Main Rd. &Youngs Ave.) ' Southold, NY 11971 G • Telephone: 631765-1938, LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, AICP LWRP Coordinator Date: January 15, 2021 Re: Local Waterfront Revitalization Program Coastal Consistency Review for LAUREN PRAUS & MARK SCHWARTZ SCTM# 1000-104-9-5 Michael Kimack on behalf of LAUREN PRAUS & MARK SCHWARTZ requests a Wetland Permit to reface approximately 265 linear feet of existing bulkhead with 2"x10" composite boards with 2"x3' ledgers and 2"x12" douglas fir cap; remove 28.5 linear feet and 67 linear feet of existing bulkhead in two (2) locations; construct 34 linear feet of new vinyl bulkhead in place of removed bulkheading along -------- -- easterly side of property; remove approximately 1-5 cubic yards-of-fill,--prepare sub g_r de7slope frorh fop of bulkhead to shoreline; place approximately 7 cubic yards of clean course sand on the sub base'to create extension of beach line from neighboring property; install two (2) 8" diameter double set dauphin pilings for anchorage where 67 linear feet of bulkhead removed; construct a 4'x16' (64sq.ft.) fixed dock; install a 3'x14' (42sq,ft,) aluminum ramp; install a 6'x20' (120sq.ft.) floating dock with six (6) 8" diameter piles and one 8" diameter double set daupkin piling. Located: 1360 Broadwaters Road, Cutchogue. SCTM# 1000-104-9-5 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed bulkhead work is CONSISTENT with the LWRP. The proposed dock is INCONSISTENT with the below listed LWRP policies and therefore is INCONSISTENT with the LWRP: Aerial photos show an existing dock against the bulkhead and a jet ski dock already occurring on the parcel. The proposed dock is not permissible pursuant to Chapter 275. Wetlands and Shoreline Article II. Permits § 275-11. Construction and operation standards. (c) Regulations for the placement and configuration of docking facilities. [1] Residential docks. (Amended 10-11-2005 by L.L. No. 17-20051 [a] Only one catwalk may be permitted per residential lot. Only one mooring or dock may be permitted per residential lot. Upon a showing of special need due to low water level and hazard to property, the Trustees may permit both a mooring and a dock for the same residential property. Policy 6 Protect and restore the quality and function of the Town of Southold ecosystems The applicant has not demonstrated that the following dock standards pursuant to § 275- 11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: j21 Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependent activities; Private dock structures extending into public waters decreases the public use of bottomlands and the nearshore area. [5] Whether the dock will cause degradation of surface water quality and natural resources; The action is proposed to be located within a New York Department of State Significant Coastal Fish and Wildlife Habitat Area - CUTCHOGUE HARBOR AND WETLANDS. The construction of dock structures in these areas results in the loss of littoral and marine habitats. The COASTAL FISH &WILDLIFE HABITAT ASSESSMENT FORM states that: "Elimination of salt marsh and intertidal areas, through dredging, loss of tidal connection, excavation or filling, would result in a direct loss of habitat area. Construction of shoreline structures such as docks, piers, bulkheads or revetments, in areas not previously disturbed by development(e.g., natural beach or salt marsh) may result in a loss of productive areas which support the fish and wildlife resources of Cutchogue Harbor Area. Unrestricted use of motorized vessels including personal watercraft in the protected, shallow waters of bays, harbors, and tidal creeks can have adverse effects on aquatic vegetation and fish and wildlife populations. Use of motorized vessels should be controlled (e.g., no wake zones, speed zones, zones of exclusion) in and adjacent to shallow waters and vegetated wetlands." [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. This information has not been provided. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The extending of the dock structure will result in a net decrease in public access to public underwater lands. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed actions.
