The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP. This recommendation is based on the inconsistency with Policy 1 of the LWRP, which states that the pattern of development minimizes adverse effects of development on the environment. In this case the expansion of the deck will encroach into a 50' conservation easement area designated by the Planning Board to protect the tidal wetlands—an environmentally sensitive area. This conservation easement is described on the filed subdivision map of R.F. Blum and W. A. Littell. See attached copy of the filed map and note item 7 which states the following: "A conservation easement having a depth of 50 feet shall be established along the tidal wetlands." The tidal wetlands line is shown on the survey by Van Tuyl that was included in the Trustees application. We have registered that survey to the GIS aerial to show generally where the 50' conservation easement area is located. According to that map, the deck cannot be any closer than it already is to the wetlands or it will be in violation of that easement.
