Located: 10335 Nassau Point Road & Off Nassau Point Road, Cutchogue. SCTM# 1000-119-1- 14.1 & 14.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to'this department, as well as the records available to me, it is my recommendation that', the action is INCONSISTENT with Policy Standards 4, 6, and 9 and therefore is INCONSISTENT with the LWRP. Policy 4.1 Minimize loss of life, structures, and natural resources from flooding and erosion. B. Use vegetative,non-structural measures to manage'flooding and erosion hazards. -The installation of the fence does nofineet thi§policy. Vegetative, non- structural measures are not proposed. Policy 6.4 Protect vulnerable fish, wildlife, and plant species, and rare ecological communities. The installation of the fence does not meet this policy. Fences impede wildlife movement in natural environments. Policy 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. r Photos one and three submitted in the application shows the high tide wrack line landward of the fence location in the photos. Beach areas seaward of the high tide line are held in public trust. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
