In 2019 a similar action'was found'consistent' nd'an am6hdtnent to Wetlarid'Permit(8920) was issued, however based on better available information'I am now recommending this action and INCONSISTENT with the LWRP. Suffolk Environmental Consulting on behalf of MILDRED PASCUCCI requests a Wetland Permit to construct a proposed two-story, single-family dwelling with the first floor area to include 518 sq. ft. of living space, a 1,445sq.ft. deck, a 70sq.ft. ramp, and 148sq.ft. of stairway; second floor to include 1,741sq.ft. of living space, a 345sq.ft. deck, 112sq.ft. of stairway, and 625sq.ft. landing; install sanitary system along the easterly portion of the lot; install 151 linear feet of retaining'wall;-place=an approximate 370 cubic yards of clean sand surrounding the proposed INOWTS septic system; install a well; install a 30'x15' French drain 2 feet deep and construct a 560sq.ft. gravel driveway; landscape the property consisting of 2,600sq.ft. surrounding the house to be planted with red, . fescue, 6,600sq.ft. planted with Cape American beach grass; install three groupings of Atlantic Red Cedar and supplement plantings adjacent to the septic system with Groundsel Bush installed 6 feet on center and within the bounds of the property. SCTM# 1000-26-3-11 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy ---- -----Standards:- Based upon-the-information--provided on-the-L-WRP-Consistency.Assessment_Form-_ submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards 4 and 6 and therefore is INCONSISTENT with the LWRP. This determination is based upon,the following: 4.1 Minimize losses of human life and structures from flooding and erosion hazards. According to the Suffolk County Hazard Mitigation Tool the parcel and area (including roads) are susceptible to flooding. The parcel is located within: 1. 1% (100-Year Flood Zone) and 0.2% (500-Year Flood Zone) Annual Chance Flood - DFIRM ID: 36103C FEMA flood zone AE El 6. 2. Storm Surge Zone-the parcel is expected to flood during a Category 1 Hurricane and storms. 3. Extreme and High - NYDOS Costal Risk Hazard Area a. Extreme Risk Areas are areas of frequent inundation. b. High Risk Areas are areas outside of Extreme Risk Areas that are currently at infrequent risk of inundation or at future risk of sea level rise. It is expected that the property will be inundated during storms and in most hurricanes (SLOSH Model). Sea level rise will also adversely impact this parcel in the future. 4. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for.- a. oraa. 'structures which functionally require a location on the coast or in coastal waters. The single-family residence proposed does not require a location on the coast or in coastal waters— - -- - - - - - - b. water-dependent uses which cannot avoid exposure to hazards. The single-family residence would be frequently exposed to hazards. Hydrological conditions of properties change over time and shallow depth to groundwater has been recorded and is expected. The test hole conducted in 2015 should be updated. The location of the I/A OWTS is located in an area with high groundwater, expected to flood and closest to surface waters. To meet Policy 6, it is recommended that the Board re-assess the soils, vegetation and hydrology on site for a wetland system, especially in the area adjacent to King Street. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
