naming the Town of Southold as an additional insured for two million dollars and comply with

E-Filing System for Filing a Petition(S)Re: Taxes
WHEREAS, the County of Suffolk and each of the ten Suffolk County Towns are in a
State of Emergency with the entire State of New York as declared by the Governor as of
March 7, 2020, due to COVID-19; and
WHEREAS, in light of the foregoing, the Town of Southold, the Supervisor, the Board of
Assessors and the legal representatives of the Town recognize the need to reduce expenses, to
conserve resources and to maintain some type of"social distancing' into the future. Therefore,
there is a need to make certain changes to the current procedure for service upon the Town of a
Petition of Certiorari (hereinafter "Petition(s)")judicially challenging the assessment of real
property as authorized under Article 7 of the Real Property Tax Law. Changes to the current
service of process would not only limit the personal contact between the public and assessment
staff, but also greatly reduce the already limited resources of the town reviewing and processing
the grievance complaints filed each year; and
WHEREAS, the filing period for such petitions is imminent and the adoption of an E-
Filing system is in the best interest of both Petitioners and the Town; and
WHEREAS, the use of a uniform E-Filing system for filing a Petition(s) upon the Town
is currently provided for by the Real Property Tax Law §104(1)(c) and the proposed uniform E-
Filing system provides Complainants with the same protections they currently enjoy; and

WHEREAS, the adoption of a uniform E-Filing system is not intended to replace a
Petitioner's ability to file a Petition(s) in accordance with the current statutory and regulatory
framework but rather it is to be an alternative thereto; and
WHEREAS, the Procedures and Protocols will be located at:
<https://www.southoldtowimy.ov/1768/SCARCertiorari-Information> and incorporated herein
adequately address the concerns of the Petitioner and the Town; and
WHEREAS, in accordance with the provisions of Real Property Tax Law §104, the
adoption and implementation of a uniform E-Filing system for service of a Petition(s) shall be
deemed to be in compliance with the provisions of real property tax law and all other applicable
laws, rules & regulations applicable to service of process relative to a judicial challenge to the
assessment of real property.
NOW, THEREFORE, BE IT RESOLVED, the Town Board hereby authorize the Chair
of the Board of Assessors and the Town Attorney to implement the Protocols established to serve
a Petition(s) electronically in accordance with the provisions of Real Property Tax Law §104 and
adopt and implement a uniform E-Filing system for such petitions filed in compliance with the
provisions of Real Property Tax Law Article 7 and all other applicable laws, rules & regulations
applicable to service of process of a Petition(s) challenging the assessment of real property.

RESOLVED that the Town Board of the Town of Southold hereby amends resolution 2021-260,
adopted at the April 6, 2021 regular Town Board Meeting to read as follows:
RESOLVED that the Town Board of the Town of Southold hereby grants permission to the
Southold Yacht Club to park overflow vehicles in the grass area and adjacent road at Goose
Creek Beach, on July 10, 2021 (rain date July 11, 202 1) for their World's Longest Sunfish Race;
July 22-23, 2021 (rain date july 26, August 2, 2021) for their Annual Carol Smith Regatta
provided the applicant meets all of the requirements as listed in the Town Policy on Special
Events and Use of Recreation Areas and Town Roads and subject to the applicant's compliance
with all executive orders of the State of New York. Failure to comply with all provisions and
conditions will result in the revocation of the permit. Placards will be supplied by the Yacht Club
for members that do not have a Southold Town parking permit which should be placed on the

§ 189-4 Designation of parking areas on Fishers Island.

A. The use of Raee Point ^q--4 recreational areas on Fishers Island by persons other than
residents has increased to such an extent that such area has become overcrowded with the
result that residents are denied the use thereof. The Town Board therefore declares it to be
policy of the Town of Southold to restrict and regulate the parking of vehicles at R-aec-

B. No person shall park any type of vehicle in any parking area designated here in this section
as a "Parking by Permit Only" area unless such vehicle displays a valid parking permit duly
issued for such vehicle in accordance with the provisions of Subsection D. In addition to the
areas listed in Subsection A above, the following areas of Fishers Island are designated

Southold Town Clerk to all persons who are qualified residents of the Town of
Southold. Persons applying for a resident parking permit shall present for
inspection the following proof of residency: a valid tax receipt stub for the current
year for any taxable real property within the Town of Southold assessed in the
name of the applicant, or a valid motor vehicle registration in the name of the
applicant at an address located within the Town of Southold, or such other proof
of residence as is satisfactory to the designee.
(b) Upon determination by the designee that the applicant is a qualified resident of
the Town, and upon payment of a fee,previously determined by Town Board
resolution, a resident parking permit shall be issued and inscribed with the vehicle
license registration number. Such permit shall be affixed to the right front bumper
and shall not be transferred to any other vehicle.
(2) Lessee parking permit.
(a) A lessee parking permit shall be issued by the Fishers Island designee to all
persons who lease or rent property within the Town of Southold but do not qualify
as residents defined in Subsection D(1). Persons applying for a lessee parking
permit shall indicate the location of leased or rented property, the persons
occupying the same and the term of tenancy and must present to the designee as
proof of tenancy verification from the property owner or managing realtor.
(b) Upon determination by the designee that the applicant is entitled to a lessee
parking permit, and upon payment of the fee, such permit shall be issued and
inscribed with the vehicle license registration number and shall be affixed to the
right front bumper and shall not be transferred to any other vehicle.
(3) A guest parking permit shall be issued by the Fishers Island designee to all
persons who are qualified for residential or lessee parking permits as defined in
Subsection D(1) and (2) hereof for use by guests temporarily residing in the
dwelling of such resident or lessee. The resident or lessee applying for a guest
parking pennit shall indicate the location of property to be occupied by the guest,
the names of the guests and the length of time and guest occupancy. The guest
parking permit shall be displayed in the right front dashboard area of the vehicle,
shall not be transferred to any other vehicle and shall be valid during guest

occupancy only.
E. The following beach parking areas are hereby designated as Town of Southold "No
Overnight Parking" areas:
(1) Parking Lot at "Dock Beach" located on Fishers Island
&F. Any vehicle parked in violation of the provisions of this section or any other law, ordinance,
rule, regulation or resolution may be removed or be caused to be removed by the Fishers
Island Constables or the New York State Troopers.
III. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

Elect to Purchase-SEQRA McCall Dev Rights Easement
WHEREAS, the Town Board of the Town of Southold held a public hearing on the question of
the purchase of a development rights easement on a certain parcel of property owned by
Walker/McCall, LLC and McCall Family Holdings Limited Partnership LLLP on the 1 st day of
June, 2021, at which time all interested parties were given the opportunity to be heard; and
WHEREAS, said property is identified SCTM #1000-116.-1-10. The address is 21657 Main
Road (NYS Route 25) in Cutchogue. The property is located in the Agricultural-Conservation
(A-C) Zoning District and is situated on the southerly side of Main Road (NYS Route 25)
approximately 1063 feet easterly from the intersection of Locust Avenue and Main Road (NYS
Route 25); and
WHEREAS, the proposed acquisition is for a development rights easement on a parcel
consisting of approximately 7.78± acres (subject to survey). In conjunction with the purchase of
the development rights easement, an adjacent parcel known as 21380 NYS Route 25, Cutchogue,
NY and designated as SCTM #1000-109.-1-37 will be subject to a Declaration of Covenants &
Restrictions, including a requirement that the parcel remain permanently attached to the farm.
Upon closing, the Declaration of Covenants & Restrictions will be recorded simultaneously with
the Development Rights Easement. The exact area of the acquisition is subject to a Town-
provided survey acceptable to the Land Preservation Committee and the property owner; and
WHEREAS, the easement will be acquired using Community Preservation Funds. The purchase
price is $65,000.00 (sixty-five thousand dollars) per buildable acre, estimated at $505,700 (five
hundred five thousand seven hundred dollars) for the 7.78± acre easement. Purchase price will be
adjusted at time of closing based on final survey acreage determination, plus acquisition costs.
The landowner has offered to sell the development rights to the Town at a purchase price below
the fair market value indicated in the Town's commissioned appraisal and the landowner may be
eligible to claire a bargain sale; and

WHEREAS, the property is listed on the Town's Community Preservation Project Plan List of
Eligible Parcels as property that should be preserved due to its agricultural value; and
WHEREAS, the purchase of the development rights on this property is in conformance with the
provisions of Chapter 17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands
Preservation) of the Town Code, and
WHEREAS, the proposed action has been reviewed pursuant to Chapter 268 (Waterfront
Consistency Review) of the Town Code and Local Waterfront Revitalization Program
("LWRP") and the LWRP Coordinator has recommended that this action is consistent with the
LWRP; and
WHEREAS, the Land Preservation Committee has reviewed the application for the acquisition,
and recommends that the Town Board acquire the development rights easement; and
WHEREAS, the Town Board deems it in the best public interest that the Town of Southold
purchase the development rights on this agricultural land; and,
WHEREAS, the Town Board of the Town of Southold classifies this action as an Unlisted
Action pursuant to the SEQRA Rules and Regulations, 6NYCRR 617.1 et. Seq.; and,
WHEREAS, the Town of Southold is the only involved agency pursuant to SEQRA Rules and
Regulations; and,
WHEREAS, the Town Board of the Town of Southold accepted the Short Environmental Form
for this project that is attached hereto; now,therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby finds no significant impact
on the environment and declares a negative declaration pursuant to SEQRA Rules and
Regulations for this action; and, be it further
RESOLVED that the Town Board of the Town of Southold hereby elects to purchase a
development rights easement on agricultural land owned by Walker/McCall, LLC and McCall
Family Holdings Limited Partnership LLLP, identified as SCTM#1000-116.-1-10. The proposed

§ 260-18 Additional parking regulations.

A. No person shall double-park a vehicle on any Town highway or roadway.
B. No person shall park a vehicle in whole or part on a sidewalk located adjacent to a highway.
C. No vehicle shall be parked upon any public highway or roadway without first being
registered and inspected pursuant to the Vehicle and Traffic Law of the State of New York.
D. On a one-way roadway, vehicles shall be parked facing in the direction of authorized traffic
movement; on a two-way roadway, such motor vehicle shall be facing in the direction of
authorized traffic movement on that portion of the roadway on which the vehicle rests.
E. No person shall park a vehicle so as to obstruct any driveway except with express
permission of the owner.
F. In an established or designated parking area, a vehicle is to be wholly within the markings

§ 260-27 Pedestrian Crosswalks
A. Purpose. The Town Board of the Town of Southold finds that, with the increasing
development and population of the Town of Southold, transportation activities are
increasing and impacting the local streets. Regulation of pedestrian traffic on local streets is
necessary so as to provide for the safety and welfare of the Town's citizens and for the
orderly flow of vehicular and pedestrian traffic on busy local streets.
B. There shall be a pedestrian crosswalks at the following locations:

more than 15 days, or by both such fine and imprisonment.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided

COUNCILMAN GHOSIO: NOTICE IS HEREBY GIVEN that pursuant to the provisions of
Chapter 17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands) of the Town
Code, the Town Board of the Town of Southold hereby sets Tuesday, June 1, 2021, at 4:30 p.m.,
Southold Town Hall, 53095 Main Road, Southold,New York as the time and place for a public
hearing for the purchase of a development rights easement on property owned by
Walker/McCall, LLC and McCall Family Holdings Limited Partnership LLLP. Said property is
identified as SCTM#1000-116.-1-10. The address is 21657 Main Road (NYS Route 25) in
Cutchogue. The property is located in the Agricultural-Conservation (A-C) Zoning District and
is situated on the southerly side of Main Road (NYS Route 25) approximately 1063 feet easterly
from the intersection of Locust Avenue and Main Road (NYS Route 25). The proposed
acquisition is for a development rights easement on a parcel consisting of approximately 7.78±
acres. In conjunction with the purchase of the development rights easement, an adjacent parcel
known as 21380 NYS Route 25, Cutchogue,NY and designated as SCTM#1000-109.-1-37 will
be subject to a Declaration of Covenants & Restrictions, including a requirement that the parcel
remain permanently attached to the farm. Upon closing, the Declaration of Covenants &
Restrictions will be recorded simultaneously with the Development Rights Easement.
The exact area of the acquisition is subject to a Town-provided survey acceptable to the Land
Preservation Committee and the property owner. Community Preservation Funds will be used to
acquire the easement plus acquisition costs. The purchase price is $65,000.00 (sixty-five
thousand dollars) per buildable acre, estimated at $505,700 (five hundred five thousand seven
hundred dollars) for the 7.78± acre easement. Purchase price will be adjusted at time of closing
based on final survey acreage detennination, plus acquisition costs. The landowner has offered to
sell the development rights to the Town at a purchase price below the fair market value indicated
in the Town's commissioned appraisal and the landowner may be eligible to claim a bargain sale.
The property is listed on the Town's Community Preservation Project Plan as property that
should be preserved due to its agricultural value.
FURTHER NOTICE is hereby given that a more detailed description of the above mentioned
parcel of land is on file in Land Preservation Department, Southold Town Hall Annex, 54375
Route 25, Southold,New York, and may be examined by any interested person during business
hours.
I do have a copy of the public notice and affidavit of publication in the Suffolk Times and on the Town
Clerk's bulletin board. I have a letter from Melissa Spiro, the Land Preservation Coordinator: "As noted

in the hearing notice,the 7.9 acre farm is located in Cutchogue. The town is purchasing development
rights using Community Preservation Funds. The map shows the location of the property,the area of the
development rights easement acquisition and the development area. Light green indicated the town PDR
properties and dark green indicates county PDR properties. Further to the east, in blue, is town owned
open space known as Down's Farm Preserve. The landowner, Russ McCall, is well known to the town as
he has sold development rights before and has helped to facilitate the preservation of other lands. The
preserved farms to the east and west of the subject farm are owned by the McCall family. The subject
farm is 7.8 acres, smaller than typical farmland development rights acquisitions,however,preservation of
this farm connects 2 existing preserved farms and results in a block of just under 120 acres of preserved
farmland. The Land Preservation Committee and the Town Board supported the project with a
development area and as part of the acquisition, the separate tax parcel shown on the map as a
development are will be restricted in a manner that requires it to always remain attached to preserved
farmland. The landowner has offered the development rights to the town at a purchase price below that of
the town's appraisal. The Committee and I would like to thank him for doing that and also to extend
additional thanks for his past and most likely future participation in conservation efforts. The Land
Preservation Committee supports this acquisition as presented and recommends that the Town Board
proceed with this acquisition.'

registered and inspected pursuant to the Vehicle and Traffic Law of the State of New York.
D. On a one-way roadway, vehicles shall be parked facing in the direction of authorized traffic
movement; on a two-way roadway, such motor vehicle shall be facing in the direction of
authorized traffic movement on that portion of the roadway on which the vehicle rests.
E. No person shall park a vehicle so as to obstruct any driveway except with express
permission of the owner.
F. In an established or designated parking area, a vehicle is to be wholly within the markings

I have an affidavit of publication in the Suffolk Times and an affidavit notarized that this
appeared on the Town Clerk's bulletin board and town website. I do have a letter from the
Fishers Island Community Board. 'Dear All, We, the elected representatives of the Island
Community Board of Fishers Island write to you in support of the application of two crosswalks
at the intersection of Oriental Avenue and Montauk Avenue scheduled to be considered at public
hearing on June 1, 2021. Two stop signs on Oriental Avenue at that intersection were approved
by the Town Board at the August 25, 2020 and put in place by the Highway Department shortly
after. The Fishers Island community appreciates the enhanced safety that these stop signs have
procured. Since then, the extension of the recreation path from Wilderness Road to the above
mentioned intersection has been constructed, and is nearly completed. The community also
appreciates the support of the town in the obtention of the authorizations necessary to make this
path a reality. It provides important safety for the walkers, baby strollers and bicyclists who are
already using the path and whose numbers will increase in the coming months. The two
crosswalks which the town board is reviewing at its forthcoming public hearing are the logical
complement to the stop signs authorized last year. We have attached to this letter the layout of
these crosswalks proposed by the project manager for the recreational path extension. They will
channel walkers and baby strollers wishing to continue west toward the post office to the left side
of Oriental Avenue and channel bicyclists going in the same direction to the right side of
Oriental Avenue. Similarly, they will channel walkers, baby strollers and bicyclists wishing to
proceed north on Montauk Avenue to the appropriate sides of Montauk Avenue. Without these
crosswalks,the traffic coming from the recreational path and going across Oriental Avenue and
Montauk Avenue will be hazardous. The proposal for these two crosswalks has been reviewed at
the location and approved by the foreman of the Fishers Island Highway Department, Louisa
Evans, Town Board member and a representative of the Island Community Board. We urge the
Town Board to approve these two crosswalks and to request that they be painted before the

arrival of peak summer traffic.' That's all I have.

KAREN WALLACE: Karen Wallace, Mattituck. Some people refer to Southold code
enforcement as uneven or selective. From our vantage point here in Mattituck, it is non-existent.
Over the past several years the Town of Southold has ignored code violations on the neighboring
properties that have threatened our quality of life and our personal safety. To deal with some of
these matters in the absence of code enforcement, we have gotten assistance from a detective
from the Suffolk County district attorney's office, an investigator from that office, an
enforcement officer from the NYS DEC and attorneys from the Department of Agriculture. All
of this has also required that we spend thousands of dollars, of our own money, for legal
representation. Both of our sons are disabled and need all the time and money we have to give
them. The fact that the Town of Southold requires us to use our personal resources to do its job is
appalling, deplorable, corrupt, unethical and immoral. At your October 2020 meeting,
Supervisor Russell said the Harbes operation was in complete compliance with New York City
Agriculture and Market laws in response to a question about agritainment activities and said that
he would seek that opinion in writing from the Department of Agriculture. In a few subsequent
emails, lie said he would seek written guidance from the Department on the Harbes agritainment
activities. Southold has not communicated with the Department of Agriculture about the Harbes
activities but we knew in October that they wouldn't. There has been no communication because
there can't be. The town already knows the answer it will receive. Southold has been protecting
the Harbes business enterprise in Mattituck for years because the business cannot exist as a
family friendly attraction with an agriculture themed amusement park without it. When the
Supervisor misleads us with statements like he made last Ocotober, he misleads all the residents
of Southold and he misleads you, Town Board. In fact, he is not only misleading you, lie is
misleading residents on your behalf because at these meetings he speaks for the Board. Jim, you
ran on a platform that includes statements like, if I am reelected some of my goals will include
working toward a solution of the pumpkin traffic and finally defining what a farm operation is
with respect to zoning. I think you made that statement, Jim, because I listen to many of these
meetings and have enormous amount of respect for your years on the ZBA and you know that
traffic is a direct outcome of zoning. Bob, your platform including issues of traffic and working
to keep people safe and maintain residents quality of life and Sarah, you ran on some issues of
Southold Town Board Regular Meeting

selective enforcement of(inaudible). Town Board, please show the people that voted for you
that you deserved their vote. All the residents of Southold have had enough of this town's
protection operation. It's dangerous, deplorable and ill-advised, especially from your perspective
because it makes you all irrelevant. We aren't going anywhere, even though I am enraged and
demoralized to live in a community whose government blatantly puts the interests of some
business owners over those of its residents. We'll be back because we will see this thing through
to the end that it justly deserves. Thank you for your time.
SUPERVISOR RUSSELL: Just to give you an update, we actually met with the Harbes family,
they have since engaged an attorney,the attorney representing the Harbes family is in
discussions with the Southold Town Attorney and New York State Department of Agriculture
has been contacted and I can't comment further because again, with the attorneys being
represented on both sides.
MS. WALLACE: I understand that it is a legal matter, I would appreciate it if the town dealt
with the Harbes but with arms length and treated them as if they are any other business in this
community because clearly that has not been the case and it is a disservice to the 21,000 people
or so that live here. It is dangerous and it is deplorable.....
