275sq.ft. with a setback of 14.5'; the infinity edge trough of the swimming pool was removed from
the plan; the pool area was decreased from 740sq.ft. to 640sq.ft. but there is also 130sq.ft. of pool
coping not previously proposed; the total pool area is 820sq.ft. which is an increase of 80sq.ft. with
an increase of wetland setback from 21' to 23'; the pervious driveway was reconfigured, decreasing
its area by 165sq.ft.; the pool equipment has been moved to outside the Non-Turf Buffer Area; the
-- --HVAC-equipment area-decreased-from 43sq.ft.to--15sq.ft.;-the total-impervious-upland-lot-coverage
of the property, as defined by the NYSDEC increased by 272sq.ft., from 4,311 sq.ft. to 4,583sq.ft.; .
expand the Non-Disturbance Buffer Area by an additional 125sq.ft., increasing it from 8,860sq.ft. to
8,985sq.ft.; when reviewing the approved permit, note that the expansion that was proposed as part
of Permit No. 9433 had increased the area of revegetation to be made into Non-Disturbance Buffer
Area by 980sq.ft., that increase is not 1,105sq.ft; the area of the Non-Turf Buffer Area will be
increased by 65sq.ft. from 1,200sq.ft. to 1,265sq.ft.; between the Non-Disturbance Buffer Area and
the Non-Turf Buffer Area, the site will have 10,250sq.ft. of preserved area, which is more than
double the area of impervious upland lot coverage. Located: 1085 Bay Shore Road, Greenport.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the
LWRP due to the following:
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws
and regulations for all Andros Patent and other lands under their jurisdiction.
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
In 2000 the Board of Trustees issued Wetland Permit 5238 for a similar action. A condition
in the permit required a 40' wide non-disturbance buffer adjacent to the tidal wetland line.
In 2019 a second permit (9433) was issues on the parcel that included revegetation and
expansion of the non-disturbance buffer but ultimately reduced the width of the non-
disturbance buffer.
The purpose of the non-disturbance buffer is to protect the Pipes Cove Creek and Moore's
Drain Significant Fish and Wildlife Habitat Area which this parcel abuts. Habitat
modifications which substantially change the natural character of the area, such as
residential...developments could have a significant impact on many wildlife species in the
area.
It is recommended that a pool de-watering well is identified. The limit of clearing grading
and ground disturbance...line overlaps the 102 sq. ft. revegetation area of the existing non-
disturbance buffer.
The 28.3' setback to the wetland where 50' is required for the pool and related structures is
unsupported in this ecologically sensitive area.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the.proposed action.

A. INSTRUCTIONS Board
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town)
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's
website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all
local libraries and the Town Clerk's office.

The applicant seeks to amend Southold Town Trustees Permit No. 9433. The following changes
are proposed:
1. Expansion of the footprint of the proposed pool terrace into the footprint of the existing
house that was demolished. The stairs leading off the pool terrace have also been moved
and additional stairs had to be ad e .
