Town Clerk Southold Town Board Regular Meeting May 4, 2021 page 4 Enact Local Law Chapter 280- Corner Lots WHEREAS,there has been presented to the Town Board of the Town of Southold, Suffolk County,New York, on the 23"' day of March, 2021, a need for amendments to the zoning code; and WHEREAS, it has been presented a Local Law entitled "A Local Law in relation to an Amendment to Chapter 280, ZoninjZ" and WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid Local Law at which time all interested persons were given an opportunity to be heard,NOW THEREFOR BE IT RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local Law entitled, "A Local Law in relation to an Amendment to Chapter 280, ZoninJZ" reads as follows: LOCAL LAW NO. 2021 A Local Law entitled, "A Local Law in relation to an Amendment to Chapter 280, Zoning". BE IT ENACTED by the Town Board of the Town of Southold as follows: I. Purpose. The purpose of this local law is to address issues concerning corner lots. II. Chapter 280 of the Code of the Town of Southold is hereby amended to include the underlined words and remove the struck through words as follows: § 280-4 Definitions. LOT, CORNER A lot situated at the junction of and abutting fronting on two or more ifiter-seeting streets ,.here the interior- angle o f inter-seetior does not emixeeed 135°-A lot abutting a curved street shall be deemed a "corner lot" if the tangents to the curve at the points of intersection of the side lot lines with the street lines intersect at an interior angle of less than 135°. YARD, PRIMARY FRONT For principal structures located on corner lots, that portion of said corner lot which has frontage upon one of the streets on which the lot is located and is identified as the primary front yard on plans or by physical layout. YARD, REAR An unoccupied ground area fully open to the sky between the i:ear-let line and a line drwiAm ^Falle +heron the same lot with a building or structure extending the full width of the lot and situated between the rear line of the lot and the rear line of the main building_or structure projected to the side lines of the lot. The depth of the rear yard shall be measured between the rear line of the lot and the rear line of the main building or structure In the case of corner and through lots as defined in this chapter, the rear lot line shall be opposite the primary front lot line. YARD, SECONDARY FRONT For principal structures located on corner lots that portion of a corner lot which has frontage upon one the streets on which the lot is located and which not identified as the primary front yard, shall be deemed the secondary front yard. YARD, SIDE An unoccupied ground area fully open to the sky between any pert , line other than a street „ rear-lot line and a line drawn parallel thereto between the ftepA arear-yaf,7 on the same lot with a building or structure, extending from the rear line of the front yard to the front line of the rear yard and situated between the side line of the main building or structure and the adjacent side line of the lot. In the case of corner lots as defined in this chapter, lot lines opposite a secondary front lot line shall be deemed a side yard and shall have a minimum width equal to the minimum side yard requirements of the zoning district in which located. § 280-105 Height of fences,walls and berms. Fences, walls or berms may be erected and maintained, subject to the following height limitations: A. When located in the front yard of residential zones, the same shall not exceed four feet in height. When located in the front yard of nonresidential zones, the same shall not exceed six feet in height. B. When located in or along side and rear yards, the same shall not exceed 6 1/2 feet in height. C. When located in or along a secondary front yard the same shall not exceed 6 1/2 feet in height and shall be set back from the secondary front yard line no less than 10 feet. DE. In residential and nonresidential zones; except properties/parcels engaged in bona fide agricultural production, the installation of a deer exclusion fence may be permitted by obtaining a building permit issued by the Building Inspector, subject to the following criteria: (1) When located in or along side and rear yards, the height of the deer exclusion fence shall not exceed eight feet. (2) When located in or along a secondary front yard the height of the deer fence shall Southold Town Board Regular Meeting May 4, 2021 page 6 not exceed eight feet in height and shall be set back from the secondary front yard line no less than 10 feet. (2(3) Specifications for construction of deer exclusion fences: (a) Fencing fabric: high-tensile, woven wire fence fabric with graduated opening. (b) Spacing between posts: 20 feet. (4) Deer fencing is prohibited in or along the front yard or primary front yard of any property. § 280-106 Corner lots. On all corner lots, berms, walls, fences and hedges or any other potential obstruction to vision shall not exceed a height of 2 1/2 feet above the average street level within an isosceles triangle having thirty-foot sides along each street to preserve sight lines for traffic. § 280-124 Nonconforming lots. A. This section is intended to provide minimum standards for granting of a building permit for the principal buildings of lots which are recognized by the Town under § 280-9, are nonconforming and have not merged pursuant to § 280-10. B. SEVERABILITY If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. IV. Unidentified UNIDENTIFIED: So what is the status of resolution 374 at this point? COUNCILWOMAN DOHERTY: We approved it. UNIDENTIFIED: Does that mean that there's another hearing or it's enacted into law? SUPERVISOR RUSSELL: What we did was the original proposal was withdrawn by the Town Board. We had public input, we thought the public input had merit so we made some changes to the code because we did that, we have to re-notice that and have another public hearing. UNIDENTIFIED: Okay, so there's another public hearing on June 15. Okay, I got it. So this is not law until June 15 at which point, will it be, if there are no public objections on June 15; will it go into law? COUNCILWOMAN DOHERTY: If there are no objections, we might approve it that day but it doesn't go into law until it's filed with the state, so it takes a couple of weeks. UNIDENTIFIED: Okay, so sometime in July, potentially July it would go into effect. SUPERVISOR RUSSELL: I would say mid to late July. Robert Dunn ROBERT DUNN: Can you hear me? Over the weekend, you will recall Scott, that there was a story on social media where two people wanted to close down the roads coming into town with a tax? And you kind of explained that they couldn't do that. SUPERVISOR RUSSELL: That's right. MR. DUNN: I don't really see a problem, as much a problem with the people that come in to the town as what we let them do. Whether it is a business or a building, I just don't think we are enforcing the codes that exist to keep our town from going bad. Now I grew up in the city, I grew up in eastern Queens and I saw that happen. I am going to give you an example, Greenport Brewery, there are lot of people that are unhappy, I don't mind it two days a week. You know, you have got to live with it, they also pay taxes and every dollar they pay, we don't have to pay. But what I am upset with is I believe they had to file a site plan, correct? SUPERVISOR RUSSELL: Yes. MR. DUNN: Well, that site plan, I guarantee it did not include two containers, stacked, out by the curb on unstable ground. They are cantilevered, they are dangerous and they are taking up parking spaces allotted for the cars, so now the cars are parked along the street. The same thing goes for piles and piles of beer barrels that they have all over, filed as their parking area. and now the people are parked up and down the road on their busy days. One of the nearby wineries had to put up hay bales to keep them from riding into the vines. That's just not right. That's a Vineyard 48 waiting to happen all over again. What do we need, bodies on the Main Road? I mean, we had someone who was in here and as you know, I was in here, and he was here for two years complaining about Vineyard 48, nothing happened. Four people died. Then we got action. Now the truth is, I should be taking this to our code enforcement but I kind of lost comfort in that. There's a house down here that was purchased last September, and they immediately started clearing land, including some town land. And then they put up a fence across, town land, I notified, well, I talked to them three times about it, well, I talked to their contractor but there was no response, that's what they told me to do, that's what I am doing. I then called code enforcement and they showed up immediately but I was really surprised by their answer. You sure you really want to do this? This is going to cause a lot of problems. I don't really care what problems I cause for people who are paid to do things. They should do it. That was in October. Seven months later there is still a fence across town property, at the right of way and the fence is, even if it wasn't on town property because it's a corner property. And you can't, you have that 30 foot rule, that intersection, within a couple of weeks be one of the busiest intersections in town. Inaudible. It's horrible, I just, I don't know what to say about it anymore. I've had; I've just got complete indifference for code enforcement, entirely. One excuse after another. Can somebody tell me what's going on there? Southold Town Board Regular Meeting May 4, 2021 page 42 SUPERVISOR RUSSELL: There's two issues. First what we will do, is we will send the issue with regard to the brewery to code enforcement on Monday, to check for compliance with the site plan. There was actually two site plans, one was the original brewery and one for the additional restaurant. What we will do is we will send code enforcement out to make sure there is compliance with the site plan. Secondly, I am familiar with the other issue you talked about, you and I talked about it a few times. I think I shared your frustration. MR. DUNN: Right. SUPERVISOR RUSSELL: There was a few instances where there was adjournments in court that I felt like dragged the issue out, if I am not mistaken. MR. DUNN: I was told, January 15 he was in court and he was ordered to take the fence down. It is now May 4. SUPERVISOR RUSSELL: I was told something similar but then I was also told that it had been adjourned, I think at the defendants request. I will confirm that tomorrow but I will go sit in that office tomorrow(inaudible) because I am familiar with it. I have to say I agree with you 100 percent with regard to blocking town property. We cannot accept that anymore. MR. DUNN: You know, it's an issue about safety, it's an issue about decorum, it's an issue about aesthetics, once you clear the woods, it's just breathtaking at times. I get people all the time telling me, I do a lot of work on the street and I get people all the time telling me this place is so beautiful. This guy is taking 100 trees to block the residents off from his property that can't be allowed to stay, we just can't have that because if we do that we are setting an example that people can do this, and I am telling you that people from the city, I am one of them myself, are going to come out here and continue to do that. You won't be able to keep up with it. Right now, if there was an accident there, the town would be liable because it is breaking it's own code. Just doesn't work. It just doesn't work. I got a lot more, I just, I don't want to beat it up but if these people aren't going to get real, these are all people that are not competitive positions, correct Scott? SUPERVISOR RUSSELL: Competitive class positions in terms of title? Civil service title? MR. DUNN: Off a list. SUPERVISOR RUSSELL: Yes, competitive class positions they have to be on civil service lists to take the test, yes. MR. DUNN: Okay. And once the original ticket in January was given; lie went into court and lie was ordered to take it down. You know what his reaction was? He went in and started non- conforming construction in the house, so that is number two. He had to be stopped. I don't know why a stop work order-wasn't issued on this property., They are out there working on it right now. It is a disgrace. I hope I made my point, it's sad. I could give you a personal story how uncontrolled development made a mess of my entire life, I am not gonna, it's sad. I mean, I am not going to let it go the way, Mr. Shipman who made the points on Vineyard 48, he warned you that this was an accident waiting to happen, and it happened. I am not going to be as patient as he was, if these things aren't corrected, somebody is going to have to answer for it. They are wrong. They shouldn't happen. Scott, regarding, and I haven't talked to you in a while but as a follow up to the last dredging, if you'll recall, you and I had a meeting with Peter Terranova several years ago about taking a new attempt at the dredging, well, since Jamie is gone and Michael was on vacation, Tim Abrams took care of the dredging and he followed Jamie's plans to the T which is exactly what Peter and I said you could do. The shoreline has moved 20 feet further out. So we are recapturing beach that we have been losing for years. SUPERVISOR RUSSELL: Right. MR. DUNN: It's the way to go with it. I will be glad to discuss is with anyone. I am really the only person who has a second story view of the Sound, I watch it every day. I know what this has done. And as long as I am commenting, Jim,you made a point about our new marijuana laws in the paper last week. I want to agree with it and I want to ask, do we allow cigarette smoking on town property? SUPERVISOR RUSSELL: That's a good question, I am sorry Jim. COUNCILMAN DINIZIO: That's alright. I don't know. MR. DUNN: Beaches? Parks? SUPERVISOR RUSSELL: That's a good question. I think we have legislation that was adopted as a requirement to the law several years ago with regard to smoking, a certain distance of public buildings. I am going to be candid, I don't know...... MR. DUNN: Well, here's what's going to happen. If New York State law, as it's put up regarding marijuana says you can smoke marijuana anywhere you can smoke cigarettes, so if you can smoke a cigarette at the beach, you can smoke a doobie. And that's gong to be a problem. We are going to have people.... SUPERVISOR RUSSELL: Robert.... MR. DUNN: You are going to have people sit down on the beach with kids and somebody and I am not judging anybody about what they want to smoke, that's their business, it's where they smoke it. You can sit down with your kids on the beach and three kids can come and sit next to you and start rolling joints. And there is absolutely nothing you can do unless it is illegal to smoke there. And that is something that has got to be considered, we have several town beaches, we have a bunch of open parks, we have hiking paths and again, I am not against anybody doing whatever they want to do, that's your business. it's a question of where we want to let them do it. Southold Town Board Regular Meeting May 4, 2021 page 44 SUPERVISOR RUSSELL: Actually, the Chief was here a two weeks ago, I'm going to agree with you 100 percent. I think the Town Board has no choice at this point but to designate all the properties as no smoking, if it's not already in the code. We couldn't find it but we should make sure it's in there, whether it's already in there or whether we need to adopt new legislation. But not on town properties, you are right. MR. DUNN: You are going to end up, it will be (inaudible). You know, a lot of that goes with drinking and partying, so we have got to establish where it can be and where it can't be. That's all. SUPERVISOR RUSSELL: We have a clear policy..... MR. DUNN: Clear policy, yeah. I hope all these, the two issues that I brought up to you can be taken care of because it's just, it's the kind of thing that's going to bring our town down. Someone has got to be responsible for it, I am not going to let it happen, I am not going to be a part of it and I hope you guys aren't too. Thank you. I mean, unless anyone has any comments. SUPERVISOR RUSSELL: I want to say something real quick, first I can agree with just about everything you say. With regard to drinking, there's clear policy that drinking isn't allowed on town property. The one thing I am going to take strong issue with is Vineyard 48. Vineyard 48, the town had taken assertive, ambitious action and brought all of the legal might that we could, with the state liquor authority to address that issue. It was a frustrating legal process that dragged out much longer than we wanted it to, there was court decisions we were disappointed in but we again brought all the legal might, resources financial and otherwise to address that issue. It took longer than we wanted it to, the SLA was frustrated, we were frustrated. The SLA was probably the strongest agency in New York State, they were frustrated as well because they weren't making as much headway as they wanted to. But I assure you, from the beginning we were as assertive as we could be legally. MR. DUNN: I agree, no I was there for the whole thing, I agree that you did everything that you could but the bottom line here is, it didn't get done. Whether it was the SLA, the county or whoever, I agree the town did everything, I am not at all casting doubt on what you guys did. You did the best you could. For a little tiny town in a big system and the big system didn't respond till four women were dead in that road. That's really the way I see it and it shouldn't happen here either. I mean, I could look to what happened at Soundview, what was that gentleman's name? I know have a$30,000 nitrogen system in my yard because of him. The fellow that got killed in front of Soundview. COUNCILMAN DINIZIO: Mr. Meinke. Howard Meinke. MR. DUNN: That was because that road was (inaudible) and that's what's happening here, on the end of Mill Lane at the entrance to a town beach. It's just a catastrophe waiting to happen. That's it for me. Thank you once again for your time. Southold Town Board Regular Meeting May 4, 2021 page 45 COUNCILMAN DINIZIO: Robert, I want to say one thing because you did bring up my letter, I think the entire law is a disaster and in no way ever smoked that, ever did it, I am not supporting it in anyway, I think that if we just don't give people a place to go to do this and if that's the only choice we have in my mind, it was a clever choice. It's making you opt out and giving people a safe place to go purchase and a safe place to go imbibe the stuff and it's politics 101. MR. DUNN: I agree with you 100 percent Jim. 100 percent. You are right, I mean, I am an old 60's hippie and I don't think that stuff should be forced on anybody and if you are on a beach, you don't want to partake in it, then somebody shouldn't be able to sit down next to you and partake in it and force you to partake in it or force you to move. You know, the same thing, I have gone to nude beaches. I wouldn't do it here, it's just not something we do. Thank you. SUPERVISOR RUSSELL: One thing, since you brought it up, I think there's a lot of public misunderstanding with regards to the limits of the authorities of the town. I think the public needs to understand that Southold Town does not have the right to decide if you can use, smoke and possess marijuana in the town or grow marijuana, that's a fait accompli. They are allowed to under New York State law. Southold Town has the very narrow authority to simply determine whether we would allow dispensaries and then what they call social clubs, smoking clubs, whatever or however they refer to it. That's our only roll. Everything else is, that's state law. The town does not govern any of that. I am not saying.... MR. DUNN: Inaudible, I am totally in agreement with, that will be boon for the farmers and with a huge market (inaudible), so it's not like they have to turn the town into something else. It will be controlled in greenhouses, I've seen the way they do it in California, it's amazing. But it's, I see a problem with it being on the streets, I really do. I think there are people that will get offended and it will lead to uncivil behavior, which we don't need. SUPERVISOR RUSSELL: VandeWetering farm in Riverhead just sold, it was released today for $42,000,000. That happens to be over$1,000,000 an acre. That was largely due to the license that was issued, it was bought by a very, very large corporation, investment corporation. My concern here is I think it demonstrates the licensing is going to be so limited, I just don't think it is going to help the local farmer, the mom and pop fanner anymore. The local operation. I think it's going to be dominated by large corporations. But again, it's legal, they issue the licenses and Southold has no ability to weigh in on that at all. We have very narrow authority. I just want the public to understand it. MR. DUNN: Very good. Thank you. Supervisor Russell SUPERVISOR RUSSELL: Thank you. Would anybody else like to address the Town Board? COUNCILMAN DINIZIO: I would just like to say something, number one, Holly and Bryan Weingart on their retirement, I wish them well. They spent plenty of time and lived quite a lifestyle with two people working different shifts. I think they did very well for the town, I want to congratulate them on finally retiring. And number two, I would just like to say this Southold Town Board Regular Meeting May 4, 2021 page 46 about an employee in your office, Michelle Tomaszewski, she went well over and above for me and the Police Advisory Committee to ensure that we had a zoom meeting that I couldn't attend, I had a funeral to attend and I just want to make note of Michelle and if there was some kind of award, I would give it to her. So I just want to thank her. SUPERVISOR RUSSELL: I was actually remiss in reading the resolutions for Holly and Bryan, I second everything you said. Two of the hardest workers I've ever had the pleasure of working with. I do wish them well but again they have left some very big shoes to fill, so thank you for pointing that out. Anyone else?
