I. Purpose.
The purpose of this local law is to improve safety for pedestrians and vehicles, as well as dealing with
impacts to the public's health, safety and welfare.
II. Chapter 260 of the Code of the Town of Southold is hereby amended by removing the struck through
portions and adding the underlined portions as follows:
§ 260-8 Parking prohibited at all times.
The parking of vehicles is hereby prohibited at all times in any of the following locations and at any other
location where signage indicates "no parking":
Cedar Beach Road Both From the intersection of
Paradise Point Road to its westerly
terminus
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of
competent jurisdiction to be invalid,the judgment shall not affect the validity of this law as a whole or any part
thereof other than the part so decided to be unconstitutional or invalid.

Town Board of the Town of Southold, Suffolk County,New York, on the 15th day of June,

NOTICE IS HEREBY FURTHER GIVEN that the Town Board of the Town of Southold will
hold a public hearing on the aforesaid Local Law at Southold Town Hall, 53095 Main Road,

I have a notarized affidavit that this has been published on the Town Clerk's bulletin board and
the town website. I also have an affidavit that this has been published in the Suffolk Times.
That's it.
SUPERVISOR RUSSELL: Would anyone like to address the Town Board on this particular
local law?
MARCY FETYANI: I am Marcy Fetyani, I live on Cedar Beach Road and just wanted to
confirm that that will become parking prohibited down that entire street because we have had
issues recently with people parking there that shouldn't be, so I just wanted to be sure that was
going to be implemented. I wanted to make my voice heard because we are the last house on
Cedar Beach Road on the right hand side.
SUPERVISOR RUSSELL: Yes, this would be from Paradise Point Road all the way down to
the parking lot on both side. yes,that was actually, the genesis of this was by request of Suffolk
County Legislator Al Krupski, so that they could, it would help with their enforcement also so
that it was only Suffolk County residents on Cedar Beach.
MS. FETYANI: Right. Okay.
SUPERVISOR RUSSELL: This was what they felt was one step that would make their job
easier.
COUNCILWOMAN DOHERTY: Yeah, it would help the Chief do our side, so the county can
have their side easier.
COUNCILWOMAN NAPPA: Right because that is a Suffolk County beach.

COUNCILWOMAN DOHERTY: Right.
MS. FETYANI: So there is no parking on Cedar Beach Road at all.
SUPERVISOR RUSSELL: There will be none.
MS. FETYANI: And there will be signs, other than the paper signs?
COUNCILWOMAN DOHERTY: Yes, once we approve this, it gets filed with the state and it
goes to the Highway Department to request them to put the signs up. So in a few weeks there
should be signs up.
MS. FETYANI: Great. Just wanted to make sure that our voice was being heard.
COUNCILWOMAN DOHERTY: Thank you for coming down, we appreciate it.
SUPERVISOR RUSSELL: Would anybody else like to address the Town Board on this?
COUNCILWOMAN NAPPA: I did think one of the attendees wanted to speak, so if you would
hit your raise hand button if you would like to speak? On the bottom of your zoom screen?
Well, I can speak I guess if he doesn't want to speak publicly, he did email me and said that I
could address the Board with his concerns. He is a local resident and he fishes at night there and
he is concerned that if there is no parking on both sides, he won't have anywhere to park in that
area since they close the gates at the beach and there is no parking in there and it would
effectively make it impossible for him to fish there. That was his concern, I don't know if we
want to discuss it. I don't remember when we discussed it before if we talked about doing permit
only, so that it was limited to Southold residents only, that could be an option.
COUNCILWOMAN DOHERTY: That is what it is now.
COUNCILWOMAN NAPPA: Oh, that's what it is now?
SUPERVISOR RUSSELL: The problem is, I don't know if the County (inaudible) for night
fishing and we only own the very small spot there, that goes down to the mean high water mark
(inaudible) and I don't know what their rules are on night fishing. I understand his concern and I
don't know if we can address it because it will be the County that sets its own night fishing rules
and if the county allows fishing at night then it should leave it's gate open. I don't know how to
address that.
COUNCILWOMAN DOHERTY: We own the beach right in front of the road end, right?
SUPERVISOR RUSSELL: Yeah but it's very narrow, 50 feet. It's all county beach there
(inaudible).

MS. FETYANI: Can I say last year they did close the gates at night and in the morning, but this
year it doesn't seem like they are doing that.
SUPERVISOR RUSSELL: Well, last year got special attention like all the towns in the county
because of the pandemic and also we did have enforcement issue because as you are aware, as
each different towns are making different rules,the pressure in one area is getting pushed off to
another area. We were all down there, I don't think they are doing it probably as diligently as
they did last year but I also don't think they've been ignoring it like they had done...
MS. FETYANI: No, we don't have hundreds of people on the beach, last year we had crazy
numbers of people,they have eliminated that but in regard to the night fishing, fishing is a nice
sport but when you let one person start to do it, it needs to be in a better controlled environment
because garbage is left on the street, there is a disregard for the beach honestly and I understand
it's a Suffolk County beach but not a Southold issue necessarily but it's also an issue for those of
us who live in the neighborhood. Cars flying down the street at night and it just becomes an
issue, it's a nice quiet area but...
SUPERVISOR RUSSELL: Yeah, comparing this to the gentleman, I understand the night
fishing...
MS. FETYANI: Me too.
SUPERVISOR RUSSELL: And there are people that fish at night that don't get permits and
they tend, you know,just like everybody they can abuse beaches but a lot of people get their
permits and the reason is is to allow them to go fishing at night. I don't know what county rules
are, we only govern like 50 feet there. I don't know what county beach rule, if they allow fishing
at night, they should leave the gate open. I can't address that (inaudible) but I, actually the
gentleman raised that concern, I am willing to close the hearing and wait two weeks.
COUNCILWOMAN DOHERTY: Well, there is parking up the street. We are not closing the
whole entire street. We are closing that road end.
COUNCILWOMAN NAPPA: Because there is no other parking in that area. There really isn't.
But there's a huge parking lot.
MS. FETYANI: Yeah, Suffolk County, it's their beach then they should make sure it's used
properly. I have no problem with the beach, I just don't think we should have 100 people fishing
the beach....
SUPERVISOR RUSSELL: Well, that's the balancing act. If they do leave the gate open, then
you are going to see a huge crowd. If they don't leave it open, then you are alienating a person,
even if it's an individual, you have got to listen to them.
MS. FETYANI: No, I feel for them, honestly I do. As long as it's respected but maybe it's a
Suffolk County issue (inaudible).

SPECIFICALLY, THE AMENDMENTS IF ADOPTED WOULD AMEND SECTION 260-8 TO
PROVIDE FOR A NO PARKING ZONE ON BOTH SIDES CEDAR BEACH ROAD FROM THE
INTERSECTION OF PARADISE POINT ROAD TO ITS WESTERLY TERMINUS.

A Local Law entitled, "A Local Law in relation to an Amendment to Chapter 260-8,
Parking prohibited at all times".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The purpose of this local law is to improve safety for pedestrians and vehicles, as well as
dealing with impacts to the public's health, safety and welfare.
II. Chapter 260 of the Code of the Town of Southold is hereby amended by removing the
struck through portions and adding the underlined portions as follows:
§ 260-8 Parking prohibited at all times.
The parking of vehicles is hereby prohibited at all times in any of the following locations and at
any other location where signage indicates "no parking":

Cedar Beach Road Both From the intersection of
Paradise Point Road to its westerly
terminus
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
