The property is improved with a one and a half story single family residence with covered porch, wood deck,inground swimming pool,a pergola, small shed,chain-link fencing and a frame garage with second floor wood deck and access stairs;as shown on the survey prepared by Paul Barylski,LLS,and dated April 5, 2021. BASIS OF APPLICATION: Request for a Use Variance from Article III, Section 280-13(C) and the Building Inspector's January 21, 2021,Notice of Disapproval based on an application for a permit to construct alterations to an existing accessory garage to convert to an office; at 1) proposed conversion does not constitute a permitted accessory use; located at: 275 Maple Lane,Mattituck,NY. RELIEF REQUESTED: The applicant requests a use variance to covert the second-floor unfinished storage area over an existing accessory garage to an `as built' finished and conditioned home office of approximately 480 square feet with a half bath consisting of a toilet and sink. ADDITIONAL INFORMATION: The subject parcel is the beneficiary of Zoning Board of Appeals decision 42447 dated August 4, 1978 allowing the creation of the subject parcel with an existing, dilapidated bungalow on it. Condition#2 of this decision states:"The bungalow,if rehabilitated,shall be used for seasonal use only,not for year- round occupancy. The applicant was issued building permit#44897 for alterations to a single family residence. A Building Department of the Town of Southold STOP WORK ORDER was issued January 24, 2021,when it was discovered that the second floor over the garage was finished. During the public hearing,the applicant did not provide a record of any building permit for conversion of the storage space over the garage to conditioned space nor for the addition of a full bathroom, including a shower as stated by the applicant at the public hearing,or addition of wood-burning stove,nor did they provide evidence illustrating that the bathroom conforms to requirements of the Suffolk County Board of Health. No member of the public or immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on-this-application-on August 5,-2021, at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding•neighborhood;and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings; . 1. Town Law 4267-b(2)(b)(1). The applicant can realize a reasonable return for each and every permitted use under the zoning regulations for the particular district where the property is located.Moreover,the applicant and their agent did not submit any financial evidence to'support their hardship necessitating the need for a home office in an accessory structure in the R-40 Zoning District.The applicant is able to apply to the Town of Southold Building Department for a permit to add, by Code, a half bath to the accessory structure and/ or a permit for a home office located in the existing residential structure. 2. Town Law§267-b(2)(b)(2). The hardship is not unique to the property and it does not apply to a substantial portion of the district or neighborhood. Offices in accessory structures are not common to this single-family residential neighborhood, or throughout the Town of Southold. 3. Town Law 4267-b(2)(b)(3). The requested use variance, if granted, will alter the essential character of the neighborhood. Maple Avenue is a quiet and narrow residential street servicing several homes, many of which have accessory structures, and is located off of Grand Avenue, a major thoroughfare servicing multiple residential neighborhoods on the eastside of the Mattituck Inlet. While the accessory garage with second floor storage area has stood in its present location since prior to 1987, there is no evidence to support the conversion to a home office. Furthermore, other accessory structures in this community have not been converted to home offices or other non- code compliant structures. 4. Town Law 4267-b(2)(b)(4). The alleged hardship has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. i} Page 3,August 19,2021 #7518 Santos-Montoya SCTM No. 1000-107-2-10.1 5. Grant of this use variance is not the minimum action necessary and adequate to address the unnecessary hardship not proven by the applicant, and at the same time preserve and protect the character of the neighborhood and the health, safety and welfare of the community. I received a Stop Work Order in the mail today(for 275 Maple Lane, Mattituck NY 11952). Let me start off by saying that Phillipe Jacquet did hand me the Inspection Notice on December 16 regarding the Accessory Structure(Barn). However, Phillipe is not working on the Barn. He is working on a new Kitchen and Bathroom in the main building/house.That work is duly permitted as you know. We have not done any major work on the Barn structure since we purchased this home 6 years ago(other than painting, replacing the old/broken bathroom fixtures etc).We were made aware when we purchased this home that a LOT of things were not up to code or properly permitted. However,we fell in love with the home and decided to purchase it anyway and deal with the permitting/code issues one by one as we renovate(over the years). Like we are doing now with the Kitchen/Bathroom. It's all properly permitted and up to code. On Phillipes advice, we filed for a building permit early this year stating in the filing that it was an existing structure. The idea according to Phillipe was that the Building Dept would reject the filing and pass it on to the Zoning Board (I'm not sure if that is automatic or if I have to request that step). Shortly after I filed for the Building Permit, one of your colleagues called me and I explained the situation and she promptly informed me that she would reject that request. I have not received any official notice of rejection or any info on the next steps to take... Going back to your Stop Work Order, I'm not sure how to proceed as there is not work being done in the Barn, my wife and I are using that space as our day-office(due to Covid we're both working from home). The work on the Kitchen/Bathroom in the house is nearing completion, so I assume you'll be back for a final inspection? Maybe we can schedule so I can be here and we can show you the barn, what's there and how we use it. Also, it's not an apartment...it's a rustic space, no built in heating (except for a log burning stove), no kitchen,just a large space with a bathroom. Mazo Montoya PROPERTY LOCATION: 275 Maple Lane,Mattituck,NY SCTM: 1000-107-2-10.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, 25,309 square feet, .58 acre, rectangular-shaped, non- conforming parcel located in the R-40 Zoning District measures 75 feet along Maple Avenue,then runs north 284.58 feet along a residentially developed property to the west(note—subject parcel was originally part of this lot), then runs east 99.48 feet along a residentially developed property to the north, then runs 312.17 feet south along a third neighbor. The property is improved with a one and a half story single family residence with covered porch, wood deck, inground swimming pool,a pergola, small shed,chain-link fencing and a frame garage with second floor wood deck and access stairs, as shown on the survey prepared by Paul Barylski,LLS, and dated April 5, 2021. BASIS OF APPLICATION: Request for a Use Variance from Article III, Section 280-13(C) and the Building Inspector's January 21, 2021,Notice of Disapproval based on an application for a permit to construct alterations to an existing accessory garage to convert to an office; at 1) proposed conversion does not constitute a permitted accessory use; located at: 275 Maple Lane,Mattituck,NY. SCTM No. 1000-107-2-10.1. RELIEF REQUESTED: The applicant requests a use variance to covert the second-floor unfinished storage area over an existing accessory garage to an `as built' finished and conditioned home office of approximately 480 square feet with a half bath consisting of a toilet and sink. ADDITIONAL INFORMATION: The subject parcel is the beneficiary of Zoning Board of Appeals decision#2447 dated August 4, 1978 allowing the creation of the subject parcel with an existing, dilapidated bungalow on it. Condition#2 of this decision states:"The bungalow,if rehabilitated,shall be used for seasonal use only,not for year- round occupancy. The seasonal use is defined as the period from March 15`to December I`." Page 2,August 19,2021 #7518 Santos-Montoya SCTM No. 1000-107-2-10.1 Improvements to the site are covered under the following Certificates of Occupancy: #Z-14128 December 30, 1985: The conversion from summer cottage to year-round dwelling. #Z-15672 April 21, 1987: Alterations&repair to an accessory structure. #Z-15671 April 21, 1987: Installation of an inground pool and fencing. #Z-24081 December 14, 1995:Pre-Existing Certificate of Occupancy for a one-family residence and accessory garage. #Z-29763 October 9, 2003: Alterations and additions to a single-family residence. The applicant was issued building permit#44897 for alterations to a single family residence. A Building Department of the Town of Southold STOP WORK ORDER was issued January 24, 2021, when it was discovered that the second floor over the garage was finished. During the public hearing,the applicant did not provide a record of any building permit for conversion of the storage space over the garage to conditioned space nor for the addition of a full bathroom, including a shower as stated by the applicant at the public hearing,or addition of wood-burning stove,nor did they provide evidence illustrating that the bathroom conforms to requirements of the Suffolk County Board of Health. No member of the public or immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 5, 2021, at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(2)(b)(1). The applicant can realize a reasonable return for each and every permitted use under the zoning regulations for the particular district where the property is located.Moreover,the applicant and their agent did not submit any financial evidence to support their hardship necessitating the need for a home office in an accessory structure in the R-40 Zoning District.The applicant is able to apply to the Town of Southold Building Department for a permit to add, by Code, a half bath to the accessory structure and/ or a permit for a home office located in the existing residential structure. 2. Town Law X267-b(2)(b)(2). The hardship is not unique to the property and it does not apply to a substantial portion of the district or neighborhood. Offices in accessory structures are not common to this single-family residential neighborhood, or throughout the Town of Southold. 3. Town Law 4267-b(2)(b)(3). The requested use variance, if granted, will alter the essential character of the neighborhood. Maple Avenue is a quiet and narrow residential street servicing several homes, many of which have accessory structures, and is located off of Grand Avenue, a major thoroughfare servicing multiple residential neighborhoods on the eastside of the Mattituck Inlet. While the accessory garage with second floor storage area has stood in its present location since prior to 1987, there is no evidence to support the conversion to a home office. Furthermore, other accessory structures in this community have not been converted to home offices or other non- code compliant structures. 4. Town Law 4267-b(2)(b)(4). The alleged hardship has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of this use variance is not the minimum action necessary and adequate to address the unnecessary hardship not proven by the applicant, and at the same time preserve and protect the character of the neighborhood and the health, safety and welfare of the community.
