SCTM# 1000-75-6-3.3 The proposed action has been-reviewed to Chapter-268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. 1. The pool (structures) is partially located outside of the building envelope approved on a filed subdivision plat knowh as the Standard Subdivision of John Scott SCTM#1000 75.-6-3. Locating structures outside of the building envelope is not permissible. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The proposed project has also been submitted to the SCDHS and to the NYDEC. The SCDHS has reviewed and approved the plans contingent on a NYSDEC permit and a Town of Southold Board of Trustees letter of non jurisdiction for the primary residence and a permit approval for the pool and cabana. I would like to request the appropriate documentation from the Board to submit to the SCDHS. We have recently updated the property survey and have flagged and located the wetlands as requested by the NYSDEC on December 1, 2020. A stakeout of the proposed pool, cabana and main residence was done on 12/06/20. The proposed project will be situated on a 2.273 acre parcel zoned R-80, with a net area of 2.044 acres, adjoining Richmond Creek to the east.The property survey shows elevations (NAVD88) ranging from el. 9.0 (front property line),to el. 1.0 along Richmond Creek.The proposed pool and pool cabana will be located between el.7.0 and 6.5 and will have a first floor finished elevation at el.7.50 for the pool patio and 8.50 for the cabana.The cabana will have an semi-enclosed space, a water closet and outdoor shower. A drywell (DW5) will be dedicated to the pool as shown on the plans. A 4 foot high fence will enclose the pool area as required by NYS code.
