SUFFOLK COUNTY ADMINISTRATIVE CODE: This 'application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 25,2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list-and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property, SCTM# 1000-41-1-34, is a 6,000 sq. ft. residential parcel located in an R-40 Zoning District. The parcel is a corner lot with 50 feet of road frontage on Washington Avenue,then turns north for 120 ft,the rear yard turns east for 50 ft,then south along Booth Place for 120.00 feet. The property is improved with a two-story frame dwelling, and an accessory garage. SCTM# 1000-41-1-33 is a 6,000 sq.ft.parcel located in an R-40 Zoning District and also has a road frontage of 50 feet on Washington Avenue, then turns north for 120.00 feet, the rear yard turns east for 50 feet, then returns to Washington Avenue for 120 feet. The property is improved with an accessory shed. The property is landscaped with a chain link fence that encloses both lot 33 and lot 34, as shown on survey prepared by Kenneth M. Woychuck,L.S., dated January 15,2020. BASIS OF APPLICATION: Request for a Waiver of Merger petition under Article II, Section 280- 1-OA, to unmerge land identified as SCTM No. 1000-41-1-33 which has merged with SCTM No. 1000-41-1-34, based on the Building Inspector's February 8, 2021 Notice of Disapproval, which states that a non-conforming lot shall merge with an adjacent conforming or non-conforming lot held in common ownership with the first lot at any time after July 1, 1983 and that non-conforming lots shall merge until the total lot size conforms to the current bulk schedule requirements (minimum 40,000 sq. ft. in the R-40 Residential Zoning District); located, at 810 Washington Avenue, Greenport,NY. Page 2,August 19,2021 #7523,McGee—Waiver of Merger SCTM No. 1000-41-1-33 &34 RELIEF REQUESTED: Request for a Lot Waiver under Section 280-11 to unmerge a vacant land area of 6,000 square feet (SCTM 1000-41-1-33) from an adjacent land area of 6,000 square feet (CTM 1000-41-1- 34), based on the Building Inspector's Notice of Disapproval pursuant to Section 280-10A, determining the properties have beenmerged. located, at 810 Washington Avenue, Greenport, NY. SCTM Nos.1000- 41-1-33 and 1000-41-1-34. "A non-conforming lot shall merge with an adjacent conforming or non-conforming lot held in common ownership with the first lot at any time after July 1, 1983. An adjacent lot is one which abuts with the parcel for a common course of fifty(50)feet or more in distance. Non-conforming lots shall merge until the total lot size conforms to the current bulk schedule requirements minimum 40,000 sq.ft.in the R-40 Residential Zoning District. ADDITIONAL INFORMATION: The properties in question were purchased by Irene & David Garner. Lot 34, which includes the two-story residence with accessory garage was purchased in 1948, and the adjacent property, Lot 33 was purchased in 1954. Both properties have been held by Irene & David Garner. Irene Garner retains a life estate to the property, with title transferred to her children David Garner & Jean McGee. Lot 33 has been maintained as part of the residence since it's purchase, with a well-maintained lawn & landscaping, an accessory shed, and fencing surrounding both properties. On May 1, 2021, a Pre-Existing Certificate of Occupancy# 42018 was issued for the wood frame dwelling with rear porch and accessory wood frame garage. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The standard for the granting of a waiver of merger are contained in Section 280-11 of the Town Code. Sections 280-11(A)and(B)require that the Board engage in a two prong test before granting a waiver of merger. Pursuant to Section 280-11(A)the Board must determine whether the lot proposed to be recognized has been transferred to an unrelated person or entity since the time the merger was affected. If the lot has been transferred to an unrelated person,the lot is not eligible for a waiver of merger. Pursuant to Section 280-11 (B), if the lot has not been transferred to an unrelated person,the Board must engage in a balancing test of 3 factors to determine whether the lot is eligible for a waiver of merger, namely,whether(1)the proposed waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood, (2)the lot proposed to be recognized is vacant and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation, and (3)the proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or district. The Zoning Board of Appeals held a public hearing on this application on August 5, 2021, at which time written and oral evidence were presented. Pursuant to § 280-11(A)the Applicant has submitted documentation,to the satisfaction of the Board that there have been no transfers of ownership of the lot outside the family since the time merger was affected. Consequently, the lot is eligible for a waiver of merger. Pursuant to §280-11(B),the Zoning Board finds that (1) The waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood because: Page 3,August 19,2021 #7523,McGee—Waiver of Merger SCTM No. 1000-41-1-33 &34 Due to the fact that the lots in question are located across the street from the Village of Greenport line,we can only consider the adjacent properties in the Town of Southold. The properties in this neighborhood in the Town of Southold are similar in size and shape to other lots in the neighborhood, which would make this lot comparable in size and shape to other improved lots in the Southold neighborhood. (2) The waiver would recognize a lot that is vacant and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation because: The vacant lot has not been treated and maintained as a separate lot. On the contrary it has been treated as part of lot 34. The parcel has been maintained with a manicured lawn and plantings. There is an accessory shed on the property, and there is a fence that surrounds both properties and treats them as one. (3) The proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or district because: A waiver will recognize that the lot is comparable in size to the majority of lots in the"Washington Heights" subdivision. RESOLUTION OF THE BOARD: In considering and balancing the above factors and pursuant to the Waiver Provisions of the Town of Southold Merger Law, Section 280-11, motion was offered by Member Lehnert, seconded by Member Planamento, and duly carried to GRANT the waiver of merger as applied for as shown on the survey prepared by. Kenneth"M. Woychuk, dated-January 15,2020, SUBJECT TO THE FOLLOWING CONDITIONS: 1. Proof that waiver of merger is affected by way of two separate deeds, one for each of the subject lots,recorded by the Clerk of Suffolk County, from the applicant to a separate individual or entity conveying title to that portion of the property known as 1000-41-1-33 be provided to the ZBA within 2 years of the date of this decision. Failure to comply with this condition will result in nullification of the waiver of lot merger granted herein. 2. In the event that an approval is granted subject to conditions,the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. APPLICANT'S REASONS: ����"�� (1) The waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood: Washington Avenue is the municipal line between the Village of Greenport and Town of Southold. This property (north side of Washington Avenue) is Southold Town and Southold Town Zoning and across the street(south side of Washington Avenue) is in the Village of Greenport and Village of Greenport Zoning. In the Village of Greenport there is specific language in their zoning code that prohibits lots from merging.1 The lots on the north side of Washington avenue are a mix of combined parcels and homes on single filed lot parcels. On the south side of Washington Avenue, the Village has acquired some of the lots (utility company) and many of the lots are on single filed lot parcels. On the South side of Washington Avenue 4 lots appear to have"lot line changes"with their neighbor, and 5 lots follow the original filed map lines. On the north side of Washington Avenue(in Southold) this is the only vacant parcel. All the other parcels are improved,5 lots are 1 In the Village of Greenport lots may not be merged. IL The parents purchased the vacant lot for their future. They have continued to hold these l„ two properties for 67 years without any knowledge that the lots were merged:: Garner has a life estate in the house and the children are the owners of both properties. The family did not intend to merge the properties. They continue to receive separate tax bills. Learning of the merger has been very distressing to Irene Garner. (2)The waiver would recognize a lot that is vacant and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation because: the neighborhood has proud property owners; the Garner family maintained the property in a manicured state since the properties were purchased. The lot has been cleared and maintained as a manicured yard for the entire period of ownership. The subdivision was a farm before it was subdivided in 1927, the shed on the lot was a chicken coop on the farm, consequently the parcels were cleared lots since they were created. The Garner family installed a chain link fence in the 1950's around both properties to protect the children and their dog from roaming off the property. Irene Garner was born in Greenport Hospital, Mattituck High School class of 1942, and lived her entire life with her husband and children on this property. She ran "Irene's Beauty Shop" in the house until her retirement. Irene (mom) is living with her daughter and the house is rented to Steve Berbig & his wife with their three children. His wife is a bus driver in Southold and Steve works for the Greenport Highway Department. As a separate home, this house provides affordable housing to a local family. In order to keep the house affordable and provide for Irene's long term care, and future inheritance of her two children, having the flexibility to sell the lot separately from the house enables a local family to purchase the house or the lot. As a combined parcel,these homes are being demolished and new high-end homes are being built. The area is changing,making properties unavailable to the local community,the major cause being the zoning in the Town of Southold. When lots merge the homes are larger and built for more affluent families. Greenport Village is facing development pressures and they have purposely maintained the character of the Village by preventing the merging of parcels. A waiver of merger would be consistent with the expressed desires of the Village of Greenport Trustees.2 (3) The proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or district because: the waiver of merger application is to keep the neighborhood from changing.There are no adverse environmental constraints in this neighborhood. The house is connected to the Village of Greenport utilities, including public water and public sewers. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The standard for the granting of a waiver of merger are contained in Section 280-11 on the Town Code. Sections 280-11(A)and(B)require that the Board engage in a two-prong test before granting a waiver of merger. Pursuant to Section 280-11(A)the Board must determine whether the lot proposed to be recognized has been transferred to an unrelated person or entity since the time the merger was effected. If the lot has been transferred to an unrelated person, the lot is not eligible for a waiver of merger. The Board finds, based on the documentation and testimony in the record, that the Applicant that has satisfied the requirement of § 280-11(A) in that the subject lots were merged consequent to the death of Stuart D. Staples, and that there have been no transfers of ownership outside the family since the time merger was effected. The Board also finds that a balancing of the factors contained in §280-11 (B) supports the granting of a waiver of merger in that: (1)As shown on the"Map of Washington Heights"filed December 29, 1927 as File No. 651,the subject lot(#5) is similar in size and shape to other lots in the subdivision and therefore the granting of a waiver of merger would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood. (3) The waiver will recognize the lot which is comparable in size to the majority of lots in the "Washington Heights" subdivision. Moreover, the lot has been developed without issue or complaint for nearly three-quarters of a Century. Therefore,the proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or district. Additionally, no convincing arguments were made by the applicant's attorney as to whether or not the lots were voluntarily or involuntarily merged.,As a result,the Board cannot approve a waiver of merger based upon an exemption. Pursuant to §280-11 A of the Southold Town Code,to qualify for a waiver of merger an applicant must provide documentation that"the lot proposed to be recognized has not been transferred to an unrelated person since the time the merger was effected." The applicant submitted a recorded deed indicating that both lots were transferred from William Tillinghast (prior owner) to ownership outside of the family (William M. Gremler and Michael F. Murphy) on August 24, 2016. Therefore, the applicants cannot seek relief to unmerge the subject lots under §280-11 Waiver of Merger.
