RILEY, JR. 2002 FAMILY GST TRUST, c/o ELLEN RILEY, TRUSTEE SCTM# 1000-111-5-7.2 Frederick Weber, Architect on behalf-of JAMES P.',RILEY,: JR. 2002 FAMILY GST TRUST, c/o ELLEN RILEY, TRUSTEE requests a Wetland Permit to revise the existing driveway, patios and paths consisting of a 167sq.ft. screen porch; a 175sq.ft. roofed patio (replacing existing 2nd floor deck); 147sq.ft. raised patio (replacing existing 1 st floor deck); 40sq.ft. spa; 148sq.ft. spa terrace; revise the driveway and parking area for a total of 2,887sq.ft.; remove existing sanitary system on seaward side and install a new I/A sanitary system on landward side and greater than 100' from surface water; new 184sq.ft. patio at cottage entrance; 391 sq.ft. of walk and steps; 1,1'25sq.ft. entertainment patio with 51 sq.ft. outdoor kitchen; retaining wall, a.210sq.ft. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standard 6 and therefore is INCONSISTENT with the LWRP. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. The construction of structures proposed seaward of the required 100' minimum setback from a wetland is unsupported. Structures within this setback area should be relocated, or if that is not possible; be minimized. It is recommended that the Board clarify the size of the stair landing. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
