Box 1179 Southold Towm Southold, NY 11971 a �f Trustees Dear Trustees: I am writing to you as one of the members of North Fork Lending, LLC,'to advise you of adverse conditions created by some of the neighboring properties and the Southold Shores streets at our property located at 64600 Main Road in Southold,SCTM 1000-56-07-4.1. Improper routing of runoff onto our property(as well as other issues a'nd problems described below) has created large pools of standing water on our property. The property has no underground aquifers or surface streams running through it,yet non-native phragmites, normally found in wetland areas, are overtaking native vegetation. It is our understanding that Federal,State and Local Codes require that residences and roadways provide drainage rings to contain runoff on their property. Some of the neighbors on our east property line do not appear to be in compliance with these runoff requirements and, by directing their street and residence runoff onto our property, have created serious issues we must address. Specifically,the conditions are: • Runoff from gutter leaders at homes on Dolphin Drive, along the east side of our property, are not contained and the yards are pitched to direct runoff onto our property. • The street drains on both sides of Dolphin Drive do not appear to have catch basins. • A sump for the sub division properties has been dug on our property and a 2'wide trench has been hand dug to discharge excess runoff into the bay. • Homeowners on Dolphin Drive have allowed their lawns and belongings—grass,chairs, planters, sheds,fire pits-to "creep" onto our property. • Trees have been trimmed on our property without permission,;presumably to enhance homeowners'views. • Garbage is strewn on the property in areas only accessible from homes on Dolphin Drive. t� • Non-native Phragmites is overtaking native vegetation on the property. This is directly attributable to the residential and street runoff creating large pools of standing water on the property. Attached are photographs of our property showing runoff water pooling, Dolphin Drive street drains which appear to have no catch basins, piles of trash dumped on the property,the trench leading to the bay,and cut tree limbs left on the ground. These property conditions must be remedied by re-grading to eliminate the sump and trench running to the bay, removal of non-native species, removal of trash and wood cuttings, removal of grass and belongings that have crept onto the property, and replanting all affected areas with native plantings. This will be expensive remediation and, if the underlying problems created by the neighboring properties are not addressed,will recur. I would also note that according to the NYSDEC Freshwater Wetlands Map,the wetlands shown on the site are not considered NYSDEC regulated under Article 24, Freshwater Wetlands. My partners and I look forward to working with you to determine what remedial efforts can be taken to cure the neighboring sub-division runoff problems.
