Moore, Esq. 51020 Main Road Southold, NY 11971 RE: SAM ORLOFSKY 18575 SOUNDVIEW AVENUE, SOUTHOLD SCTM# 1000-51-1-12 Dear Mrs. Moore: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, August 18, 2021: WHEREAS, Patricia Moore, Esq., on behalf of SAM ORLOFSKY applied to the Southold Town Trustees for an Amendment to Wetland Permit#9638 and Coastal Erosion Permit#9638C under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated June 9, 2021, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be - -found to be Consistent with the-Local Waterfront Revitalization Program policy_-_ standards, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, 3 2 NOW THEREFORE BE IT, RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit 9638 & 9638C for the restoration & revegetation of 12' x 80' area on bluff due to work on bluff. All disturbed areas to be planted with cape American beach grass plugs at 12" OC with additional 65 cy of clean fill to restore area.Proposed coir logs (@107') with 20 cy of clean fill at the top of the bluff, plant with native vegetation and graded landward of existing bluff to direct all drainage to proposed drywelis. Establish 10' "non- turf vegetated buffer" landward from top of bluff; existing staircase will be cut back to new grade and 4' platform from end of stairs to level ground, as needed. Proposed drywell to capture roof runoff and surface runoff prior to reaching top of bluff and running over bluff; restore hedgerow on east and west property line; construct Egress basement window (30"wide x 48" deep) to existing foundation to comply with building code (building permit#44320); reconstruct existing raised patio to.original dimensions (14' X 25') and (8' X 8') and resurface with new IPE decking; remove retaining blocks from bluff area; and as depicted on the site plan prepared by Jeffrey Pafanjo, last dated ,August 16, 2021 and stamped approved on August 18, 2021. The Permittee is required to provide evidence that a copy of+this Trustee permit has been recorded with the Suffolk'County Clerk's Office as a_notice covenant and deed restriction"to the deed of the subject parcel. Such evidence shall be provided within ninety (1 90) calendar days of issuance of this permit. Fees must be paid, if applicable, and permit issued within siz,months of the date of this notification. Basement doors, as they appear on.the-aerial photo, can be used as a point of reference for the:footprint-of former patio. By drawing a straight line, 2 or 3 feet beyond the edge of the doors, to the larger protruding window to the middle of the house, we have a footprint of previously existing patio. The former patio was a small square, roughly 12x12 ,nestled between two protruding walls, plus a narrow walkway as defined in former paragraph,nota 14x25 construction. We were frequent guests of the former owner. The patio barely sat 6 to 8 people . Presently, on the bluff side,there are two rows of concrete posts which were driven into the ground sometime in,June 2021: - The first row,-closest to the home,three,,concrete squares, is pretty- much rettymuch where the former raised patio ended. Second,r-ow : 3 square concrete posts and two round one,:are placed = where a former evergreen edge, subsequently removed by new owners, stood. If this is intended to support the proposed new patio, it would more than double the size_of former.patio. Please find enclosed an aerial view of 18575 Soundview avenue, sound side, taken shortly before ORLOFSKY closed on the home formerly owned by Ed RESCINITI. 1 As you can see the house was surrounded by bushes which now have all been uprooted and discarded. The concrete construction which started last week is right where the small terrace and bushes stood formerly and extend farther out Soundside. There are new stairs protruding some 6 feet in the air over the bluff edge.(picture taken from our yard yesterday sent in a separate a mail). Former stairs were built at ground level and disappeared into the natural habitat. We wonder what is going on there. We and our neighbors have already endured over 2 years of construction noise. 18575 is an eyesore in the neighborhood. We are not looking forward to a third Summer of disturbance. We have no problem with the new owners renovating and staying within the original footprint of the house on the Sound side. However, we object to the removal of existing vegetation in order to add to the house original footprint. The Steinbuch , neighbors on other side of 18575 have probably contacted you as well as they are equally upset at the ongoing disturbances.
