The properties are located on Main Road in Orient in the R-80 and R- 200 Zoning Districts. Matthews & Ham 38 Nugent Street Southampton, NY 11968 Re: Conditional Final Plat Approval —Weathervane Resubdivision 2183 Windshield Drive, Fishers Island SCTM#1000-2-1-8.1 & 8.2, Zoning District: R-120 Dear Mr. Ham: The Southold Town Planning Board adopted the following resolutions at a meeting held on Monday, August 9, 2021 WHEREAS, on March 24, 2021, the applicant submitted a resubdivision application for review by the Southold Town Planning Board; and WHEREAS, this resubdivision proposes to transfer 4,617 sq. ft. from Lot 1 (SCTM#1 000-2-1-8.1) to Lot 2 (SCTM#1000-2-1-8.2), and 2,884 sq. ft. from Lot 2 to Lot 1. Both lots require a variance from the Zoning Board of Appeals to be less than the minimum lot size of 120,000 sq. ft.; and WHEREAS, at their work session on May 17, 2021, the Southold Town Planning Board found the resubdivision application complete; and WHEREAS, pursuant to §240-56 Waivers of certain provisions, the Southold Town Planning Board shall have the authority to modify or waive, subject to appropriate conditions, any provision of these subdivision regulations, if in its judgment they are not requisite in the interest of the public health, safety and general welfare, except where such authority would be contrary to other ordinances or state law; and Weathervane Resubdivision Page 12 August 9, 2021 WHEREAS, the Southold Town Planning Board has determined that the following provisions of the Southold Town Code §240 Subdivision of Land are not requisite in the interest of the public health, safety and general welfare because this resubdivision does not create any additional residential building lots, and the amount of land being transferred from one lot to the other is small, and therefore are eligible for a waiver: a. Sketch Plat Review; b. Existing Resources Site Analysis Plan (ERSAP); c. Yield Plan; d. Primary & Secondary Conservation Area Plan; e. Preliminary Plat Review; and WHEREAS, on May 25, 2021, the Suffolk County Planning Commission responded that this proposal is a matter for local determination; and WHEREAS, pursuant to the resubdivision policy set by the Planning Board on February 2011, this application is eligible for a decision from the Planning Board prior to receiving approval by the Suffolk County Department of Health Services (SCDHS) as it meets the following criterion set forth in that policy: • Where both lots are already developed; and • Where no new development potential will be created in the parcel to which the land is transferred; and WHEREAS, this application is EXEMPT from review by the Local Waterfront Revitalization Program as no new development potential will come as a result of this resubdivision; and WHEREAS, on June 7, 2021, the public hearing was held; and WHEREAS, on June 17, 2021, the Southold Town Zoning Board of Appeals granted the area variances required; and WHEREAS, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617, has determined that the proposed action is a Type II Action under SEQRA according to 617.5(c)(16) "granting of individual setback and lot line variances and adjustments"; and WHEREAS, on July 26, 2021, at their Work Session, the Planning Board determined that the proposed action meets all the necessary requirements of Town Code §240-57 for a resubdivision application; and WHEREAS, pursuant to Town Code §240-41 concrete monuments to mark the property boundaries are required; therefore be it Weathervane Resubdivision Page 13 August 9, 2021 RESOLVED, that the Southold Town Planning Board has determined that this proposed action, which was incorrectly classified as Unlisted on June 7, 2021, is a Type II action under SEQRA as described above; and be it further RESOLVED, that the Southold Town Planning Board, pursuant to §240-56 Waivers of certain provisions, hereby waives the following provisions of subdivision: a. Southard Jr. 435 Bay Home Road Southold, NY 11971 Re: Approval — Site Plan for Boisseau Avenue Farm 1070 Boisseau Avenue, ± 50' n/e/o Hummel and Boisseau Avenue, Southold SCTM#1000-55.-6-37.1 Dear Mr. Southard: The following resolutions were adopted at a meeting of the Southold Town Planning Board on Monday, August 9, 2021: WHEREAS, this agricultural site plan is for the proposed construction of a 1-story 2,520 sq. ft. building for agricultural storage and no basement, two (2) 96' x 30' greenhouses, a gravel access road located on ±16 acres of farmland in the R-80 Zoning District, Southold; and WHEREAS, on March 15, 2021, Charles Southard, authorized agent, submitted incomplete materials for Site Plan Application review and was required to submit to the building department for a Notice of Disapproval; and WHEREAS, on May 27, 2021, Charles Southard, authorized agent, submitted revised site plans and materials for Site Plan Application review; and WHEREAS, on June 7, 2021, the Planning Bound accepted the application as complete for review; and WHEREAS, on June 7, 2021, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that the proposed action is a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5(c)(3) agricultural farm management practices, including construction, maintenance and repair of farm buildings and structures, and land use changes consistent with generally accepted principles of farming; and Boisseau Ave Farm Page 2 August 10,, 2021 WHEREAS, on June 7, 2021, pursuant to Southold Town Code §280-131(H), the Southold Town Planning Board waived the requirement for a public hearing regarding this application involving uses strictly related to agriculture (but excepting retail winery operations); and WHEREAS, pursuant to Southold Town Code §280-133(C) and as detailed in work session staff reports on June 7, 2021 and July 26, 2021, the Planning Board waived certain application requirements of§ 280-133 for this application involving uses strictly related to agriculture (but excepting retail winery operations); and WHEREAS, on July 1, 2021, a Notice of Disapproval was issued for the subject application; WHEREAS, on July 1, 2021, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, on July 7, 2021, the Southold Town Code Enforcement officer verified that there were no open violations on the subject parcel; and WHEREAS, on July 8, 2021, the Southold Town Engineer reviewed the proposed application and determined that the certain revisions were required in order for the application to meet the minimum requirements of Chapter 236 for Storm Water Management; and WHEREAS, on July 8, 2021, the Southold Town Fire Inspector stated there were no objections to the proposed site plan; and WHEREAS, on July 9, 2021, the Town of Southold Local Waterfront Revitalization Program Coordinator reviewed the proposed project and determined it to be consistent with the Southold Town LWRP policies; and WHEREAS, on July 19, 2021, the Southold Fire District determined that there was adequate fire protection and access for the proposed action; and WHEREAS, on July 22, 2021, Charles Southard, authorized agent, submitted specification details for the proposed earth floor greenhouses; and WHEREAS, on July 26, 2021, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan Approval of the Town of Southold have been met; and WHEREAS, on July 27, 2021, the Agricultural Advisory Committee provided comments supporting the proposed project for approval; and WHEREAS, on July 27, 2021, the Southold Town Chief Building Inspector reviewed and certified the proposed Agricultural Storage and Greenhouses as permitted uses in the R-80 Zoning District; therefore be it Boisseau Ave Farm Page 3 August 10, 2021 WHEREAS, on August 5, 2021, Charles Southard, authorized agent, submitted revised site plans showing updated exterior lighting and storm water management details; therefore be it RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; and be it further RESOLVED, that the Southold Town Planning Board hereby waives the requirement for a public hearing and certain application requirements as described above; and be it further RESOLVED, that the Southold Town Planning Board approves the Site Plan with conditions, listed below, to the site plan entitled "Boisseau Avenue Farm" prepared by Charles W. Southard dated March 10, 2021 and last revised July 23, 2021 and authorizes the Chairman to endorse the Site Plan and the following pages: 1. S — 1: Site Plan 2. P1 model exterior lighting specifications sheet Conditions 1. Access to the farm and future retail area from Boisseau Avenue shall be from the access road as shown on the approved site plan. Temporary access over the existing driveway to the south is permitted until the new access driveway is constructed. Any additional formal access points to Boisseau Avenue must be approved by the Planning Board prior to installation; 2. Contact the Office of the Town Engineer at(631)765-1560 prior to installation of any drainage structures to set up an inspection schedule; 3. All exterior lighting on the property shall comply with the approved site plan and the provisions of Chapter 172 of the Town Code. Any future exterior light fixtures not shown on the approved site plan must be reviewed for compliance and approved by the Planning Board prior to installation. Please also note the following requirements in the Southold Town Code relating to Site Plans: 1. Any new lighting fixtures beyond those approved as part of the Lighting Plan must conform to the Code and may require Planning Board approval depending on their number, size, intensity and location. Fixtures shall be shielded so the light source is not visible from adjacent properties and roadways and shall focus and direct the light in such a manner as to contain the light and glare within property boundaries and conform to §172 of the Town Code. 2. Proposed storm water run-off containment systems must be inspected by the Town Engineer at the time of installation. Please call the Southold Town Engineer prior to beginning this work. 4. Approved Site Plans are valid for eighteen months from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. 5. Any changes from the Approved Site Plan shall require Planning Board approval. 6. Prior to the issuance of a Certificate of Occupancy, the Planning Board must inspect the site to ensure it is in conformity with the Approved Site Plan, and issue a final site inspection approval letter. Should the site be found not in conformance with the Approved Site Plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. A copy of the Approved Site Plan is enclosed for your records. One copy will also be sent to the Building Department and the Town Engineer/Highway Department. and WHEREAS, on September 23, 2020, William Kelly, authorized agent, submitted a portion of materials for Site Plan Application review; and WHEREAS, on November 18, 2020, William Kelly, authorized agent, submitted additional materials for Site Plan Application review; and WHEREAS, on December 7, 2020, the Planning Bound determined the application as incomplete for review; and WHEREAS, on May 3, 2021, William Kelly, authorized agent, submitted a portion of materials for Site Plan Application review; and WHEREAS, on May 6, 2021, William Kelly, authorized agent, submitted the Site Plan application fee and revised site plans for Site Plan Application review; and WHEREAS, on May 27, 2021, William Kelly, authorized agent, submitted the building elevations for Site Plan Application review; and Murtha Farm Ag Building Page 2 August 10, 2021 WHEREAS, at their work session on June 7, 2021, the Southold Town Planning Board accepted the site plan application for review; and WHEREAS, on June 7, 2021, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that the proposed action is a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5(c)(3) agricultural farm management practices, including construction, maintenance and repair of farm buildings and structures, and land use changes consistent with generally accepted principles of farming; and WHEREAS, on June 7, 2021, pursuant to Southold Town Code §280-131(H), the Southold Town Planning Board agreed to waive the requirement for a public hearing regarding this application which involves uses strictly related to agriculture; and WHEREAS, pursuant to Southold Town Code §280-133(C) and as detailed in work session staff reports on June 7, 2021 and July 26, 2021, the Planning Board agreed to waive certain application requirements of§ 280-133 for this application which involves uses strictly related to agriculture (but excepting retail winery operations); and WHEREAS, on June 24, 2021, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, on June 24, 2021, the Southold Town Fire Inspector stated there were no objections to the proposed site plan; and WHEREAS, on July 1, 2021, the Southold Town Code Enforcement officer verified that there were no open violations on the subject parcel; and WHEREAS, on July 8, 2021, the Southold Town Engineer reviewed the proposed application and determined that the certain revisions were required in order for the application to meet the minimum requirements of Chapter 236 for Storm Water Management; and WHEREAS, on July 15, 2021, the Town of Southold Local Waterfront Revitalization Program Coordinator reviewed the proposed project and determined it to be consistent with the Southold Town LWRP policies with certain recommendations issued; and WHEREAS, on July 19, 2021, the Southold Fire District determined that there was adequate fire protection and access for the proposed action; and WHEREAS, on July 26, 2021, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan Approval of the Town of Southold have been met; and WHEREAS, on July 27, 2021, the Agricultural Advisory Committee provided comments supporting the proposed project for approval; and Murtha Farm Aq Building Page 3 August 10, 2021 WHEREAS, on July 27, 2021, the Southold Town Chief Building Inspector reviewed and certified the proposed Agricultural Storage Building as a permitted use in the A-C Zoning District; therefore be it RESOLVED, that the Southold Town Planning Board hereby waives the requirement for a public hearing and certain application requirements as described above; and be it further RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; and be it further RESOLVED, that the Southold Town Planning Board approves the Site Plan with conditions, listed below, to the site plan entitled "Murtha Ag Barn" prepared by Nathan Taft Corwin III, L.S., dated March 25, 2020 and last revised April 30, 2021 and authorizes the Chairman to endorse the Site Plan. Conditions 1. All Suffolk County Farmland Committee requirements shall be met as issued October 12, 2017 for Committee Resolution Number FC-33-2017; 2. This site plan was reviewed and approved with no exterior lights. Any future exterior lighting must be approved by the Planning Board by letter prior to installation. 3. Fences a. Fencing as shown on the site plan may be relocated as needed; and, additional fencing may be installed without the need to amend the Planning Board site plan approval. b. As permitted by the Suffolk County Farmland Committee. c. Prior to installing fencing closer than 100' to the wetlands, a permit or letter of non jurisdiction from the NYS DEC and Southold Town Trustees shall be obtained. d. A buffer* shall be provided between the fences and the wetland boundaries. *Consult the NYS DEC or the local Natural Resources Conservation Service Center for advice on buffer size and composition. 4. Drainage requirements for this small barn and gravel area have been waived. All stormwater runoff must be prevented from entering wetlands and contained within the property. The agricultural barn building location may be changed to any location on the property within required setbacks without any amendment to this site plan approval and without further consultation with the Planning Board. 6. Provide an as-built survey to this department upon completion of the barn construction. Please also note the following requirements in the Southold Town Code relating to Site Plans: 1. Any new lighting fixtures beyond those approved as part of the Lighting Plan must conform to the Code and may require Planning Board approval depending on their number, size, intensity and location. Fixtures shall be shielded so the light source is not visible from adjacent properties and roadways and shall focus and direct the light in such a manner as to contain the light and glare within property boundaries and conform to §172 of the Town Code. 2. All storm water run-off from grading, driveways and gravel areas must be contained on site. 3. Proposed storm water run-off containment systems must be inspected by the Town Engineer at the time of installation. Please call the Southold Town Engineer prior to beginning this work. 4. Approved Site Plans are valid for eighteen months from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. 5. Any changes from the Approved Site Plan shall require Planning Board approval. 6. Prior to the issuance of a Certificate of Occupancy, the Planning Board must inspect the site to ensure it is in conformity with the Approved Site Plan, and issue a final site inspection approval letter. Should the site be found not in conformance with the Approved Site Plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. A copy of the Approved Site Plan is enclosed for your records. One copy will also be sent to the Building Department and the Town Engineer/Highway Department.
