In addition we can remove the existing walkway on the west side and extend the gravel area there and have bluestone pavers to connect the dwelling to the existing deck. WHAT THIS MEANS IS THAT WE REDUCED THE 591 sf EXISTING DECK TO 14x16 =224 sf OF THE EXISTING DECK. The owner understands that that deck cannot be rebuilt if a storm destroys or damages it. I conducted an inventory and evaluation of the site on April 161h 2019 with respect tothe proposed property improvements detailed in the Notice of Disapproval letter sent to the applicant on February 11th, 2019.The improvements include add itions/a Iterations to the existing single-family dwelling and an accessory in-ground swimming pool.The Notice of Disapproval cited the following. Article XX||Section Z8U'116A(l) "All buildings orstructureslocated onlots upon which there exists a bluff landward of the shore or beach shall be set back notfewer than 100feetfrom the top ofsuch b/uff.^The site plan shows the proposed construction at 25.2 feet from the top of the bluff. In addition,the proposed construction was not permitted pursuant to Chapter 280-Bulk Schedule which requires minimum side yard setback of15feet.The proposed construction has a 7 S feet side yard setback. Lastly,the accessory swimming pool is not permitted pursuant to Article III, Section 280-15, which states "accessory buildings and structures may belocated/nthe required rear yard, or in case of a waterfront parcel, accessory buildings and structures may be located in thefront yard, provided that such buildings and structures meet the front yard principal setback requirements. The swimming pool islocated /nthe side yard. I observed the site and respectfully submit the following comments: 1)The waterfront residential property located at 745 Aquaview Avenue in East Marion, NY, is located atop a large bluff that leads down to the Long Island Sound.The property atop of the bluff is well vegetated with a mix of perennial grasses,trees and shrubs The toe of the bluff is not supported by a hardened shoreline (bulkhead) and shows signs of significant wind and water erosion.The bluff face exceeds the recommended maximum 1:3 ratio, and partly as a result,the bluff condition is poor and unstable in some areas.The face of the bluff is very steep and consists of several areas with vertical faces between the top of the bluff and the toe. Although the bluff's face is shows an estimated 80%of vegetated cover,there are several areas of concern that should be addressed to ensure the bluff's long- term protection. Failure to monitor and maintain the angle of repose and adequate vegetation on the bluff will significantly impact the bluff's long term resilience.As you will see in the photos below,there are several areas of the bluff face that are bare and/or eroding that may contribute to significant soil loss of the bluff,specifically around and under the staircase. I believe that these unstable areas are a result of several factors that may be causing the erosion of the bluff including the use of woody and invasive species that occupy the bluff face, as well as several wildlife corridors that create gully erosion approximately 1-25 feet below the top of the bluff. In addition,there are number of spots on the bluff that suffer from soil loss due to runoff from the top of the bluff.To stabilization the bluff, runoff control measures are recommended to capture and covey all stormwater runoff away from the bluff and discharged to the south. It is recommended that the bluff face,top and toe be monitored closely for any changes in the vegetation.Additional stabilization mitigation measures may be required if erosion persists.See attached images. 2)The current structure (single family dwelling) on the property is located very close to the top of the bluff and may impact the stabilization and health of the bluff that is adjacent to the structure. It was observed that the current structure is overhanging the top of the bluff and as a result poses significant impact to the bluff's stability. It is important to note the age of the existing structure and that the bluff's size and orientation may have changed greatly since the structure was originally erected.See attached images. 3)The proposed improvements to the site include the construction of an accessory swimming pool located in the side yard with a 25.2 foot setback from the top of the bluff.This raises a concern as,the location of pool and required construction may cause the bluff to destabilize and fail. In addition, even though the proposed construction does not drastically increase the amount of impervious area,special consideration should be taken to ensure that any runoff from these surfaces are collected and discharged in a designated area away from the top of the bluff. It is critical that runoff be diverted away from the proposed structure during construction and post-construction to ensure the stabilization of the soils surrounding the proposed improvement.Stormwater runoff,stabilization and soil loss is a significant factor when considering the location of a pool or similar structure. It is recommended that the location of the pool be considered to avoid impacts associated with the proposed construction.See attached images. 8 �g MAY 2 8 2019 Southold Town Board of Trustees It is recommended that the proposed accessory swimming pool be located in the side yard or the front yard,with a significant setback from the bluff's top to ensure no additional impacts to the already eroded bluff. 4)Additional considerations: • All ground disturbance activities have an impact. If soil disturbance is minimized the impacts associated with the activated are significantly decreased. Undisturbed and vegetated areas should be left undisturbed whenever possible. • Protection of existing vegetation is critical to ensuring the long-term stabilization of the property. Protected areas should be clearly identified with bright colored ribbon and/or fencing prior to the commencement of construction.Additionally,stockpile locations,staging areas and access points must be clearly defined to minimize impacts. • Any improvement that alters the natural course of drainage (ex:structures, impervious surfaces, conveyances, etc.)will increase the impact of stormwater runoff. Consideration should be taken to minimize the impact of runoff during and after construction. Erosion and sediment control measures should be implemented prior to ground disturbing activities. • All efforts should be taken to vegetate and stabilize disturbed soils as soon as possible.See NYS Standards and Specification for Erosion and Sediment Control ("Blue-Book")for additional control measures and considerations. • Construction and the use of heavy equipment may impact the stabilization of soils.Vibrations from machinery as well as soil compaction have adverse impacts. Machinery should not be left to idle and only running when in use.The location and storage of such equipment should be as far away as possible from critical areas such as bluffs and any unstable soils. • Although there was no irrigation found at the site, it is cautioned that any irrigation should be limited to protect the stabilization of the bluff and the surrounding soils. Box 1179 Southold,New York 11971-0959 Re:ZBA#7293 Milano,Susan and Timothy SCTM#1000-21-02-09 Chairperson Weisman, Thank you for reaching out to the Suffolk County Soil and Water Conservation District and requesting technical assistance regarding the proposed improvements to the property located at 745 Aquaview Avenue East Marion,NY.I conducted an inventory and evaluation of the site on April 16th, 2019 with respect to the proposed property improvements detailed in the Notice of Disapproval letter sent to the applicant on February 11th,2019.The improvements include additions/alterations to the existing single-family dwelling and an accessory in-ground swimming pool.The Notice of Disapproval cited the following: Article XXII Section,280-116A(1)"All buildings or structures located on lots upon which there exists a bluff landward of the shore or beach shall be set back not fewer than 100 feet from the top of such bluff."The site plan shows the proposed construction at 25.2 feet from the top of the bluff. In addition,the proposed construction was not permitted pursuant to Chapter 280-Bulk Schedule which requires a minimum side yard setback of 15 feet.The proposed construction has a 7.5 feet side yard setback. Lastly,the accessory swimming pool is not permitted pursuant to Article Ill,Section 280-15, which states "accessory buildings and structures may be located in the required rear yard,or in case of a waterfront parcel, accessory buildings and structures may be located in the front yard, provided that such buildings and structures meet the front yard principal setback requirements." The swimming pool is located in the side yard. Office Hours:Mouday through Thursday 7:30 am.to 4:00 p.m. Friday 7:30 a.m.through 3:00 p.m. I observed the site and respectfully submit the following comments: 1)The waterfront residential property located at 745 Aquaview Avenue in fast Marion,NY,is located atop a large bluff that leads down to the Long Island Sound.The property atop of the bluff is well vegetated with a mix of perennial grasses,trees and shrubs.The toe of the bluff is not supported by a hardened shoreline(bulkhead)and shows signs of significant wind and water erosion.The bluff face exceeds the recommended maximum 1:3 ratio,and partly as a result,the bluff condition is poor and unstable in some areas.The face of the bluff is very steep and consists of several areas with vertical faces between the top of the bluff and the toe. Although the bluff's face is shows an estimated 80%of vegetated cover,there are several areas of concern that should be addressed to ensure the bluffs long- term protection.Failure to monitor and maintain the angle of repose and adequate vegetation on the bluff will significantly impact the bluffs long term resilience.As you will see in the photos below,there are several areas of the bluff face that are bare and/or eroding that may contribute to significant soil loss of the bluff,specifically around and under the staircase.I believe that these unstable areas are a result of several factors that may be causing the erosion of the bluff including the use of woody and invasive species that occupy the bluff face,as well as several wildlife corridors'that create gully erosion approximately 1-25 feet below the top of the bluff.In addition,there are number of spots on the bluff that suffer from soil loss due to runoff from the top of the bluff.To stabilization the bluff, runoff control measures are recommended to capture and covey all stormwater runoff away from the bluff and discharged to the south.It is recommended that the bluff face,top and toe be monitored closely for any changes in the vegetation.Additional stabilization mitigation measures may be required if erosion persists.See attached images. 2)The current structure(single family dwelling)on the property is located very close to the top of the bluff and may impact the stabilization and health of the bluff that is adjacent to the structure.It was observed that the current structure is overhanging the top of the bluff and as a result poses significant impact to the bluff's stability.It is important to note the age of the existing structure and that the bluffs size and orientation may have changed greatly since the structure was originally erected.See attached images. 3)The proposed improvements to the site include the construction of an accessory swimming pool located in the side yard with a 25.2 foot setback from the top of the bluff.This raises a concern as the location of pool and required construction may cause the bluff to destabilize and fail.In addition,even though the proposed construction does not drastically increase the amount of impervious area,special consideration should be taken to ensure that any runoff from these surfaces are collected and discharged in a designated area away from the top of the bluff. It is critical that runoff be diverted away from the proposed structure during construction and post-construction to ensure the stabilization of the soils surrounding the proposed improvement.Stormwater runoff,stabilization and soil loss is a significant factor when considering the location of a pool or similar structure.It is recommended that the location of the pool be considered to avoid impacts associated with the proposed construction.See attached images. 1 it is recommended that the proposed accessory swimming pool be located in the side yard or the front yard,with a significant setback from the bluffs top to ensure no additional impacts to the already eroded bluff. 4)Additional considerations: • All ground disturbance activities have an impact.If soil disturbance is minimized the impacts associated with the activated are significantly decreased.Undisturbed and vegetated areas should be left undisturbed whenever possible. • Protection of existing vegetation is critical to ensuring the long-term stabilization of the property.Protected areas should be clearly identified with bright colored ribbon and/or fencing prior to the commencement of construction.Additionally,stockpile locations,staging areas and access points must be clearly defined to minimize impacts. • Any improvement that alters the natural course of drainage(ex:structures,impervious surfaces, conveyances,etc.)will increase the impact of stormwater runoff.Consideration should be taken to,minimize the impact of runoff during and after construction.Erosion and sediment control measures should be implemented prior to ground disturbing activities. • All efforts should be taken to vegetate and stabilize disturbed soils as soon as possible.See NYS Standards and Specification for Erosion and Sediment Control("Blue-Book")for additional control measures and considerations. • Construction and the use of heavy equipment may impact the stabilization of soils.Vibrations from machinery as well as soil compaction have adverse impacts.Machinery should not be left to idle and only running when in use.The location and storage of such equipment should be as far away as possible from critical areas such as bluffs and any unstable soils. Although there was no irrigation found at the site,it is cautioned that any irrigation should be limited to protect the stabilization of the bluff and the surrounding soils.
