SCTM# 1000-26-2-47 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS 1 , All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area, 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR ORIENTAL UNICORN LLC 860 WILLOW TERRACE LANE ORIENT,NY SCTM#1000-26-2-47 POLICY 4 Consistent with Policy 4, the project seeks to replace an existing, Town-permitted timber bulkhead with a vinyl bulkhead in the same location to maintain the property's historical method of protection against erosion and flooding. The existing, developed site has been improved with and supported and protected from flooding and erosion by a bulkhead since prior to 1984, and the current position of the'bulkhead, which is situated between and connects to bulkheading on both adjoining properties, was established in 1993 pursuant to Board of Trustees Permit No. 4503. There is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the bulkhead, the subject property and the adjacent, bulkheaded properties would be exposed to severe erosion, flooding, and potential damage to the residential structures located thereon. Also consistent with the permit standards of Chapter 111-15, the project will thus effectively maintain the historically existing conditions along this bulkheaded shoreline without causing a measurable increase in erosion or causing adverse effects to the site, the adjacent properties, or natural coastal processes and resources. And the replacement bulkhead will be constructed in accordance with generally accepted engineering principles and is intended' to withstand inundation, wave impacts, weathering, and other effects of storm conditions for a minimum of 30 years. The project will effectively maintain the historically existing and permitted shoreline condition without any significant change to or adverse impacts on the adjacent tidal waters And consistent with the Policy 6 goal of protecting and restoring the quality and function of Town of Southold ecosystems,the project will provide the ecological benefits associated with replacing a treated timber bulkhead with untreated vinyl sheathing and restoring and maintaining the existing 15'wide naturally vegetated non-turf buffer with native vegetation upon completion of the bulkhead reconstruction,which will provide a sink and filter for surface water runoff and potential contaminants contained therein.
