SUPERVISOR RUSSELL: Please rise for the Pledge. Thank you. At this point, I am going to
ask anybody from the public that would like to comment on any of the agenda items to please
feel free at this time. I know we have a public hearing tonight, we will take comment regarding
that when we recess for public hearings.

PATRICIA MOORE: Thank you. I will be commenting on the code change because I do
support it and I appreciate and applaud you any time that you try to address issues that are
continually problems for the Zoning Board or end up with a lot of applications to the Zoning
Board. But I would ask, please, there is so much more that needs to be done. When the zoning
code was overlayed, our minimum zoning was one acre and that is presumed a 40,000 acre
parcel but we have all over town 1/8 an acre, 1/4 acre, 1/2 acre parcels in completely developed
neighborhoods. The town has never attempted to help people who have these small lots to be
able to develop them, improve them, renovate them without having to go to the Zoning Board.
It's very unfair, it's a very difficult process, very expensive and if you look at the agenda with the
Zoning Board, they are at least six months behind on applications, tremendously long
applications. I really urge you to please take a look at the code and all the variances that have
been,just the number of variances that the Zoning Board hears and see what the majority of
those variances are. I think that you are going to find that a lot of them are lot coverage
variances and setback variances that are particularly burdensome on small, undersized lots. In
addition, you added not too many years ago, a buildable lot definition in response to waterfront
properties that were being developed and the lot may be an acre or two but the buildable area
may have only consisted of a half acre or a quarter acre. Well, the town still uses a one acre
setback, a one acre regulation on lots where buildable area is half or a quarter of that. So you are
imposing automatically anybody trying to improve their property the obligation to go to the
Zoning Board of Appeals. That is,there is something wrong with our code and there is
something wrong with our town when we force everyone to get a variance. We should
encourage people to invest in their property. There has been a huge turnaround and I am sure
you see it, there has been a great demand for homes but quite honestly, the generation, my
husbands grandparents who bought the house, their house originally, now I am seeing that
generation is gone, the next generation is starting to retire and relocate and it's, I am actually on
the older side of the generation and my kids generation coming in and wanting to improve and
invest in properties. So I urge you please, take the time, make it your mission to update the code
and provide relief, right off the bat lot coverage on 1/4 lots, 20 percent is really unreasonable
when a 2 percent variance or a 2 percent request is 180 square feet and on a very small parcel the
Zoning Board forces applicants to bend over backwards to try to conform. Most recently, the
Zoning Board takes the position that well, if you have an existing house and even though you
may have 30 percent lot coverage and you want a renovation to an existing house, well, that's
okay, we will give you a variance but if you have a dilapidated house or a vacant lot in the same
neighborhood well, now you have got to maintain that 20 percent lot coverage. That's not fair.
The character of the community is such that it's over 20 percent but you are forcing a vacant lot
or a house that unfortunately cannot be saved to meet standards that the entire rest of the
neighborhood is not obligated to conform to. So, I have always made myself, I have offered over
and over again, I am happy to meet with the Board, I don't have particular clients in mind, I just
have continuous applications that are, in my opinion, sometimes completely unnecessary and
burdensome to property owners. So, that is my request, it is always a continued request and I am
hoping that at some point, a Board will take it upon themselves to make a correction and make it
fair for homeowners and property owners to improve their property with as little bureaucracy and
as much support from this town as is possible and I thank you.

SUPERVISOR RUSSELL: Thank you, Pat. Just a quick clarification, you are talking about the
building yield on a per parcel basis based on the upland buildable area, that was actually adopted
by a previous Board.
MS. MOORE: Oh, no, 1, yes it was other Board's but it's not, I have raised it over and over again
as something that needed to be corrected but it's been kind of falling on deaf ears, I point out the
deficiency and there is never any correction, so again, I applaud you when you do address a
problem, corner lot is a wonderful thing to address but I can tell you if you look at the calendar
of the Zoning Board, it's probably one of the simpler ones that they get, the ones that can be
resolved quickly but I think if you look at the number of variances that are requested, take a look
and see that they may be far more important ones to address that would eliminate a lot of
variances. You shouldn't have to wait six to eight months to get a decision for a zoning board,
that's, you know, imagine if you were trying to renovate your house and you have to wait six to
eight months to get an approval to replace a dilapidated deck or to put an addition for you know,
a child or your elderly parents or yourself. So it's very burdensome and very costly, so...

RESOLVED that the Town Board of the Town of Southold hereby approves a six month extension to the
terms of the agreement regarding Conifer Realty and Community Development Corporation of Long
Island's 30-year, deferred, zero interest loan in the amount of$250,000.00 from the Town of Southold
Housing Fund for the construction of affordable housing in connection with the site plan application
known as"Vineyard View"pursuant to section 34-6(E)of the Town Code and previously approved under
Resolution No. 2018-1016, subject to the execution of an agreement provided by the Town Attorney's
office.

Accept LKMA Proposal
Financial Impact: Conversion of Town Hall
WHEREAS, the Town Board of the Town of Southold has decided to retain architectural and
engineering consulting services to study the possible conversion of Town Hall to a justice court,
and;
WHEREAS, the firm L.K. McLean Associates P.C. ("LKMA") has previously provided
consulting services to the Town with regard to Town buildings and the requirements for a justice
court and therefore has extensive knowledge of the Town's infrastructure and justice court
requirements, and;
WHEREAS,the Town Engineer has requested and recommended that the Town Board waive the
Town's procurement policy requiring the Town to obtain three quotes and accept the proposal of
LKMA dated January 14, 2021, therefore be it;
RESOLVED, that the Town Board of the Town of Southold hereby waives the procurement
policy requirement of obtaining three quotes with regard to retaining professional consulting
services to study converting Town Hall to a justice court, and be it further;
RESOLVED, that the Town Board of the Town of Southold hereby accepts the proposal of
LKMA dated January 14, 2021 and authorizes and directs Supervisor Scott A. Russell to execute
a contract with LKMA to study the conversion of Town Hall to a justice court in amount not to
exceed $19, 877.50, subject to the approval of the Town Attorney.

Request for Speed Limit Reduction W. Mill Road
WHEREAS, the Town Board of the Town of Southold has received requests from residents for a
reduction of the speed limit from 35 mph to 30 mph on West Mill Road in Mattituck,New York
and Bay Avenue in East Marion,New York.
WHEREAS, the Town Board of the Town of Southold reviewed the requests and all relevant
information and has recommended that the speed limit on West Mill Road in Mattituck,New
York and Bay Avenue in East Marion, New York be reduced from 35 mph to 30 mph.
NOW THEREFORE, be it
RESOLVED that the Town Board of the Town of Southold pursuant to New York State Vehicle

County,New York, on the 201h day of April 2021, a need for a reduction of weight limits for
vehicles on certain Town roads; and
WHEREAS, it has been presented a Local Law entitled "A Local Law in relation to an
Amendment to Chapter 260, Vehicles and Traffic, in connection with Traffic and
Pedestrian Safety" now, therefore, be it
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at Southold Town Hall, 53095 Main Road, Southold,New York, on the
18th day of May,2021 at 7:01 p.m. at which time all interested persons will be given an
opportunity to be heard.
The proposed Local Law entitled, "A Local Law in relation to an Amendment to Chapter

A Local Law entitled, "A Local Law in relation to an Amendment to Chapter 260, Vehicles
and Traffic, in connection with Traffic and Pedestrian Safety".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The purpose of this local law is to improve safety for pedestrians and vehicles, as well as
dealing with impacts to the public's health, safety and welfare.
II. Chapter 260 of the Code of the Town of Southold is hereby amended by removing the
struck through portions and adding the underlined portions as follows:
Article IV Truer Vehicle Traffic
§ 260-26 Restricted true! vehicle traffic.
A. Purpose. The Town Board of the Town of Southold finds that, with the increasing
development and population of the Town of Southold, transportation activities are
increasing and impacting the local streets. Regulation of tfu&vehicle usage on local
streets is necessary so as to provide for the safety and welfare of the Town's citizens and
for the orderly flow of vehicular and pedestrian traffic on busy local streets. There are
numerous other alternate local streets linking state and highways in the area.
B. Vehicles, trucks, tractors, tractor-trailer combinations, tractor-semitrailer combinations
or tractor-trailer-semitrailer combinations in excess of a registered weight of 10,000
8,000 pounds are prohibited from traveling upon the following streets. Such exclusion
shall not be construed to prevent the delivery or pickup of merchandise or other property

front line of the rear yard and situated between the side line of the main building or

chapter, lot lines opposite a secondary front lot line shall be deemed a side yard and shall
have a minimum width equal to the minimum side yard requirements of the zoning district
in which located.
§ 280-105 Height of fences,walls and berms.
Fences, walls or berms may be erected and maintained, subject to the following height
limitations:
A. When located in the front yard of residential zones, the same shall not exceed four feet in
height. When located in the front yard of nonresidential zones, the same shall not exceed
six feet in height.
B. When located in or along side and rear yards, the same shall not exceed 6 1/2 feet in height.
C. When located in or along a secondar front the same shall not exceed 6 1/2 feet in
height and shall be set back from the secondary front yard line no less than 10 feet.
DE. In residential and nonresidential zones, except properties/parcels engaged in bona fide
agricultural production, the installation of a deer exclusion fence may be permitted by
obtaining a building permit issued by the Building Inspector, subject to the following
criteria:
(1) When located in or along side and rear yards, the height of the deer exclusion
fence shall not exceed eight feet.
(2) When located in or along a secondar font yard the height of the deer fence shall
not exceed eight feet in height and shall be set back from the secondar font yard
line no less than 10 feet.
(4 ) Specifications for construction of deer exclusion fences:
(a) Fencing fabric: high-tensile, woven wire fence fabric with graduated
opening.
(b) Spacing between posts: 20 feet.
(4) Deer fencing is prohibited in or along the front yard or primary front yard of any
property.

A. This section is intended to provide minimum standards for granting of a building permit for
the principal buildings of lots which are recognized by the Town under § 280-9, are
nonconforming and have not merged pursuant to § 280-10.

(1) When located in or along side and rear yards, the height of the deer exclusion
fence shall not exceed eight feet.
(2) When located in or along a secondary fi-ont yard the height of the deer fence shall
not exceed eight feet in height and shall be set back from the secondary front yard
line no less than 10 feet.

III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of
competent jurisdiction to be invalid,the judgment shall not affect the validity of this law as a whole or
any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect after filing with the Secretary of State as provided by law.
I have recommendations from the Planning Board, LWCC and it says, 'Pursuant to the
requirements of sections 1414 A to 25, of the Suffolk County Administrative code,the above
referenced application submitted to the Suffolk County Planning Commission is considered to be
a matter of local determination and there is no apparent significant' and this is from the Planning
Board, supports the amendment as consistent with the comprehensive plan, the amendment will
reduce some non-conformities without unduly affecting community character by providing
setback relief to lots located on corners. And LWRP, they find it consistent with the policy
standards. I have an affidavit of publication in the New London Day and Suffolk Times and on
the Town Clerk's bulletin board and that's it.
SUPERVISOR RUSSELL: Would anyone like to address the Town Board on this local law?
ROB HERMAN: Good evening, it's Rob Herman from En-Consultants in East Hampton. How
are you? So I just have a couple of quick comments on the proposed code. One, I think it's great
that you all are doing this, we deal with this, the two front yard dilemma pretty often both in
connection, particularly on the waterfront and particularly pre-exisiting, non-conforming lots

both in connection with wetland permits and zoning. Two substantive comments would be, one,
is I while I do think that it's great, I am not sure that it goes far enough, particularly with the lots
that are less than 40,000 square feet where basically you are creating a 25 foot secondary front
yard which is only 10 feet less than the 35 required for primary and the same thing for lots that
are 20,000 to 39,999 square feet where you would have a secondary front yard of 30 feet as
opposed to the required 40. I have a handful of these applications right now that are sort of held
in abeyance pending the outcome of this and I think that in all but one case, the change in code
wouldn't change the situation, there would still be applications going into the ZBA but if you
went down another 5 feet for each, most of those would then be resolved. So that would just be
one suggestion because you know, it almost becomes you are not quite deciding to treat it like a
side yard which I understand, but if there isn't, if the relief is really minimal, it probably is not
going to help as many people as you hope to help and probably will not reduce the case load in
jfront of the ZBA as much as you think it will, if those are two of the primary objectives to this
which I am just assuming is the case. And then my second comment which I am not sure if it
relates directly to the spirit of what you are doing but sometimes when we deal with these issues
Iover and over again when there is a proposal to make a change to something, it's kind of our one
chance to kind of speak up with some suggestions which you can do with as you wish and that
relates to the proposed change to definition of the yards, most particularly the rear yard because
that's where you pull in the issue of the location of accessory structures which except for
waterfront lots, as you know accessories can only be in the rear yard. The language of this
definition I think continues to be very broad when it states that the depth of the rear yard shall be
measured between the rear line of the lot and the rear line of the main building or structure and
there is no additional defining language of what the limit of that main building is and the reason
that I raise that question is because we are constantly dealing with the dilemma of swimming
pools and whether they are located in a rear yard or a side yard and of course, if they are located
in the side yard it is a truly detached accessory and they are not allowed to be there and so what a
lot of property owners are doing and we are seeing this a lot in the past year as you have a huge
influx of people moving out here and building swimming pools, is they are 'attaching the pools to
the house through an extended raised deck or raised patio' because if the pool is treated by the
building department as a so-called addition to the house, the pool can then be located in the side
yard where it is not supposed to be if it is a detached structure. And so, sort of an unwanted
consequence of that in a way is you are really increasing the lot coverage of a lot of properties
particularly along the waterfront because this is a common mechanism of avoiding the ZBA and
so you get in a situation where you are telling the homeowner that if you wrap a deck or a raised
patio around the pool then it is part of the house and can be in the side yard but if there was no
deck and patio and there was just a pool on the lawn, well now it is a detached accessory and it
has to go to the ZBA. So I know that that's not something that you are necessarily dealing with
with this section of code but I think there is an opportunity to help with it because I am often
struggling with clients and the building inspectors to figure out what is the rear line of the house.
So obviously the habitable condition space and the rear side of the house itself is a pretty obvious
limitation there. But what happens if you have a covered porch, does the rear yard then begin at
the outer limit of that covered porch, that still sounds logical because it's roof, but what happens
in the cases of the uncovered porch? The raised deck that is open to the sky, the raised patio that
is open to the sky? If these are attached to the house; I believe that it is the building departments
standard practice to consider the rear edge of that open deck or open patio as the beginning of the

rear yard. Which means again, you can't put a pool to the side of that structure because now
even though it is not really to the side of the house proper, it's to the rear of the house proper, it's
to the side of the deck or patio, it's again considered to be in the side yard. So, I am just
wondering if as the Board contemplates adopting this that there would be some opportunity to
explore and include a little bit more defining language when you are using terminology like the
rear line of the main building. You know, what exactly defines the entirety of the main building?
Is it anything that is attached to the house or is it just a roof portion of any structures that's
attached to the house etc.? If nothing else, that gets you thinking about sort of the follow up
conundrum here that I think should be addressed at some point in terms of accessories in a side
yard, is an accessory versus sort of an attached accessory if you will. I know that is a mouthful
but it's something we have been contending with, with a lot of property owners in the town for
many years running now so I wanted to get a chance to mention both of those things to you.
COUNCILWOMAN DOHERTY: Thanks, Rob.
SUPERVISOR RUSSELL: I just want to say, there's a lot of what you said I certainly agree
with. One of the problems with the code is that there are a lot of sections that in my view, are
not necessary to protect the character of any given residential setting and yet there's also sections
that are overly permissive that there is, it is leading to some pretty fundamental changes in the
character of any community setting, so it's going to be tough row to hoe in the future, but I would
agree on some of the stuff, the building department that needs better language. I think they are
applying the code as best they can based on historic interpretation but I would agree, things like
main dwelling or building can be a little bit nebulous.
TOWN ATTORNEY DUFFY: Rob, I understand what you are trying to say, really hyper-
technical and it's hard to get into too much detail here but I thought that this revised definition of
what you are addressing, at least in part of what you were saying, so maybe if you can call we
can discuss it further (inaudible) I think I know where your issue is and I would love to address it
further because I think it is a problem and I tried to address it with this definition.
MR. HERMAN: I would be happy to.
COUNCILWOMAN NAPPA: Just for clarification, that first point that you made about
setbacks, was that just for front yard setbacks? You were saying maybe 5 feet more?
MR. HERMAN: Right. So the first part of what I was saying which is more precisely related to
what you are working on here is that it's fantastic that your'e proposing this code change that is
creating a relaxed setback for what would be considered the second or now be called the
secondary front yard. but I think if you went five feet further with that relaxation, I think it
would go a long way to helping more property owners who are stuck in the two front yard
dilemma and reduce the ZBA caseload further. And I am just saying that because if you do have
a lot, for example, that is 20,000 to 40,000 square feet which is an awful lot of properties in the
R-40 zone, the secondary front yard setback that you are proposing in this version of the
legislation is 30 feet as opposed to the 40 feet that is and would be continued to be required for
the primary front yard. I think if you went down to 25, it would be more effective at

accomplishing what I am assuming your goals are which is to provide more relief to these
homeowners and decrease some of the caseload that has gone to the ZBA which are typically
approved because the ZBA, I think, has always been reasonable in their handling of reasonable
applications and you know, the people who have the two front yards and I mean, I was just in on
one of these not long ago on Nassau Point, you know, where you've got 20 some odd of these
walking right of ways from the boulevard to the bay that are treated as front yards, so you have
got these narrow, wooded walking pathways that really stretch from the road in someone's front
j yard, past their side yard, their rear yard, they really are truly side yards but they are regulated as
front yards. And so I think if you went a little further, even just 5 feet further in these setbacks, it
would be more helpful. I mean, you still wouldn't be going to 50 %relief which would be a lot,
50, but right now going from 40 to 30 really isn't a big change. just to give you some context,
the Town of Southampton in connection with their wetlands law did something very similar to
what you are doing right now many years ago, where the wetlands setbacks which would push
dwellings much closer to the road because they were being chased from the wetland boundary,
the town basically built in this automatic relief where the required front yard setback would be
reduced by 50%. And so the purpose of that was to allow people to successfully move farther
from the wetland without dumping all of these additional cases in front of the ZBA who would
I say, of course we are going to grant this relief because you are trying to move further from the
wetlands. Again, within reason and there could always be a minimum, you could say 50%but
no closer than this because there maybe some standard that you just don't want you know, even
as a secondary front yard, you know, people's houses to be closer to but I do think jumping from
40 to 25 and 35 to 20 would be reasonable as part of this code change.
COUNCILWOMAN NAPPA: Bill, on the code that we have, under the secondary front yard, it
shows like,you are talking about, there is a number in parentheses after the 25 and the 30, what
were those? The 15 and 20?
TOWN ATTORNEY DUFFY: For the rest of the Board, we are talking about (inaudible)the
code changes to that and those numbers in parentheses should have been deleted from the
publication, those were the numbers where we started with and when we had further discussions,
we kept the numbers in parentheses to show the Board where we started, this was a struggle for
the Board, there was a lot of different opinions with regard to safety on these corner lots and
what was the right number for the secondary front yards should be and we started with the 15
and settled on 25 and for lots less than 20,000 and for lots between 30,000 and 39,999 we started
at 20 and ended up at 30. So the proposed local law (inaudible).
MR. HERMAN: So Bill, I unknowingly suggested a precise compromise between those two
numbers.
TOWN ATTORNEY DUFFY: I just want to address one thing, I understand your concerns and
at least with the changes to the front yard definition, I think we did eliminate the walking right of
way issue. Because we changed the definition and took the right of way out and just figured out
where the street line is so if something is not a definition of street, it would not have the same
issue as in the past, it would not be considered front yard in those cases where you just have a
central path for walking, it would not be (inaudible).

KERRY: Okay, hi everyone. I am sure Mr. Russell and Ms.Nappa are very tired of reading all
of my emails that I have been sending for a little bit over a year now regarding the heavy traffic
and speeding traffic on Peconic Bay Boulevard.....
SUPERVISOR RUSSELL: Kerry, I don't mean to interrupt, I am just going to ask if we can get
the public hearing closed and then we want to hear from you regarding Peconic Bay Boulevard
but we are in the middle of a public hearing, so I just want to make sure that people get a chance
to comment on that and then we will kick it back to you, if that's okay.
KERRY: That's absolutely fine.
SUPERVISOR RUSSELL: Okay, is there anybody out there that wants to comment on this
particular local law?
MERYL KRAMER: Hello, this is Meryl and I guess everyone can hear me okay? Very briefly I
just want to say that I am also in favor of this code change and that I do work oftentimes with
Rob Herman and I echo many of the things that he explained and I don't feel like I need to repeat
them and I also do think that some sort of additional decrease in the second side yard would be
helpful without being overly permissive. I think what, it's very frustrating because so many
projects always have to go to the ZBA and each property is unique and it seems to kind of create
it's own issues, so I can understand and appreciate the difficulty in writing a code that has to
address a universal approach but anyway, I do support what you are doing and I just wanted to
say thank you.
SUPERVISOR RUSSELL: Would anyone else like to address the Board on this public hearing?
PATRICIA MOORE: Hi, thank you. I do want to have an opportunity to address this. I, like
Rob Herman, applaud your desire to incorporate some relief to the code. I thought what Ms.
Nappa had pointed out, those italic numbers, and it left me confused as to which numbers applied
but thank you, that clarified that what's in the brackets is where you started and I guess where
you ended is by example on lots that are less than 20,000 you ended up at 25. I would agree with
Rob, it does not go far-enough and in fact, when you do go to the Zoning Board of Appeals you
actually can get relief at 15 from a front yard and when the lot is 20-39,999 is going to 20, that is
not out of the ordinary requested relief but if you feel uncomfortable, that that number is too
close, I would encourage you to at least come to the compromise in between. The numbers that
you proposed won't do much to decrease the case load and you know, as you point out, the
secondary road, it's the people's side yard and placement of structures, accessory structures, it's
always difficult and challenging to locate a house. So I definitely am in favor of this, I don't
want to go over everything Rob said but yes, please adopt this regulation and certainly adopt one
that is, I prefer the numbers in the italics versus the numbers that you propose but you have to
come to the middle ground, that's fine, that's certainly better than what is being proposed. Thank

FRANK LUPINACCI: I just wanted to jump in from the perspective of an owner of one of these
types of lots that Rob and I think it was Patricia and I am sorry, the second person that was also
in favor of going a little further. I and my wife are owners of a lot exactly like this, we actually
have one of these rights of way, it's not a walking path, it sounds like we would be in better
shape it if was but it's actually a paved driveway and I will tell you it is very difficult for us to do
the things that we would like to do because of the fact that the setbacks are what they are and the
reality is probably what Patricia just said, it really is our side yard when it is treated as a front
yard, so I just wanted to jump in with that perspective of an owner of one of these properties and
echo what Rob and Patricia and the other person in support of it and thank you again for all of
your efforts to relieve this.

KERRY: Okay, like I started saying before, Mr. Russell, I apologize and Ms. Nappa, I apologize
for over a years worth of emails going back and forth trying to get in touch with the
Transportation Commission regarding the heavy speeding traffic on Peconic Bay Boulevard and
this was a matter to came to my concern when we moved in, I have lived on the north fork for
the past 20 years but we recently moved about 1 1/2 years ago from Aquebogue to Peconic Bay
Boulevard and the main reason that we did this was to get into a better school district, to get into
a better community. We absolutely love it out here, my husband has worked in the high school
for 20 plus years now, but as we moved in, as we were putting all the (inaudible) in the front of
the house, there was a gentleman riding a bicycle and he was pulling behind him one of those
baby strollers and a truck came flying down the road which he came very close to hitting this
man and he was knocked off his bicycle and he did not have enough time to grab his baby, at that
point, I saw the main concern and I decided to put in everyone's mailboxes which I was
reprimanded by the post office that we cannot do that, I put out a petition asking for suggestions
and concerns on the Boulevard and I was unable to reach the people that had post office boxes
but I reached the people that had regular mail boxes and I was able to get signatures and petitions
from over 40 homes from Laurel Lane all the way to Bay Avenue and I gathered over 100
signatures that this was now way too dangerous. And you know what? I am sure everybody
drives down this road because it used to be scenic. It used to be peaceful, it used to be a quiet
way home but nobody is considering the people that actually live there. The speeds that people
travel, very dangerous. There is no shoulder. People are riding bikes,jogging, walking their
dogs. Now it's just a hazard. Waze, GPS has ruined this road for all of us that live there. Yes, I
know that prices of homes out here are sky rocketing but when this all calms down, people's
houses are going to lose value because this is now the new Main Road and the new Sound
Avenue because it was referred to I believe it was, I believe it was Mr. Orlando, he even referred
to this road as the BQE. We have people racing up and down this road all day and all night. We
can't keep our windows open because the road noise is absolutely insane. We came up with
signs and I am sure you have seen them, not aesthetically pleasing, not what we wanted to do.
Some people abide by them but just the other day, we had somebody that decided at every,
starting at Delmar and at Bray to stop their car and floor it, leaving marks 50 yards or more in
front of our houses. People, if you drive the speed limit on this road, you get passed by 60 miles
an hour or more. If you are outside doing yard work and you signal for people to slow down,
you get yelled at, you get cursed at. We have large groups of motorcycles coming down here, I
counted one time sitting out on my back deck, we counted I believe in one pack there were 28
people in one group. Limousines, all sizes, all day long from, and this is no longer just a
seasonal issue, this is all year round. Not only do we have limos, we don't want that in front of
our homes, all sizes. We have limo buses, they are letting their patrons out to urinate and vomit
in our lawns; on our property and on the wooded areas. That is vile, that is disgusting and you
would not want that in front of your homes. I apologize but this has been over a year and I do
get responses here and there but I feel like for all of us it has been falling on deaf ears. I have
been working with Chief Flatley closely and he did do the speed monitoring, I am still waiting to
get that data but since then, we have had more police presence but they are very limited because
they can't be here all the times. So we are looking at the dangers of this road, and you are now

having an amount of traffic that if you look at the Waze app at any given point during the tourist
season, our road is jam packed bumper to bumper. We have people drinking at the wineries, the
breweries, now we have the legalization of marijuana down the line. People are distracted
driving. I have watched them,they are looking at their phones, looking around,people driving
taking pictures down our road, they are crossing the double yellow lines, a limo was driving at
me coming head on because he had his phone talking to one of his patrons in the back. I literally
had to pull onto someone's lawn and for that I do apologize. But if we look at it, limos are a big
problem out here, this is another one of my pet peeves. We remember the accident on Route 48.
We have had several hit and runs, we have had deaths of pedestrians due to drunk driving, there
is no reason to have this on Peconic Bay Boulevard and there are multiple reasons for it. There
is going to be a death and the people that live here, we have no respite. We (inaudible). We don't
have that, we don't have our weekends anymore, the tourists, they come out, they get to enjoy
their weekends, when we are in our homes, our windows have to be closed because of the road
noise. And I am not too sure, I sent out a video, it took me awhile to create it but it's about a half
an hour long, I sent it to the Transportation Commission,to Chief Flatley, it was a day in the life
on Peconic Bay Boulevard. A box truck driving on the wrong side of the road. We have one
motorcycle, a green motorcycle that will do, I would say, 70 to 80 miles an hour two to three
times a day when the weather is nice. There is no margin for error here. At least on 25 and
Sound Avenue, you have a shoulder. People want to get out,they want to walk, they have no
where to go, so I mean, right now I am trying to be the voice for many, many people on the block
instead of you guys getting bombarded with daily emails and not being able to keep track, I am
trying to filter everything through me so I can organize and eventually get it to you but I believe
Ms. Nappa, did you share that letter that I just wrote the other day with the committee?
COUNCILWOMAN NAPPA: I shared the letter and the video with the Town Board members.
KERRY: Oh, that long, lengthy video? I apologize, but that was, it was scary and we put
! together as much information as we could but we need to be removed from Waze. I am sorry,
this is not a road for that and unfortunately people already now, they don't need Waze anymore,
this is just their alternate route. You would not want this in front of your home. We need to get
rid of limos, direct there somewhere else. Put them up Laurel Lane, block off Bay, Sigsbee and I
am sure all the people on this road feel the same way I do. And I would be more than happy to
get their opinion as well. Somebody on the road would love to block off Peconic Bay at Laurel
Lane because we have that bridge that has been in for repair several times, it cannot
accommodate that traffic, especially people walking and jogging. And I see on the other side of
that bridge and I watch elderly people, and I am probably getting to that age, they are walking
their dogs, people that have lived here and their roots run deep here. This is not the way they
should have to live. I am suggesting speed cushions, much different than speed bumps. These
are removable. The allow for ambulances, fire trucks, because they can straddle it. You know;
and yes, we would love a police presence and we do have a police presence now more than ever
but you know what? As soon as they pass that officer, they floor it. I am purposely, I am having
this meeting downstairs where you can't hear it because upstairs we are trying to have the
windows open, and it's just car after car after car. Something has to be done here, we really have
to redirect the traffic, privatize the road, do something. Because I have well over 100 signatures,
I don't mean to be complaining but this has been over a year and when I am witnessing these

things and we are getting yelled at, this is not the way we should have to live. I apologize, this is
a mouthful and I apologize to everybody that is being bombarded. I just felt this was falling on
deaf ears.
SUPERVISOR RUSSELL: Sarah, you can let her know that we just noticed.
COUNCILWOMAN NAPPA: Kerry, thank you for coming and presenting your issue.
Obviously, it sounds awful, I do feel for everyone that is experiencing that. So tonight we,
during one of the resolutions, we set a public hearing to put a weight limit on the whole stretch of
Peconic Bay Boulevard that is in Southold Town which would match the weight limit that is on
the bridge which is 8,000 pounds, so that public hearing is going to be on May 18th at 7:00
where we will hear from the public about that. I know this is a big problem and we are going to
do what we can to chip away at it and I think the weight limit is a good place to start because that
will divert the traffic, some of those bigger, the box trucks and the limos will have to go back to
the Main Road so, again, it's a big problem, I know and I do want to working on it and start
chipping away at it. So this is our first step.
KERRY: I greatly appreciate that. I mean, I do love the fact that, I can't tell you how much a
regular stretch limo weighs at this point but this is a step in the right direction and I appreciate
that but I would love to be on a committee to specifically work with this because I would
honestly like to be proactive rather than reactive. We see it, you hear about it but we are the ones
witnessing it and the other day with the stretch marks, burning rubber whatever you want to call
it, we heard it, it was a horrific sound and the first thing I did was I ran outside because my 14
year old son was out riding his bike and god forbid that car lost control and hit him and believe
me, Ms. Nappa, I appreciate this and we are going to start chipping away at this together and I
mean, I understand, I just don't want this road to turn into western Suffolk,Nassau County.
Believe me, I work in Nassau County, I want to escape it as quickly as possible but if we don't
have the police force do this, when we have the tourist traffic out here, the police force cannot be
sitting on our road at every block. We don't have the manpower, so we need to have some self-
regulation and installing these speed cushions, I have done the research on it and lowering the
speed limit to 25, putting in cross walks, I put a full bullet list for everyone to review and I
apologize but this is something I am passionate about because cars racing all night long, 1, 2,
3:00 in the morning and all day long, it's insane and what you have seen from my video. What,
28 minutes of watching that pleasurable thing and that was just one weekend, a day and a half.
So now, it's just year long and now the locals, I spoke to Chief Flatley and he said most of the
tickets came from the locals and when I tell you they are hauling, they are going 50 plus miles. I
want to get rid of our signs, I want to get back to a way of living where it is peaceful and we
want to enjoy our homes and not worry and with the limos allowing the patrons out that, I am
sorry; that is a huge issue.
SUPERVISOR RUSSELL: Just a few things, I know we have emailed back and forth a few
times over the last year or so, there's just a couple of issues. First of all, the four ton, the new
standard which will be a four ton limit should take care of most of the larger vehicles, busses,
stretch limousines. I think the old limousines might come a little bit under but there are so few
of those out there anymore but you know, speeding, when sat down with the Chief a few years

{ ago, I had researched, I saw that there's equipment that you can mount on poles that capture data,
speeding is a town wide challenge and most of the roads are similar to Peconic Bay in terms of
they are narrow with no shoulders, so I thought we should buy the devices, capture all the data
and highlight the times where the speeding is at its worse and do our enforcement around that,
we could do that throughout the community to sort of allocate our resources at times where they
are most needed. So, I know that is already underway, he has already identified during the day
that has a higher incidence of speeding, you know,just so you know, I know the issue of cross
walks, we have had requests over the years but I think one thing, we can't have illusions here.

We are going to try to solve the speeding, we are going to solve the over size vehicles with the
proposed code but the issue of traffic itself is going to be very difficult to challenge because the
entire town has become jam packed with vehicles on an infrastructure that was never designed to
hold the type of volume that we are seeing. So I don't think traffic in and of itself is going to be
an easily solvable or even solvable problem. Motorcycles, you mentioned, the problem with
motorcycles is they are permitted and we are not allowed to say no motorcycles on a particular
public road so, as long as their muffler systems comply with the MVA, they are allowed. So
there is a lot of challenges here, and with the crosswalks we have had requests for but you have
to remember with all this increased traffic, if you put crosswalks in, that creates stops and those
stops leads to more gridlock and more logjams up the road. So every time you bring a solution
to the table, you might push the problem, almost like pushing on a water balloon over to another
issue. So those are all those challenges we are trying to balance, I think as Councilwoman
Nappa was trying to say,there's a lot of issues here that we are going to try to take on one at a
time. No singular solution but we try to hopefully come up with a series of lesser ones that will
sort of culminate in something that we will try to address the issues here as best we can.
KERRY: I truly really appreciate, I feel your pain. It's just to a point that it's almost not a
desired place, I mean, it really ruining the quality of life. I mean, I understand that but now the
businesses out here, although thriving, believe me, I am an economic major and I am a business
teacher and I understand it is critical for these businesses out here to thrive but now it's at the
expense of the local residents and these side streets should not be used and believe me, I know
that you are trying to do the roundabout at Love,Lane, I know that you are trying to keep traffic
flowing but like you said, if you put up a crosswalk, it's going to stop traffic and it's going to
reroute it. You have the lights, the lights cause people to stop and now people want to come
down this road. We didn't have the massive amounts of traffic five years ago but now we do and
we do need to taken off of Waze and GPS, we have to confront that. They have done it in other
states and you know, they were bringing people from going over bridges, traffic was being
rerouted through residential neighborhoods and they actually had to do it, they had to take it off
of Waze, I know the people that live here are very, very upset. Maybe privatize this road, what
actions would we have to do, I don't know. And this is something we are going to have to chip
away little by little but I know there's going to be continuous videos, I know because Peconic
Bay is not the only issue here but I think I am the one that's taking this on but I know this issue is
so challenging but we really would like the quality of life and we would love to enjoy our homes
too. You know, the tourists are enjoying it but we can't enjoy where we live and I don't mean to
be mean but it's so frustrating, if you lived here, you see it when you drive through but if you
lived here, it's a whole different scenario. And I mean, I know you understand I know it's a

challenge but I am asking that we stay in touch and it doesn't get pushed aside. And this is
something that we can continuously have dialogue about.
