Mark Terry, Assistant Town Planning Director LWRP Coordinator Date: June 9, 2021 Re: Local Waterfront Coastal Consistency Review for PECONIC RIVER, LLC SCTM# 1000-81-1-18.1 En-Consultants on behalf of PECONIC RIVER, LLC requests a Wetland Permit to demolish existing two-story, 2,300 sf, FEMA-noncompliant, single-family dwelling with 460 sf attached deck and 761 sf detached garage; and construct at least +17 feet farther landward a new one to two-story, 3,200 sf, FEMA-compliant, single-family dwelling with 106 sf entry porch, 945 sf attached deck, 850 sf attached garage, 850 sf swimming pool (equipped with saltwater filtration system), 580 sf structurally detached deck, and Tx 46' uncovered basement egress; install pool enclosure fencing with gates; remove existing nonconforming septic system located +/-42' from bulkhead, and install new I/A OWTS sanitary system outside Chapter 275 jurisdiction; install a drainage system of drywells to collect and recharge roof runoff and pool backwash; install new pervious gravel driveway and parking areas; remove specified trees located no closer than +/-69 feet from bulkhead; and establish and perpetually maintain a 27' to 39' wide, approximately 5,959 sf buffer " area adjacent to bulkhead, including existing 4,259 sf naturally vegetated embankment and additional 10' wide, ±1,700 sf non-turf buffer to be established in place of existing lawn along top of bank. SCTM# 1000-81-1-18.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP. The 580 sf structurally detached deck is recommended as INCONSISTENT. Structure in VE FEMA flood zones should be relocated outside of the zone or minimized. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS 1, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within'the Coastal Erosion Hazard Area. 2. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable J STATEMENT OF EFFECT AND LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR PECONIC RIVER LLC ' 450 BASIN ROAD SOUTHOLD, NY The proposed project, which seeks to replace an existing, FEMA-nonconforming dwelling and detached garage with a new, modernized, energy-efficient, FEMA-compliant dwelling with attached garage, decks, and swimming pool, will have a net beneficial impact on the surrounding shoreline and tidal wetland ecosystem as a result of the below described design elements and additionally incorporated environmental mitigation measures. A) Project Design 1) The proct desi ,would re It in the new dwelling being situated approximatel feet from Sou old Bay and thus at least 16 feet farther from wetlands t an the existi welling to be removed; and would result in an overall t cre in the minimum structural setback from,w an s o approximately 12 feet (from 54 feet to the existing dwelling s eps�to 66 feet_to the proposed structurally detac 'waterside_deck). 2) Due t the landward r ocation of the dwelling described above, the project desi would res emoval and replacement of a FEMA-nonconforming dwelli g locate a VE floo zone with a new dwelling located-entirely within an-_X_ ad_z O -e-proposed-detaehed-wAor-§ide—deck, which will be structur etac e om the primary dw ing and constructed on wood posts, will be located within the VE flood zone. 3) Due to the landward relocation of the dwelling described above, the project design would result in the removal and replacement of a dwelling that currently projects seaward of the plane drawn between the seaward corners of the two adjacent dwellings with a new dwelling positioned landward of that plane, thus compliant with Section 275-11(A)(3). 4) The proposed swimming pool would be located approximately 79 feet from wetlands, well exceeding the minimum 50' wetland setback for pools set forth in Section 275-3(D)(1)(a)(5). B) Additional Mitigation 1) The existing nonconforming septic system, which is located only approximately 42 feet from the surface waters of Southold Bay, will be removed and replaced with a low-nitrogen, innovative/alternative sanitary system;(UA OWTS) located at least 134 feet from surface waters and well outside Chapter 275 jurisdiction. 11Page Unlike conventional septic systems, the I/A OWTS is designed to significantly reduce nitrogen loading into the groundwater table. 2) A 27' to 39' wide, approximately 5,959 sf buffer area would be permanently maintained adjacent to the existing bulkhead fronting Southold Bay, including the existing, approximately 4,259 sf naturally vegetated embankment and an additional 1,700 sf non-turf buffer area to be established in place of existing lawn within 10 feet of the top of bank. 3) A drainage system consisting of leaders, gutters, and drywells would be, installed to collect and recharge roof runoff. 4) The proposed swimming pool would be equipped with a saltwater filtration system, thus avoiding use of a traditional, high-chlorination treatment system; and a drywell dedicated to the capture of pool backwash. 5) The proposed driveway and parking area would be composed of pervious gravel. 6) A project limiting fence would be installed to contain site disturbance and potential surface runoff during construction. - These project design and mitigation measures, which together would result in increased separation between wetlands and site development; potentially reduced runoff and improved runoff quality; and potentially improved groundwater and surface water quality, will thus further the goals of Chapter 275 and LWRP Policies 4, 5, and 6, including minimizing risk of flood and erosion damage; protecting and improving water quality; and protecting the quality and function of the surrounding Southold Bay shoreline and tidal wetland ecosystem.
