OFFICE LOCATION: OF Soft MAILING ADDRESS: Town Hall Annex P.O. Box 1179 54375 State Route 25 Southold, NY 11971 (cor. Main Rd. &Youngs Ave.) Southold, NY 11971 G • Telephone: 631 765-1938 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To. Glenn Goldsmith, President Town of Southold Board of Trustees From: Mark Terry, Assistant Town Planning Director - - - --- - -- LWRP Coordinator-- ------- Date: - --Date: , March' 12;•2021 Re: LWRP Coastal Consistency Review for JJS EDGEWATER LLC, c/o SCOTT EDGETT SCTM 1000-123-8-11.3 Jeffrey Patanjo on,belialf=of•JJS-EDGEWATER LLC-, c/o SCOTT=EDGETT requests afWetland Permit to remove and replace existing 89 linear foot long and;60 linear foot long jetties in same location with new vinyl jetties; and new jetties to be no higher than 18" above existing sand elevation. Located: 610 Park Avenue Extension, Mattituck. SCTM# 1000-123-8-28.6 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that ; the action is INCONSISTENT with Policy Standards 4, and 9 and therefore is INCONSISTENT with the LWRP. Policy 4.2-Protect and restore natural protective features. D. A limited interference with coastal processes may be allowed where the principal purpose of the structure is necessary to: 1. simulate natural processes where existing structures have altered the coast 2. provide necessary public benefits for flooding and erosion protection __3. provide for the efficient operation of water-dependent uses There is no doubt that the shoreline of this area has been altered. The function of the jetties is questionable when looking at the geography of the beach over the years. In 1984 aerial photos show that the beach did not have jetties and the beach appeared stable. Policy 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. Policy 9.4 Assure public access to public trust lands and navigable waters. A. Provide free and substantially unobstructed passage along public trust shorelands. The proposed jetties would impede public access along the shoreline. The application does not show the mean high tide line in relation to the proposed jetties on the shoreline. The 18' maximum elevation of the jetties above grade is an impediment to the public walking along the foreshore. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
