En-Consultants on behalf of RONI JACOBSON & DAVID FELDMAN-requests an'Administrative Permit to remove and replace (in-place) 218 sf grade-level masonry patio beneath existing second- floor porch to remain, construct 30"-ht x 11' Ig retaining wall adjacent to patio, and repair/cosmetically renovate porch (e.g., replace/reinforce ex. support posts/deck frame, replace siding and screen panels); remove existing retaining wall, excavate approx. 135 cy of soil material to lower existing grade adjacent to dwelling by approx. 5 ft, install 380 sf sunken masonry patio with approx. 37 If of 18"-high masonry curb and paver steps, and install drywell to collect patio runoff; construct 200 sf grade-level masonry patio in place of ex. 280 sf patio; construct +3' x 14' 2-story addition in place of existing bay window (adjacent to 100' wetlands setback); and establish 12' —26' wide, approx. 1,770 sf non-turf buffer in place of existing lawn adjacent to bulkhead. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the following ins considered to further Policy 6. Require that the non-turf buffer be planted with native, salt tolerant vegetation. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR RONI JACOBSON&DAVID FELDMAN 4680 WUNNEWETA ROAD CUTCHOGUE,NY SCTM#1000-111-14-36.6 POLICIES 5& 6 The project consists of renovations proposed substantially within the footprint of existing structures, located no closer than the existing minimum wetlands setback of 67 feet between the bulkhead and existing dwelling structure, including ordinary repairs to and cosmetic renovation of a Trustees-permitted second floor porch and in-place replacement of the grade-level patio beneath it (see Wetlands Permit No. 5330); a new 380 sf sunken masonry patio adjacent to a dwelling addition/alteration on its landward side, which is situated outside Chapter 275 jurisdiction (see Trustees jurisdictional determination dated 11-23-20); a 39 sf 2-story addition in place of an existing 24 sf bay window, which is situated adjacent to but physically landward of the 100' wetlands setback; and replacement of an existing 280 masonry patio with a smaller, 200 sf patio. The project will thus result in a net increase in total patio area of 300 sf with no additional encroachment on the existing, previously permitted wetlands setback; and a nominal net increase in dwelling footprint of 15 sf, thus leaving Town-defined lot coverage effectively unchanged. However, to mitigate any potential project impacts, the new patio area will be equipped with a drywell-connected drainage system to collect and recharge surface runoff, and a 12' to 26' wide, approximately 1,770 sf non-turf buffer will be established in place of existing lawn area adjacent to the bulkhead. Therefore, the project will not have any significant adverse impacts on the adjacent tidal wetlands or waters of Wunneweta Pond. See attached narrative jointly addressing Policy 5 and Policy 6.
