at toe of existing bluff; installation of terracing consisting of 2"x12" un-treated timber boards with un-
treated timber 2"x4" stakes every 8' along the face of the disturbed bluff; planting of entire disturbed
bluff with Cape American beach grass plugs 12" on center; install 10'x19' platform on-grade at top
of bluff with 4'x12' walkway leading to 4'x6' steps to 4'x6' platform to 4'x22' steps to 4'x6' platform to
4'x41' steps to 4'x6' platform to 3'x10' aluminum retractable steps to beach; all decking to be un-
treated; a temporary silt fence will be installed surrounding the at-grade 10'x19' platform during
construction to prevent any sediment from leaving the immediate work area until stabilized; ar)d ;
landward of the top of bluff is selective tree clearing as required to remove deceased or.dead trees

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of 04
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action (except the construction of the rock revetment and stabilizing the bluff) is
INCONSISTENT wiftthe Policy Standards,an'd therefore is INCONSISTENT with'thd.LWRP based
upon:

6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
A 25' wide Non-disturbance buffer landward of the crest of the bluff was created
by Covenant and Restriction L.D00012585 P.978 in 2009.
The clearing of trees, construction of a platform and accessing the stair within the
25' Non-disturbance Buffer is not permissible. Further, the bluff in this location is
unstable and highly erosive the construction of an access stair is inconsistent
with polices 4 and 6.
The rock revetment and stabilizing the bluff is recommended as CONSISTENT. In the event
the revetment is approved, rocks that naturally occur on the beach or in public ownership
should not be used in construction.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

A. INSTRUCTIONS Planning Board
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Townl
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
suapportina facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions,it shall not be undertaken.
