SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated June 1, 2021 stating.that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards: The LWRP Coordinator'issued a recommendation dated July 14, 2021. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP pursuant to Policy 4.1. The intent of the Southold Town Code requirement of 100 feet top of bluff setback from structures is to minimize impacts on natural protective feature and protect structures from damage and loss due to storms and erosion overtime. Consideration of 30 feet wide landscaped buffer landward from the top of the bluff is recommended and an increase in the top of bluff setback to 80 feet will result in a more CONSISTENT action with LWRP policy standards. SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: This application was referred for an evaluation and recommendation to the Suffolk County SWCD. According to the information provided in a letter from the agency dated June 16,2021,following an inspection conducted on June 14, 2021,the agency described the bluff as well vegetated with what appears to be a diverse selection of forbs, grasses, shrubs and appears to be in relatively stable condition. There are also grasses along the top of the bluff just before the drop and there appears to one retaining wall present. Furthermore,there appears to be minimal to no runoff issues from the dwelling towards the bluff. The toe of the bluff is well vegetated and the beach itself is partially vegetated. The proximity of the proposed pool and patio to the bluff could be a possible concern in maintaining the integrity of the bluff. These structures can negatively affect the bluff by way of surface and subsurface water flow issues and increase of stormwater runoff towards and down the bluff. In closing,the agency recommends NYS standards and specifications Page 2,August 19,2021 #7525,Zoitas SCTM No. 1000-14-2-3.15 for erosion and sediment control procedures and proper measures when using heavy equipment close to the Coastal Erosion Hazard Area, PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 40,695 sq.ft. parcel located.in an R- 40 Zoning District. The parcel has an 165.00 feet road frontage along Grandview Avenue,then turns north for 281.04 feet to Long Island Sound,where it turns east for 130.00 feet of Sound frontage before returning 290.13 feet south back to Grandview Avenue. The property is improved with a 2-story frame dwelling. BASIS OF APPLICATION: Request for a Variance from Article XXII, Section.280-116A(1); and.the Building Inspector's April 5, 2021,Amended June 18,2021 Notice of Disapproval based on an application for a permit to construct an accessory in-'ground swimming pool; at 1) swimming pool is located less than the code required 100 feet from the top of the bluff; located at: 1470 Grandview Drive, (Adj.to Long Island Sound) Orient,NY. SCTM No. 1000-14-2-3.15. RELIEF REQUESTED: The applicant requests a variance to construct an accessory in-ground swimming pool surrounded by over 3,000 sq. ft of pervious patio on grade, in the rear yard at 64. 3 feet from the top of the bluff, where a minimum of 100 feet is required. ADDITIONAL INFORMATION: As per testimony from the applicant's agent, one of the reasons for the proposed location of the pool is that there is an existing septic system in the rear yard. There is currently work being undertaken at the residence which includes the construction of a bulkhead. The applicant's agent documented prior variance relief from the Board of Appeals for pools with non-conforming bluff setbacks on Grandview Drive including-File# '24 10,#3538, and#6299. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 5,2021 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b M. Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed location of this pool is in keeping with the neighborhood where there are other pools in rear yard locations with non-conforming bluff setbacks, and the proposed pool will be fully screened on both side yards by mature vegetation for privacy from adjacent properties. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. Any proposed structure seaward of the existing house would require variance relief as being within the 100-foot required setback. 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 36%relief from the code. However, an alternative location closer to the house to increase the bluff setback and the installation of a non-turf buffer will mitigate any potential adverse impacts to the bluff,while still allowing the owners to install an accessory swimming pool. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The bluff is well vegetated with no signs of erosion. The applicant must comply with Chapter 236 of the Town's Storm Water Page 3,August 19,2021 #7525,Zoitas SCTM No. 1000-14-2-3.15 Management Code and the conditions imposed herein, including the installation of a non-turf buffer and approvals from the Southold Town Board of Trustees. 5. Town Law X267-b(30)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Lehnert,seconded by Member Planamento,and duly carried, to DENY as applied for and GRANT ALTERNATIVE RELIEF as follows: Increase distance of the proposed pool from top of bluff from the 64.3 ft. proposed to 80 feet from the top of the bluff. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Installation of a 30-foot-wide non-turf buffer planted with drought tolerant native species along the top of the bluff line as recommended in the LWRP report. 2. The applicant shall submit a signed and stamped site plan depicting the 30-foot wide non turf buffer planted with drought tolerant native species landward from the top of the bluff and the in-ground swimming pool located 80 feet from the top of the bluff. 3. Pool mechanicals shall be placed in a sound deadening enclosure. 4. Drywell for pool de-watering shall be installed. 5. The pool shall remain open to the sky above. Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of dated, stamped and signed final surveys or site plans conforming to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. A site visit was conducted on June 14th, 2021, in response to your request to review and evaluate a proposal for the parcel located at 1470 Grandview Drive, Orient,NY. The proposal has been previously disapproved for the following reasons: The proposed swimming pool, on this conforming 40,695 sqft parcel in the Residential R-40, are not permitted pursuant to Article XXII Section 280-116A(1), which states: "All buildings or structures located on lots upon which there exists a bluff landward of the shore or beach shall be set back not fewer than 100 feet from the top of such bluff." The site plant shows the swimming pool at 63.5 feet from top of bluff. Office Hours:Monday through Thursday 7:30 a.m.to 4:00 p.m. Friday 7:30 a.m.through 3:00 p.m. Observations and Current Conditions: The dwelling is situated at the highest point of the property,with a subtle decline in elevation towards the bluff, and a drastic downward slope towards the front of the property and street. With exception to the walkway, asphalt driveway, and existing brick patio, the ground is covered with turf-grass with flower beds around the dwelling and along the side property lines. No water discharge lines or pipes were seen on or near the bluff. There also does not appear to be any irrigation lines present in the lawn, there may be some irrigation lines within the flower beds surrounding the dwelling. All gutters and downspouts on the house are discharged at the surface. Most of them are located in the flower beds, but none of the downspouts present are currently being discharged underground into drywells. Two manhole covers for the septic system were discovered on the southeast side of the proposed pool site. This system will be replaced by a new, traditional septic system that will be relocated to the northwest side of the dwelling. There appears to be minimal to no runoff issues from the dwelling towards the bluff. There is some evidence of runoff from the dwelling towards the street due to the steep elevation grade. The bluff itself is well-vegetated with what appears to be a diverse selection of forbs, grasses, and shrubs, and appears to be in relatively stable condition from what could be observed. The staircase is also in good condition,with the ground underneath mostly covered in vegetation. While there are some minor signs of runoff down the face of the bluff, there does not appear to be any major evidence of bare soils or soil loss. Most of the plants and shrubs on the bluff are well-established and there are minimal dead branches or plants that need to be trimmed. Mile-a-minute and mugwort was observed on the southeast side of the property, however,those plants were not observed near or on the bluff at the time of this site visit. There are minimal native plants along the top of the bluff—there is turf grass and some small plants, no flower beds. There are also grasses along the top of the bluff just before the drop off, and there are some small areas with runoff concerns. On the bluff face there appears to be at least one retaining wall present. The toe of the bluff is well-vegetated, and the beach itself is partially vegetated. "� :#�,e¢+-».9�,d'• .�`� �a�".�`` r, a�+�� R - �,` y k,�u AH •h R 7 Comments: The presence of mile-a-minute and mugwort on the property (closer to the dwelling on the southeast side) can be a concern to the bluff if it becomes established on the bluff in the future. Both of these invasive plant species are highly invasive because they are fast growing, fast spreading, and can outcompete and smother, native plants. If not properly treated,they could pose resource concern issues by encroaching and overtaking healthy vegetation on the bluff. The proposed structures are within 100 feet from the top of the bluff and could potentially result in negatively impacting the stabilization of the bluff long-term. The New York State Standards and Specifications for Erosion and Sediment Control (or Blue Book)provide erosion and sediment control standards and procedures and how to implement practices appropriately. Proper measures should be followed into order to minimize stormwater runoff and soil/sedimentation from leaving the construction area, and other impacts of construction—such as the utilization of heavy-use equipment close to the Coastal Erosion Hazard Area. As previously mentioned, the proximity of the proposed pool and patio to the bluff could be a possible concern in maintaining the integrity of the bluff. Although the bluff currently appears to be in good condition,these structures could negatively affect the bluff a number of ways. Two to mention involve surface and subsurface water flow issues which could lead to bluff degradation. Surface stormwater runoff may increase due to a decrease of permeable surfaces and could flow towards and down the bluff. Lateral seepage is a process that can also occur, which is a term used to describe groundwater running laterally—or horizontally—as opposed to vertically. This can often occur as a result of significant water discharge from structures like pools, drywells, etc. within 50 feet of the bluff. Both issues can cause major natural resource concerns for the bluff, such as vegetation wash outs, exposure of soils, gully and rill erosion, and vertical slough and undercutting of the bluff etc.; all of which drastically speed up the natural recession of the bluff and can become hazardous and unstable. In additional, any discharging of pool water on or near the bluff should be discouraged and can also be detrimental to the bluff.
