COUNCILWOMAN DOHERTY: Please rise for the Pledge of Allegiance. Thank you. So
thanks for coming tonight, this is an exciting night for two of our officers. I will turn it over to
the Chief now.
CHIEF FLATLEY: Thanks for coming tonight. With the pandemic, this is the first gathering
we have had like this, it's hard to pull off promotions like this but I think it's very important that
we all join here to recognize the efforts and the careers of the two gentlemen that are being
promoted tonight. I think it's also important for the public to see that we are promoting two
worthy candidates tonight and I would ask that if we can start off with the resolution for
Christopher Salmon?

CHIEF FLATLEY: If I could have Chris Salmon come up. Chris is an 11 year veteran on our
job and tonight it makes me very happy to promote you to Sergeant. Thank you. Now, if we

CHIEF FLATLEY: Just quickly before we bug out of your meeting, I just want to thank all the
members of the Town Board for supporting these promotions, they are well deserved and it Qoes
a long way for supporting our department, so I appreciate it and I thank you.

this is a small little thing, you deserve more than that but this is the way we do it and it's really

Resolution Number 2021-077 of the Fishers Island Ferry District adopted May 24, 2021 which
reads as follows:
WHEREAS the Ferry District requires additional full-time Deckhands (FIFD) during the peak season
between May 15, 2021 and September 15, 2021; and
Therefore it is RESOLVED to temporarily appoint with effect May 19, 2021 Kevin Hurley as summer
seasonal Deckhand (FIFD) at a rate of$14.00 per hour; and
It is further RESOLVED that on September 15, 2021 Kevin Hurley will terminate his summer seasonal
position and on September 16, 2021 be re-appointed to part-time Deckhand (FIFD).

Resolution Number 2021-078 of the Fishers Island Ferry District adopted May 24, 2021 which

WHEREAS the Fishers Island Ferry District policy as described in the Employee Handbook and the CSEA
Collective Bargaining Agreement grants a 1% longevity increase to wages when an individual has been
employed by the Fishers Island Ferry District for twenty (20) years; and,

Statement regarding resolution #524
COUNCILWOMAN DOHERTY: Hold on a second, I feel that our priorities are misplaced here
and I feel that we should be working on the Building Department as they are severely
understaffed. I don't think it's the time right now to add more staff to the Zoning Board, so I vote
no.
COUNCILMAN GHOSIO: I agree with that, particularly with our conversations about re-
opening the Building Department. I think this is something we can come back to, re-evaluate;
but we need to staff the Building Department so we can get them fully open, so I say hold off on
this. I say no as well.
COUNCILWOMAN NAPPA: Can I move to table this resolution, since Scott, since we are
missing a voting member?
COUNCILMAN DINIZIO: I am not rescinding my motion. I made a motion, l think it was
seconded and I think we should vote on it.
COUNCILWOMAN DOHERTY: So the motion is lost because we don't have a majority.

A. Purpose. The Town Board of the Town of Southold finds that, with the increasing
development and population of the Town of Southold, transportation activities are
increasing and impacting the local streets. Regulation of pedestrian traffic on local streets is
necessary so as to provide for the safety and welfare of the Town's citizens and for the
orderly flow of vehicular and pedestrian traffic on busy local streets.

II. Chapter 280 of the Code of the Town of Southold is hereby amended to include the
underlined words and remove the struck through words as follows:
§ 280-4 Definitions.
LOT, CORNER
A lot situated at the junction of and abutting fronting on two or more intei!seefing streets

shall be deemed a "corner lot" if the tangents to the curve at the points of intersection of the
side lot lines with the street lines intersect at an interior angle of less than 135°.

§ 280-105 Height of fences,walls and berms.
Fences, walls or berms may be erected and maintained, subject to the following height
limitations:
A. When located in the front yard of residential zones, the same shall not exceed four feet in
height. When located in the front yard of nonresidential zones, the same shall not exceed
six feet in height.
B. When located in or along side and rear yards, the same shall not exceed 6 1/2 feet in height.
C. When located in or along a secondary front yard the same shall not exceed 6 1/2 feet in
height and shall be set back from the secondary front yard line no less than 10 feet.
DE. In residential and nonresidential zones, except properties/parcels engaged in bona fide
agricultural production, the installation of a deer exclusion fence may be permitted by
obtaining a building permit issued by the Building Inspector, subject to the following
criteria:
(1) When located in or along side and rear yards, the height of the deer exclusion
fence shall not exceed eight feet.
(2) When located in or along a secondary front yard the height of the deer fence shall
not exceed eight feet in height and shall be set back from the secondau front yard
line no less than 10 feet.
(2{3) Specifications for construction of deer exclusion fences:
(a) Fencing fabric: high-tensile, woven wire fence fabric with graduated
opening.
(b) Spacing between posts: 20 feet.
(4) Deer fencing is prohibited in or along the front yard or primary front yard of any
property.
§ 280-106 Corner lots.

the principal buildings of lots which are recognized by the Town under § 280-9, are
nonconforming and have not merged pursuant to § 280-10.

III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law

IV. EFFECTIVE DATE

Town Board of the Town of Southold, Suffolk County,New York, on the 4th day of May, 2021,
a need for amendments to the zoning code; and
NOTICE IS HEREBY FURTHER GIVEN, it has been presented a Local Law entitled "A
Local Law in relation to an Amendment to Chapter 280, Zoninjz" and
NOTICE IS HEREBY FURTHER GIVEN that the Town Board of the Town of Southold will
hold a public hearing on the aforesaid Local Law at Southold Town Hall, 53095 Main Road,
Southold,New York, on the 15111 day of June, 2021 at 7:01 p.m. at which time all interested
persons will be given an opportunity to be heard.
The proposed Local Law entitled, "A Local Law in relation to an Amendment to Chapter
280, ZoninIZ" reads as follows:
LOCAL LAW NO. 2021
A Local Law entitled, "A Local Law in relation to an Amendment to Chapter 280, ZoninLy".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The purpose of this local law is to address issues concerning corner lots.
II. Chapter 280 of the Code of the Town of Southold is hereby amended to include the
underlined words and remove the struck through words as follows:
§ 280-4 Definitions.
LOT, CORNER
A lot situated at the junction of and abutting fronting on two or more interseeting streets
the interior-angle of inter-seetien does not & ed '=5°. A lot abutting a curved street
shall be deemed a "corner lot" if the tangents to the curve at the points of intersection of the
side lot lines with the street lines intersect at an interior angle of less than 135°.
YARD, FRONT
An unoccupied ground area open to the sky between the-street line, or-between the ty-eet
line established by the Official Map of the Town or an appr-oved subdivision plat, and a line

YARD, PRIMARY FRONT
For principal structures located on corner lots, that portion of said corner lot which has
frontage upon one of the streets on which the lot is located and is identified as the primary
front yard on plans or by physical layout.
YARD, REAR
An unoccupied ground area fully open to the sky between the rear-lot line- and a line drawn
arallel then-o+ on the same lot with a building or structure, extending the full width of the
lot and situated between the rear line of the lot and the rear line of the main building or
structure projected to the side lines of the lot. The depth of the rear yard shall be measured
between the rear line of the lot and the rear line of the main building or structure. In the case
of corner and through lots, as defined in this chapter, the rear lot line shall be opposite the
primary front lot line.
YARD, SECONDARY FRONT
For principal structures located on corner lots, that portion of a corner lot which has
frontage upon one the streets on which the lot is located and which not identified as the
primary front yard, shall be deemed the secondary front
YARD, SIDE
An unoccupied ground area fully open to the sky between any propefly line other-than
street or-rear-lot line and a line drawn parallel thereto between the front and rear-yar on
the same lot with a building or structure, extending from the rear line of the front yard to the
front line of the rear yard and situated between the side line of the main building or
structure and the adjacent side line of the lot. In the case of corner lots, as defined in this
chapter, lot lines opposite a secondary front lot line shall be deemed a side yard and shall
have a minimum width equal to the minimum side yard requirements of the zoning district
in which located.

I do have a copy of the signed and notarized affidavit that this has been noticed on the Town
Clerk's bulletin board and town website. Also that this has been noticed in the Day and the
Suffolk Times. And that is it.
COUNCILWOMAN DOHERTY: Is there anyone that would like to comment on this public
hearing?
ROBERT DUNN: Good to see you all again. I think I get the gist here and when I first heard a
month ago and started reading it, I thought well that sounds fair, why should people be penalized
with a big setback on both sides? But then the wheels started turning overtime and I noticed the
hearing and I figured I would talk about it. I actually didn't know that I could be here today. If
you allow, this is going to allow somebody to choose one of their two frontages so to speak as a
sidewalk, correct?

COUNCILWOMAN DOHERTY: Yes.
MR. DUNN: So now that house can build further out because it's a sideyard and not front yard
that has a greater setback/
COUNCILWOMAN DOHERTY: What do you mean?
MR. DUNN: In other words, if you were building a house, you have got setbacks. Front yard
setbacks are more than side yard setbacks, so literally all the houses on the block will be
governed by front yard setbacks, like here, where the houses on either corner can be out here, if
they both pick the other side. Additionally, they could put a 6 1/2 foot fence where the other
people on the block can only put a 4 foot fence. So is that fair to the remainder of the block? In
other words, the second house is going with the setback 35 feet, correct?
COUNCILWOMAN DOHERTY: Right. And the first house would be on the other block
though.
MR. DUNN: No, no. Their front yard would be on, let's call it an Avenue or a Street. Their
front yard would be on the Avenue and their side yard would be on the Street. But the rest of the
houses on the Street, it's their front yard. So they are looking at the house. Plus, they can only
have a 4 foot fence, the rest of the block. But the people who have designated as their side yard
can have a 6 1/2 foot fence.
COUNCILWOMAN DOHERTY: Just like they can have a 6 1/2 foot fence on their side yard.
MR. DUNN: On their side yard, not their front yard. But now this side yard affects their front
yard. Because it's next to it. So you could have, I am going worse case scenario here and this is
the way laws should be written, not for the best case but for the worse case. Because the way it
is right now, everybody that owns property in Southold right now bought under the current
circumstances, so the only person who is going to get any improvement out of this is the person
who is going to buy a corner lot property and decides to put their house further out or the
developer who finds he can squeeze another house in on the street because he doesn't have
greater-set backs on the corner lot property. This is just going to, could create problems. You
are going to have people on the street, with both ends of the block the house could be (inaudible)
and have a six foot fence and the people on the street can't. That's not right for them. And now
you are changing the rules on them. This is not right. Inaudible. It's just wrong. You are taking
away something from the people who are existing under the rule on the rest of the street. You
are removing value from their property, you are creating an eyesore (inaudible). What I am
talking about is a place like Southold, where you have a street and an avenue so to speak and you
have 20 houses on the block, well, those two corner houses, can be out now, if they use those
yards as their side yards. So their views are diminished and they have got to look at a six foot
fence in their neighbors yard but they can't have one and they shouldn't have one because it's the
frontage. So, I don't see any value to this, other than for a few developers.
COUNCILWOMAN DOHERTY: Well, this is going to affect mainly houses that already exist.

We talked about all the different scenarios when we were working out this code. The reason we
are having this public hearing is to get people like you to give us these comments, but we didn't
go out to, they don't have the same side yard as other people have side yards on this side. We
didn't go to, I can't remember the, (inaudible).
MR. DUNN: Secondary front, secondary front.
COUNCILWOMAN DOHERTY: Front yard is not, the side yard aren't the same as regular side
yards.
MR. DUNN: Okay, that's what I need clarified.
COUNCILWOMAN DOHERTY: It goes further than a regular side yard.
MR. DUNN: All I know is it says right here, when located in or along the secondary front yard,
the same shall not exceed 6 1/2 feet in height and shall be set back from the secondary front line
from no less than 10 feet.
COUNCILWOMAN DOHERTY: Right, so we have a primary front yard (inaudible) and then
the secondary front yard would be 25 feet and the side yard is 10, so in that...
MR. DUNN: Inaudible.
COUNCILWOMAN DOHERTY: So you have two front yards, so the front yard on the street
they said okay, I want to make that my side yard, the setbacks are 25 feet where normally they
are 10. So they have to be setback 25 feet, not 10 feet like normal. So their other side yard
could be....
MR. DUNN: Where is that?
COUNCILWOMAN DOHERTY: That's under 280-106 corner lots, that's C 280-124 non-
conforming lots A, B, C.
TOWN ATTORNEY DUFFY: Mr. Dunn is referring to fences, which will still have a 10 foot
setback but the setback you are referring to is structures.
COUNCILWOMAN DOHERTY: Okay, so you are just strictly referring to fences?
MR. DUNN: I'm talking fence and structures.
COUNCILWOMAN DOHERTY: So the structures have a 25 foot setback on that secondary
front yard, that we would call a side yard now, not a 10 foot.
MR. DUNN: And on the front yard? The setback is?

COUNCILWOMAN DOHERTY: 35 feet.
MR. DUNN: Okay, so then, next to that side yard that only gets 25 feet, the person right next to
them going down the block, has to be 35 feet, as does everybody else on the block until you get
to the corner and they can jog out again.
COUNCILWOMAN DOHERTY: Right.
MR. DUNN: Okay, so what you are giving to the two corner lots, you are taking away from
everybody else between.
COUNCILMAN GHOSIO: The same scenario would occur on the other block, in the other
direction.
MR. DUNN: How's that?
COUNCILMAN GHOSIO: Well, if you rotated the house.......
MR. DUNN: No, we are not talking about rotating the house, we are talking about designating
one of the two current front yards we are designating one of them as side yard.
COUNCILWOMAN DOHERTY: Right.
COUNCILMAN GHOSIO: So they don't have two front yards.
MR. DUNN: Inaudible.
COUNCILMAN GHOSIO: Yes.
MR. DUNN: Okay, so we are changing that. We are down to....
COUNCILWOMAN DOHERTY: Like 10 feet.
MR. DUNN: Like 10 feet.
COUNCILMAN GHOSIO: Yes.
MR. DUNN: Okay and we are allowing a 6 1/2 foot fence where the guy next door can only
have a 4 1/2 foot fence and his has to be 35 feet.
COUNCILMAN DINIZIO: May I comment on that?
MR. DUNN: Yes.
COUNCILMAN DINIZIO: The yard that we are creating is a front yard, a secondary front yard,

so I am just assuming the height of the fence would be what is whatever is allowed in a front
yard whether it's secondary or primary.
MR. DUNN: When located in or along a secondary front yard, the same shall not exceed 6 1/2
feet.
COUNCILMAN DINIZIO: Okay, my mistake.
MR. DUNN: So that means, I own a corner property, my avenue has a 35 foot setback because
that's still the front, my side which is no longer the front yard is considered a secondary front
yard, only has to be 25 feet and it can have an 8 foot fence. Next to the guy next to me, behind
me technically,he has to have a 4 foot fence because it's his front yard. I don't see who benefits
out of that.
COUNCILMAN GHOSIO: The guy on the corner lot.
MR. DUNN: Only him. The rest of his block can go to hell.
COUNCILMAN GHOSIO: It all depends on how you look at it.
MR. DUNN: If you owned that house, you are happy. If you owned one of those houses, now
where you used to be able to look down the corner and see nothing, inaudible, I look at that
corner and possibly see a house. I mean this is, the structural element of it in terms of houses is
only where lots that haven't been developed. The fence can happen right away to anyone, they
can now build an 8 foot fence where now you are only allowed a 4 foot fence. That's fact and
that doesn't seem fair to the rest of the people on that block and up until now, we have done fine
with what we have.
COUNCILWOMAN DOHERTY: We had a lot of, the reason why we got here is we have had a
lot of applications for sheds and pools have had to go to the Zoning Board for this and this will
alleviate people from going to the Zoning Board for putting something in their back yard because
they would have a side yard....
MR. DUNN: To put something in their backyard but off to the side which would be the front...
COUNCILMAN GHOSIO: But you know most homes don't have that issue with the corner lot
(inaudible)you get to put a fence up right at your house line and if you fence in the backyard and
side yards and now you have a whole lot more space to work with, where you lose that on a
corner lot.
MR. DUNN: Understood.
COUNCILMAN GHOSIO: I think this is what this addresses.
MR. DUNN: Okay but it is addressing it at the expense of everybody else on the block because

now this guy can have a 6 foot fence.....
COUNCILMAN GHOSIO: Six foot fence for his backyard.
MR. DUNN: Side yard.
COUNCILWOMAN DOHERTY: And the secondary front yard...
MR. DUNN: The secondary front yard can have a six foot fence and everybody going down the
street from there has to be 10 foot further back and only have a 4 foot fence.
COUNCILMAN GHOSIO: For their front yard.
MR. DUNN: Because it is their front yard.
COUNCILMAN GHOSIO: That's right. They've only got one front yard.
MR. DUNN: Correct.
COUNCILMAN GHOSIO: Well, why can't we make it..
MR. DUNN: Because it's impacting their sight line, it's impacting all the people in the middle.
Their sight line.
COUNCILWOMAN DOHERTY: I don't see it as such a big impact.
MR. DUNN: You don't see it as an impact when one fence can only be 4 foot and right next to it
maybe 6 foot.
COUNCILWOMAN DOHERTY: Yeah, if I had my yard, I'm looking at this way and this fence
is a little higher, I don't think that's going to impact me....
COUNCILMAN GHOSIO: The front yard is at the front at your house, right now the 6 foot
fence is going to the sides and to the back.
MR. DUNN: Yeah but the guy next to you can't because he's only got a front yard.
COUNCILWOMAN NAPPA: Can I comment? I think one of the things that we had sort of
talked about was in this secondary front yard, that would be a place to locate certain accessory
structures or things.......
MR. DUNN: Inaudible.
COUNCILWOMAN NAPPA: So in that case, you know, I think that you know, the higher fence
is appropriate, you know, to sort of block that view from the street of where those items are

going in the corner persons yard.
MR. DUNN: But it also blocks that view from everybody else on that street that might look that
way or that way.
COUNCILWOMAN NAPPA: But the people on the corner lot might not want their neighbors
looking in on their swimming pool or that accessory building on the side...
MR. DUNN: Then they shouldn't buy a corner lot. I mean, you are talking about on each street,
you are talking about 2 blocks as opposed to 20 or 10 or 15 that might be between them.
COUNCILWOMAN NAPPA: Well, I think that's part of the reason that we addressed it this
way because this is where these accessory structures go, the accessory parts of the corner lot and
so therefore, having a higher fence gives it the privacy of the, where those things would not
always be possible on a corner lot.
MR. DUNN: Currently, correct.
COUNCILWOMAN DOHERTY: So here is the corner lot, here is the 6 foot fence, they put a 6
foot fence in the back....
MR. DUNN: Yep...
COUNCILWOMAN DOHERTY: And even if they don't put a fence here, they....
MR. DUNN: Inaudible.
COUNCILWOMAN DOHERTY: Right.
COUNCILMAN GHOSIO: Inaudible. Because you have got the 6 foot lining up with the next
door neighbor on this road because of the way it lines up, you are saying that because this guys
front yard fence is 4 foot, it lines up with the other guys side yard fence...
MR. DUNN: No, this guys fence is going to be back here because it's 35 feet.
COUNCILWOMAN DOHERTY: No the fence doesn't have to be at 35 feet, the fence can be
closer.
MR. DUNN: Okay, whatever this guys fence, now I am talking about this is a front yard, right
and this is the side front, okay, well this side front can be 6 foot and this front yard can only be 4
foot. That's where I see a problem.
COUNCILMAN GHOSIO: Inaudible.
MR. DUNN: It's not like that here.

MR. DUNN: So what I am saying you have a lot of houses currently that have a 4 foot fence that
could soon be living next to a 6 foot fence, along their frontage. It's the other guys side but it's
their frontage.
COUNCILWOMAN DOHERTY: But if they have a 6 foot fence in their back yard which goes
out, so here's the guy with a 4 foot fence, he is already blocked by the side fence, so what's the
difference if he has a 6 foot fence here, if he's already got the blocked, legal, that he can do now,
on his back yard.
MR. DUNN: Because his 6 foot fence can't go out to the front, can it?
COUNCILWOMAN DOHERTY: Yeah, his 6 foot fence can go out to...
MR. DUNN: Can go all the way out to the curb?
COUNCILWOMAN DOHERTY: The fence is not set back 35 and 25....
MR. DUNN: I understand that.
COUNCILWOMAN DOHERTY: So,the back fence can go out to whatever the thing is......
MR. DUNN: I don't want to, I know you.....
COUNCILWOMAN DOHERTY: We hear what you are saying and if it becomes a problem, we
can address it but I don't think any of us see it as a big issue.
MR. DUNN: Obviously. You wouldn't have proposed it if you did.
COUNCILWOMAN DOHERTY: If we are wrong, we will tell you we were wrong.
MR. DUNN: I just thought it was something that you might have missed.
COUNCILWOMAN DOHERTY: Okay, no we appreciate...
COUNCILMAN GHOSIO: There was already quite a few....

changed it from that one hearing and we are back.

MR. DUNN: I remember the discussion about it here and it wasn't until I read this and saw 6 1/2
foot fence and that whole side now can be 6 1/2 previously 4 1/2 and I understand the other
situation but if you buy under those circumstances (inaudible), now people who buy are going to
want to put up 6 foot fencing and I am telling you it's going to happen. You guys didn't spend
enough time in Port Washington.
COUNCILWOMAN DOHERTY: Yes, I did.
MR. DUNN: Once you get beyond Suffolk County line, everybody puts up fencing. I've seen
neighborhoods totally destroyed by them. I don't like them but you have the right to them. You
give them the right to go to 6 foot,they will go to 6 foot. If you give them 12 foot, they will go
to 12 foot. That's just the way it is.
COUNCILWOMAN DOHERTY: I was lucky, I had a golf course behind.
MR. DUNN: Okay, I've made my point. Thank you.

Robert Dunn
ROBERT DUNN: Robert Dunn, Peconic. As some of you will recall, I have been discussing for
several months now something that has been going on by my house, seven months. And I really,
I wasn't going to bring it up tonight because I was home and I found out you were going to be
open but Scott wasn't here and I thought I would discuss it with everyone present. Simply
because, I am going to let you touch on it but last week a woman brought up a problem with
code enforcement, she went on quite a while about it. I am not going to address her problem
because her issue is something I can't, I worked for one of the Harbes family, so it just wouldn't
be fair for me to discuss it one way or the other but I hear her frustration. And I don't think it's
fair that people have to wait that long, I am doing it myself and I have a lot of problems with our
code enforcement department. I've been ignored, I have been misled, I have been lied to by three
attorneys. Had a code enforcement officer come to my house and the first words out of his

mouth were, are you sure you want to do this? This is going to cause a lot of problems. I don't
really give a damn if it causes a lot of problems. It's a violation or it isn't. it isn't about a
problem or not a problem. In fact, I see that code officer has a bigger problem. Inaudible. And
then I find out that he was fired by East Hampton. He was fired for 10 items, including
unauthorized destruction or removal of town records in confidence and conduct which brings
disgrace to upon the town. And I am supposed to look at this guy and say he is credible? Come
on. Come on, I just can't buy that. And I have been offended, I have seen my wife crying in our
bedroom because this clown next door has got bells going constantly, nobody does anything
about it. I was told, he has got lights shining in my bedroom. I was promised by Mr. Burke,
who lied, that he was going to have someone come and see it, Lester, that was three months ago.
I am not accepting that. I am a taxpayer, I want to be served better. If I contact Mr. Duffy, I
don't expect to have people running blockage for him, he can't talk to me, he can't talk to me.
Well, I send him an email and he ignores me but yet within two hours because I sent Scott
Russell a copy of the email, I get a copy of an email to Mr. Hagan from Scott, it's an obstruction
on town property. We have every right to remove it without having to wait for a disposition.
Notice the person who put it there, give them a deadline date. If they don't comply,just remove
it. If I left a boat on Main Bayview Road, you wouldn't wait for the court to act. At least I don't
feel prejudiced against, they ignored Scott like they ignore me. Inaudible. Somebody took some
town property and put it inside a fence. Several neighbors complained about it. One of them
told me last night he was told by a town attorney that it's coming down on July 15. They gave
him a six month extension. and they gave him the six month extension to take it down, he had
only owned the property for four months. They gave him a six month extension to keep his non-
complying fence that was put on town property. I don't understand this?
COUNCILWOMAN DOHERTY: An extension or a stay?
MR. DUNN: I'm sorry? No, a fence.
COUNCILWOMAN DOHERTY: An extension or a stay? It's two different.....
MR. DUNN: An extension or a....
COUNCILMAN GHOSIO: They gave him a stay for six months.
TOWN ATTORNEY DUFFY: Because neither one, the defendant pled guilty and he was given
a conditional discharge requiring him to take down the fence within six months, if he doesn't take
it down in six months, he would come back to court and be resentenced.
COUNCILMAN GHOSIO: That was the condition that the judge put on him.
MR. DUNN: The judge put on him or we...
TOWN ATTORNEY DUFFY: It's a standard plea agreement that we do. The judge has to sign
off on it but it was our proposal.

COUNCILMAN GHOSIO: Okay, got it.
MR. DUNN: Okay, so now he has got town lawyers agreeing to a six month extension of an
encumbrance of town property that this is wrong but also creates a blind corner that now the
town is liable for because it's against it's own code, on it's own property. So how is protecting
who? Who is watching out for the tax payer? When you agree to take on a liability like that,
why would you do it? I don't understand it.
COUNCILMAN GHOSIO: Well, was there a question of whether it was on town property or
was that all resolved in the plea?
TOWN ATTORNEY DUFFY: Whether it was on town property or not is not a matter for the
justice court, that would be a civil court litigation. We believe the fence probably does encroach
on town property but you know, a lot of people put up obstructions on town right of ways. But I
respectfully disagree, Mr. Dunn, about any type of safety issue. If there was a safety issue, we
would have immediately taken further action. The fence is kind of, it's off the street and it's
elevated, it's kind of elevated off the ground, we don't see any problems with traffic or a blind
corner at all.
MR. DUNN: You don't see anything with a blind corner, it goes, it's a fence and a privacy
screen, a landscape privacy screen goes up to the corner on one side and comes up to a corner on
this side and right there is a beach entrance. If you don't see a problem there, you are blind. I
don't think...
TOWN ATTORNEY DUFFY: Inaudible.
MR. DUNN: Have you visited it?
TOWN ATTORNEY DUFFY: Yes, I have.
MR. DUNN: And you didn't see the blind corner?
TOWN ATTORNEY DUFFY: We believe that the shrubs he has installed, the screening, is set
back far enough from the road that it doesn't create a problem.
MR. DUNN: No, it is not. It is outside in the right of way.
TOWN ATTORNEY DUFFY: That's why I said I respectfully disagree with your opinion. I
don't think it causes a safety issue.
MR. DUNN: It is contrary to our code. Our code says all blockages above 2 1/2 feet on a corner
lot property has to be 30 feet back in an isosceles triangle. That's the way I read it. This is not
30 feet back on either side. If this is how Duffy wants to defend the screwup, he can't. But 1 am
telling you how it is. I just backed out of my property to come here and there was a little girl
walking there, I knew she was coming because I could see her through the hedges but you

couldn't (inaudible) to see her. And now that corner, that intersection, is going to be one of the
busiest intersections in town, the next two months. It's a beach entrance with a blind coiner.
And a blind legal department. I am not pulling any punches here, I am not impressed with this. I
had Hagan misled me, in January I talked to Hagan, I said what's going on there? He said they
agreed to, they are getting fined and agreed to take it down. That was it. I was like, okay, it's
going down. And then I find out four months later, they agreed to six months. What was he
hiding? Then he tells me in May, it's coming down in 60 days. So what's the story? He agreed
to take it down, is it going to be six months, sixty days, or are we hiding our incompetence?
COUNCILMAN GHOSIO: Well, the only, you know I respect you.
MR. DUNN: Absolutely.
COUNCILMAN GHOSIO: Absolutely, you've done a lot. I understand what you are saying,
the only problem I have is that you are saying things and the other person isn't here to respond,
you know, that's a little....
MR. DUNN: I hear you. As a matter of fact, I make it a rule not to do that.
COUNCILMAN GHOSIO: Right. I know, that's why I called you on it.
MR. DUNN: I make it a rule not to mention people's names but these guys are just lying and
confused and giving me crap. For seven months I haven't been able to sleep in my bedroom. Is
that right? Is it right that I have got to look at my wife crying because she's being driven
neurotic for listening to chimes throughout the house for five days because they have done
nothing and (inaudible).
COUNCILWOMAN DOHERTY: I don't know if we have a law against chimes though.
MR. DUNN: We've got a law against noise.
COUNCILWOMAN DOHERTY: But it's...
MR. DUNN: No it's not.
COUNCILWOMAN DOHERTY: Is it that loud?
MR. DUNN: You bet it is. There's three of them.
COUNCILWOMAN DOHERTY: Inaudible.
MR. DUNN: And I know a lot of people do but this is deliberately to annoy me, he put it under
my bedroom window.

MR. DUNN: There's two of them below my bedroom window, the third one about 65 feet away
on his porch. Why do they need to be under my bedroom window? And why hasn't our code
enforcement department or our lawyers done what they said they were going to do? I won't
mention any names. One of them ignored me and two of them lied or misled me. I am not going
to mention any names but I am not going to accept that. That department is earning over half a
million a year and I don't see them being worth it. I want to know when this is going to be taken
care of.
COUNCILMAN GHOSIO: I am going to take a ride down there for sure and take a look. At
least that way, I know you sent us photos (inaudible).
COUNCILWOMAN DOHERTY: I can't speak to it because we have to look at the paperwork
of what happened in court and everything else because...
MR. DUNN: What about the light complaint? What about the noise.complaint? They have
done nothing, nothing.
COUNCILWOMAN DOHERTY: I don't know if they've done nothing. We will have to sit
down with the town attorney....
MR. DUNN: He promised me he was going to have Lester come with a light meter. I don't
know who that is, it's not his fault.
COUNCILWOMAN DOHERTY: Yeah
MR. DUNN: Inaudible. And that was 2 1/2 months ago. As far as I am concerned, that was a
lie. When you tell me something that is not true, I see it as a lie. When you tell me something
that is half true, I see it as misleading. You ignore me, I see it as being ignored. If that's how we
handle taxpayers in this town,just tell me, then I know. Don't waste your time talking to
anybody in town because they are just going to ignore you. I don't think that is so. Scott Russell
made two trips there, he has been there twice. I talk to him incessantly about this and emails, on
the phone. Where our town lawyer won't even answer the phone.
COUNCILMAN GHOSIO: Inaudible.
MR. DUNN: I'll go home and sleep in my daughters room tonight again. Thank you. I am not
going away on this.
