SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 2.3,and the Suffolk County Department of Planning issued its reply dated May 25,2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP`DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list',and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a56,710 sq. ft. (1.3 acres) non-conforming parcel located in an Agricultural Conservation (A-C) Zoning District. The parcel has a 214.00 feet frontage along Depot Lane, then turning west for 265.00 feet, then Funning 214.00 feet north before returning 265.00 feet back to Depot Lane. The property is improved with a one-and-one half story frame dwelling with an attached enclosed porch and a concrete porch,and an accessory frame barn in the rear yard as shown on a survey prepared by Nathan Taft Corwin, III,L.S. last revised April 28, 2021. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; and the Building Inspector's April 1, 2021 Notice of Disapproval based on an application for a permit to construct an accessory structure; at 1) located less than the code required minimum rear yard setback of 15 feet; 2) located less than the code required minimum side yard setback of 15 feet;`located at: 3375 Depot Lane, Cutchogue,NY. SCTM No. 1000-102-1-6.1. RELIEF REQUESTED: The applicant requests a variance to place an accessory garage(car port)with rear and side yard setbacks of 5 feet where a 15 feet minimum setback is required. ADDITIONAL INFORMATION: As per testimony from the applicant at the hearing the proposed garage will be ,used to store classic cars, and will have no plumbing. The applicant also testified that the reduced, non-conforming setbacks were to allow for the maneuvering of a large trailer. The Board discussed a variety of other locations and- options on the subject property for the applicants to consider,that would not require variance relief. Page 2,August 19,2021 47519, Stocker SCTM No. 1000-102-1-6.1 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 5,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and-surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Although the subject property is surrounded by vineyards on the side and rear yards, and the accessory garage is proposed in a code conforming rear yard, the property is large and there is more than enough space for the placement of the proposed garage in a conforming location with conforming rear and side yard setbacks,thereby maintaining the character of the neighborhood as defined in the Southold Town Code. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicants explained the reason for the placement of the structure close along the property line is to clear a turning radius for large vehicles. It has been determined that the subject property has adequate square footage in the rear yard and that the space between the existing accessory structure and proposed accessory structure placed in a conforming location will adequately allow a turning radius for large vehicles. 3. Town Law 4267-b(3)(b)(3). The variances requested herein for the side and rear yard setbacks are mathematically substantial,each representing 66%relief from the code. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will-have an:adverse,impact on the physical or environmental conditions in the neighborhood.However, the Board of Appeals grants variance relief only when conforming to the code'is not feasible or practicable for the applicant to pursue. 5. Town Law-4267-b(3)(b)(5). The difficulty has�been self-created. The applicant purchased the parcel after-the Zoning Code was in'effect and it is presumed that the applicant had actual or constructive'knowledge of-the limitations on the use of the parcel under the Zoning Code in,effect prior to.or at the time;of purchase. 6. Town Law 42.67-b. Grant of the requested relief IS NOT the minimum actiori,necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage while preserving and-protecting the character of the neighborhood and the health, safety and welfare of the community.
