
weekend going through July and August. I will support 562, but I am going to ask the Board to
consider the fact that in past circumstances we questioned whether so many events on (inaudible)
basis was simply a change in business model and I think that we really have to get to the bottom
of that in terms of equity (inaudible) so I am voting for 562, 1 just want you to know how I feel
for the next one because I think they are in for-the (inaudible)___

Whereas Lauren Paterson was unable to start on her hire date; and
Therefore it is RESOLVED to rescind resolution 2021-092; and
It is further RESOLVED to appoint, with effect June 18, 2021, Lauren Paterson as a part-time Cashier
(FIFD) at a rate of$14.00 per hour.
It is further RESOLVED to temporarily appoint with effect June 19, 2021, Ms. Paterson from part-time to
full-time summer seasonal status. On September 15, 2021, Ms. Paterson will terminate her summer
seasonal position and on September 16, 2021, be re-appointed to part-time Cashier (FIFD).

Approve Resolution Number 2021-114
RESOLVED that the Town Board of the Town of Southold hereby ratifies and approves
Resolution Number 2021-114 of the Fishers Island Ferry District adopted July 6, 2021 which
reads as follows:
It is RESOLVED to rescind Resolution 2021-066; and
WHEREAS the Ferry District requires additional full-time and part-time Deckhands (FIFD) during the peak
season between May 15, 2021, and September 15, 2021; and
Therefore it is further RESOLVED to re-appoint with effect May 14, 2021,Jonathan Hiller as a part-time
Deckhand (FIFD) at a rate of$21.00 per hour; and
Therefore it is further RESOLVED to temporarily appoint with effect May 15, 2021, Mr. Hiller as a
summer seasonal Deckhands (FIFD) and at the end of business on September 15, 2021, Mr. Hiller will
terminate his summer seasonal position and on September 16, 2021, be appointed a part-time

WHEREAS, Mattituck Farm Holdings, LLC, owns approximately 256± acres in Cutchogue,
located between Depot Lane to the east and Elijah's Lane to the west, and between Oregon Road
to the north and County Road 48 to the south; and
WHEREAS, a combined total of 136± acres are subject to existing Town or County
development rights easements, and the remaining lands, a combined total of 120± acres, have
development rights intact; and
WHEREAS, all of the properties are located within the Agricultural-Conservation (A-C) zoning
district, are comprised of Prime Soils, and are in active agriculture; and
WHEREAS, the properties are listed on the Town's Community Preservation Project Plan as
properties that should be preserved due to their agricultural value and aquifer recharge area
value; and
WHEREAS, the Town proposes to purchase six (6) separate Development Rights Easements, on
all or part of some of the properties owned by Mattituck Farm Holdings, LLC, on a cumulative
total of 106.78± acres. Said properties are identified as all or part of SCTM 41000-95-3-3.4
(4710 Oregon Road), 1000-95-3-8.1 (5780 Oregon Road), 1000-95-4-1 (7040 Oregon Road),
1000-95-4-3.1 (8500 Alvah's Lane), 1000-95-4-5.2 (8820 Alvah's Lane), 1000-95-4-12 (19285
County Road 48) and 1000-95-4-13 (19155 County Road 48), in Cutchogue,New York, and
WHEREAS, as part of the acquisition, the remaining 13± cumulative acres, including new
development (reserve) areas and existing development (reserve) areas, will each be subject to the
recording of a Declaration of Covenants & Restrictions simultaneously with the Easement,
including a requirement that the area will remain permanently attached to the preserved farm.

WHEREAS, as a condition of the acquisition, the existing tax parcels known as SCTM #1000-
95.4-12 and #1000-95.-4-13, each 6.5± in acres, will be merged; and
WHEREAS, as a condition of the acquisition, the existing tax parcels known as SCTM #1000-
95.4-9.2 (4.3 acres subject to existing Town development rights easement) and #1000-95.-4-10
(19.5 acres subject to existing Town development rights easement), will be merged; and

WHEREAS, the total acquisition purchase price is $6,000,000.00 (six million dollars),
calculated to be $56,190.30 (fifty-six thousand one hundred ninety and 30/100 dollars) per
buildable acre based on the 106.78± acres contemplated to be encumbered as follows:
SCTM #1000-95.-3-3.4 1.98± acres at $ 111,257.00
SCTM #1000-95.-3-8.1 53.00± acres at $ 2,978,086.00
SCTM #1000-95.4-1 10.00± acres at $ 561,903.00
SCTM #1000-95.-4-3.1 24.00± acres at $ 1,348,567.00
SCTM #1000-95.-4-5.2 4.80± acres at $ 269,713.00
SCTM #1000-95.4-12 & 13 13.00± acres at $ 730,474.00
If the final survey shows that the total acreage of the Premises is different from the 106.78± acre
figure used to determining the purchase price for each easement, the final price per acre shall be
adjusted such that the final purchase price remains at $6,000,000.00 (six million dollars.) The
exact areas of the acquisitions are subject to Town-provided surveys acceptable to the Land
Preservation Committee and the landowner; and
WHEREAS, Community Preservation Funds will be used to acquire the easements and to pay
for closing costs and expenses associated with the acquisitions; and
WHEREAS, the Town commissioned an appraisal, by a qualified appraiser, to value the
development rights and restrictive covenants on portions of the subject parcels. The Town
acknowledges that the Town's purchase offer is below the fair market value as determined by the
appraisal, and the landowner may be eligible to claim a bargain sale; and
WHEREAS, this acquisition involves six easements, three new development (reserve) areas,
four covenants and restrictions for existing development (reserve) areas as well as two 2-lot
mergers of parcels and is subject to, and contingent upon, the Town's acquisition of the entire
scope of this proposed project; now, therefore, be it
RESOLVED that pursuant to the provisions of Chapter 17 (Community Preservation Fund) and
Chapter 70 (Agricultural Lands Preservation) of the Town Code, the Town Board of the Town of
Southold hereby sets Tuesday, July 27, 2021 at 4:30 p.m., Southold Town Hall, 53095 Main
Road, Southold, New York as the time and place for a public hearing for the purchase of
Development Rights Easements, in accordance with the acquisition as detailed above, on
properties owned by Mattituck Farm Holdings, LLC; and,
FURTHER NOTICE is hereby given that a more detailed description of the above mentioned
parcels of land are on file in Land Preservation Department, Southold Town Hall Annex, 54375
Route 25, Southold, New York, and may be examined by any interested person during business
hours.

of the Town Board, and factors such as the public benefit provided to the community shall be

District (HB)to create one (1) affordable apartment that will remain affordable in perpetuity,

necessary so as to provide for the safety and welfare of the Town's citizens and for the
orderly flow of vehicular and pedestrian traffic on busy local streets.

RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
Law entitled, "A Local Law in relation to an Amendment to Chapter 260-8, Parkin;;
prohibited at all times" reads as follows:
LOCAL LAW NO. 12 2021
A Local Law entitled, "A Local Law in relation to an Amendment to Chapter 260-8,
Parkins prohibited at all times".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The purpose of this local law is to improve safety for pedestrians and vehicles, as well as
dealing with impacts to the public's health, safety and welfare.
II. Chapter 260 of the Code of the Town of Southold is hereby amended by removing the
struck through portions and adding the underlined portions as follows:
§ 260-8 Parking prohibited at all times.
The parking of vehicles is hereby prohibited at all times in any of the following locations and at
any other location where signage indicates "no parking":
Cedar Beach Road Both From the intersection of
Paradise Point Road to its westerly
terminus
III. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

Doorhy, to hold Special Event 2021-38 at the Peconic Bay Vineyards, 31320 Main Road,
Cutchogue,New York as applied for in Application PBV3a for Kaits Angels Fundraiser on
August 20, 2021 from 5:OOPM to 9:00 PM, provided they adhere to all conditions on the
application, permit and the Town of Southold Policy for Special Events. All parking must be
contained on site. This permit is subject to revocation if the applicant fails to comply with any of

increasing and impacting the local streets. Regulation of pedestrian traffic on local streets is
necessary so as to provide for the safety and welfare of the Town's citizens and for the
orderly flow of vehicular and pedestrian traffic on busy local streets.
B. There shall be a pedestrian crosswalks at the following locations:

SUPERVISOR RUSSELL: Would anyone like to address the Town Board on this particular
local law?
Marcy Fetyani
MARCY FETYANI: I am Marcy Fetyani, I live on Cedar Beach Road and just wanted to
confirm that that will become parking prohibited down that entire street because we have had
issues recently with people parking there that shouldn't be, so I just wanted to be sure that was
going to be implemented. I wanted to make my voice heard because we are the last house on
Cedar Beach Road on the right hand side.

SUPERVISOR RUSSELL: Yes, this would be from Paradise Point Road all the way down to
the parking lot on both side. yes, that was actually, the genesis of this was by request of Suffolk
County Legislator Al Krupski, so that they could, it would help with their enforcement also so
that it was only Suffolk County residents on Cedar Beach.
MS. FETYANI: Right. Okay.
SUPERVISOR RUSSELL: This was what they felt was one step that would make their job
easier.
COUNCILWOMAN DOHERTY: Yeah, it would help the Chief do our side, so the county can
have their side easier.
COUNCILWOMAN NAPPA: Right because that is a Suffolk County beach.
COUNCILWOMAN DOHERTY: Right.
MS. FETYANI: So there is no parking on Cedar Beach Road at all.
SUPERVISOR RUSSELL: There will be none.
MS. FETYANI: And there will be signs, other than the paper signs?
COUNCILWOMAN DOHERTY: Yes, once we approve this, it gets filed with the state and it
goes to the Highway Department to request them to put the signs up. So in a few weeks there
should be signs up.
MS. FETYANI: Great. Just wanted to make sure that our voice was being heard.
COUNCILWOMAN DOHERTY: Thank you for coming down, we appreciate it.
SUPERVISOR RUSSELL: Would anybody else like to address the Town Board on this?
Councilwoman Nappa
COUNCILWOMAN NAPPA: I did think one of the attendees wanted to speak, so if you would
hit your raise hand button if you would like to speak? On the bottom of your zoom screen?
Well, I can speak I guess if he doesn't want to speak publicly, he did email me and said that I
could address the Board with his concerns. He is a local resident and he fishes at night there and
lie is concerned that if there is no parking on both sides, he won't have anywhere to park in that
area since they close the gates at the beach and there is no parking in there and it would
effectively make it impossible for him to fish there. That was his concern, I don't know if we
want to discuss it. I don't remember when we discussed it before if we talked about doing permit
only, so that it was limited to Southold residents only, that could be an option.
COUNCILWOMAN DOHERTY: That is what it is now.

COUNCILWOMAN NAPPA: Oh, that's what it is now?
SUPERVISOR RUSSELL: The problem is, I don't know if the County (inaudible) for night
fishing and we only own the very small spot there, that goes down to the mean high water mark
(inaudible) and I don't know what their rules are on night fishing. I understand his concern and I
don't know if we can address it because it will be the County that sets its own night fishing rules
and if the county allows fishing at night then it should leave it's gate open. I don't know how to
address that.
COUNCILWOMAN DOHERTY: We own the beach right in front of the road end, right?
SUPERVISOR RUSSELL: Yeah but it's very narrow, 50 feet. It's all county beach there
(inaudible).
MS. FETYANI: Can I say last year they did close the gates at night and in the morning, but this
year it doesn't seem like they are doing that.
SUPERVISOR RUSSELL: Well, last year got special attention like all the towns in the county
because of the pandemic and also we did have enforcement issue because as you are aware, as
each different towns are making different rules,the pressure in one area is getting pushed off to
another area. We were all down there, I don't think they are doing it probably as diligently as
they did last year but I also don't think they've been ignoring it like they had done...
MS. FETYANI: No, we don't have hundreds of people on the beach, last year we had crazy
numbers of people, they have eliminated that but in regard to the night fishing, fishing is a nice
sport but when you let one person start to do it, it needs to be in a better controlled environment
because garbage is left on the street, there is a disregard for the beach honestly and I understand
it's a Suffolk County beach but not a Southold issue necessarily but it's also an issue for those of
us who live in the neighborhood. Cars flying down the street at night and it just becomes an
issue, it's a nice quiet area but...
SUPERVISOR RUSSELL: Yeah, comparing this to the gentleman, I understand the night
fishing...
MS. FETYANI: Me too.
SUPERVISOR RUSSELL: And there are people that fish at night that don't get permits and
they tend, you know,just like everybody they can abuse beaches but a lot of people get their
permits and the reason is is to allow them to go fishing at night. I don't know what county rules
are, we only govern like 50 feet there. I don't know what county beach rule, if they allow fishing
at night, they should leave the gate open. I can't address that (inaudible) but I, actually the
gentleman raised that concern, I am willing to close the hearing and wait two weeks.
COUNCILWOMAN DOHERTY: Well, there is parking up the street. We are not closing the
whole entire street. We are closing that road end.

COUNCILWOMAN NAPPA: Because there is no other parking in that area. There really isn't.
But there's a huge parking lot.
MS. FETYANI: Yeah, Suffolk County, it's their beach then they should make sure it's used
properly. I have no problem with the beach, I just don't think we should have 100 people fishing
the beach....
SUPERVISOR RUSSELL: Well, that's the balancing act. If they do leave the gate open, then
you are going to see a huge crowd. If they don't leave it open, then you are alienating a person,
even if it's an individual, you have got to listen to them.
MS. FETYANI: No, I feel for them, honestly I do. As long as it's respected but maybe it's a
Suffolk County issue (inaudible).
